Cease the effectiveness of 2 Circulars in 2022 on e-procurement

On July 29, 2022, the Ministry of Planning and Investment issues Circular No. 16/2022/TT-BKHDT on ceasing the effectiveness of Circular No. 08/2022/TT-BKHDT and Circular No. 10/2022/TT-BKHDT.

In particular, the Ministry of Planning and Investment prescribes:

- To cease the implementation effect of the Circular No. 08/2022/TT-BKHDT on elaborating provision and publishing of information on bidding and selection of contractors on Vietnam national e-procurement system from August 01, 2022 to September 15, 2022.

Particularly, the provisions on the road map for application of e-selection of contractors for the packages prescribed in Clause 1, Article 37 are ineffective from August 01, 2022 to January 01, 2023.

- To cease the implementation effect of the Circular No. 10/2022/TT-BKHDT on elaborating provision and publishing of information on bidding and selection of contractors on Vietnam national e-procurement system from August 01, 2022 to September 15, 2022.

In the time of ceasing the implementation of Circular No. 08/2022/TT-BKHDT and the following regulations shall be effective:

Circular No. 05/2015/TT-BKHDT

Circular No. 14/2016/TT-BKHDT

Circular No. 04/2017/TT-BKHDT

Circular No. 05/2018/TT-BKHDT

Circular No. 11/2019/TT-BKHDT

Circular No. 05/2020/TT-BKHDT

- Articles 7, 8, 9, 10, 13 of the Circular No. 06/2020/TT-BKHDT;

- Clause 4, Article 8, Circular No. 09/2021/TT-BKHDT.

For the purchasing packages of multi-components

In the packages which issue the bidding document before January 01, 2023, the contractor selection shall be carried out according to the issued E-HSMT and effective regulations of the governing law at this time;

- From January 01, 2023, if the approved bidding package fails to apply e-selection of contractors and its bidding document has not been issued, the e-selection of contractors shall be carried according to the road map specified in Article 37 of Circular No. 08/2022/TT-BKHDT. For this case, the competent person shall not revise the plan for the selection of contractors.  Circular No. 16/2022 takes effect on August 01, 2022.
