Ministry of Construction proposes relaxed road transport business conditions

A draft decree revising road transport regulations has been introduced to remove obsolete business conditions while promoting the application of information technology in the settlement of administrative procedures.

The Ministry of Construction (MOC) has submitted a draft decree revising regulations in the road transport sector to the Central Committee of the Vietnam Fatherland Front, related ministries and agencies, provincial-level People’s Committees, the Vietnam Chamber of Commerce and Industry, and automobile transport associations to solicit opinions.

The proposed amendments cover Decree 158/2024/ND-CP on road transport activities, and Decree 165/2024/ND-CP detailing and guiding the implementation of the Law on Roads and the Law on Road Traffic Order and Safety.

The draft reduces and simplifies business conditions for automobile transport, removing requirements that are no longer practical or likely to create unnecessary costs and delays for enterprises.

The MOC also proposes streamlining procedures for the issuance and revocation of transport business licenses, vehicle badges and international transport permits. The entire process of submitting and processing dossiers and receiving results would be conducted electronically through the VNeID platform, which is expected to help businesses save time and travel costs.

In addition, numerous regulations on transport business conditions would be adjusted to eliminate unnecessary requirements, such as proof of vehicle ownership or complicated managerial requirements. Enterprises would be allowed to submit electronic or certified copies of original records instead of notarized originals, provided authenticity is ensured.

Procedures for vehicle leasing, making partnership contracts and financial leasing would also be relaxed, giving businesses more flexibility in mobilizing vehicles.

Remarkably, the processing time for issuing or reissuing vehicle badges would be shortened to just two working days. Enterprises could also apply for renewal 15 days before expiry, a change expected to benefit large transport firms owning hundreds of vehicles.

Currently, Vietnam’s road transport sector has over 70,000 businesses with hundreds of thousands of vehicles, forming a critical part of the domestic logistics chain.

Reducing business conditions, digitizing administrative procedures and enhancing power decentralization are seen as practical measures to help lower national logistics costs, which remain high at 16-17 percent of GDP.

Once approved, the draft would help businesses save hundreds of billions of Vietnam Dong each year by cutting paperwork, printing, certification and inspection costs. The shift to electronic management through VNeID would also improve transparency and regulatory oversight.

This draft is a concrete step to institutionalize Resolution 66/NQ-CP, aiming at building a digital government and a modern and equitable business environment for the transport sector, while ensuring traffic order and safety nationwide, according to the Vietnam Road Administration.
