The Law Amending and Supplementing a Number of Articles of the Law on Judicial Records 2025, No. 107/2025/QH15, shall take effect on July 01, 2026, and focuses on amending key provisions to create a synchronous legal framework for judicial record management in the new period.
Key points of the Law include:
- Recognizing the legal validity of electronic judicial record cards: The 2009 Law only stipulated judicial record cards in paper form. Meanwhile, the Law Amending and Supplementing the Law on Judicial Records 2025 stipulates that judicial record cards, which shall be issued in electronic or paper form shall have equal legal validity.
- Uniform use of personal identification numbers in judicial records: The amending Law has replaced the phrase “serial number of the identity card” with “personal identification number” in various articles, such as Article 16, Article 26, Article 37, Article 42, and Article 43.
- Transfer of judicial record management from the Ministry of Justice to the Ministry of Public Security: The Ministry of Public Security shall assume the prime responsibility for, and coordinate with the Supreme People’s Court, the Supreme People’s Procuracy, the Ministry of National Defence, and the Ministry of Justice in prescribing coordination in carrying out procedures for the retrieval, exchange, and provision of judicial record information and verification of conditions of automatic conviction remission as prescribed in the Penal Code.
- Supplementing age conditions when requesting the issuance of judicial record cards: Vietnamese citizens and foreigners who resided or are currently residing in Vietnam and aged full 16 years or older may request a competent agency to issue their Judicial record cards.
- Prohibition of requesting Judicial record card No. 2: Judicial record information and Judicial record cards shall be managed and used under the law on personal data protection applicable to sensitive personal data. Agencies, organizations, and individuals shall not request other individuals to provide Judicial record cards No. 2 as prescribed in Article 43 of the Law.
