To tighten the management of sea encroachment activities, the Government has recently required the identification of specific coastal locations, areas, boundaries, and coordinates of to-be-encroached sea areas to comply with the survey and mapping law.

To tighten the management of sea encroachment activities, the Government has recently required the identification of specific coastal locations, areas, boundaries and coordinates of to-be-encroached sea areas to comply with the survey and mapping law.

Under Decree 42/2024/ND-CP dated April 16, the determination of sea encroachment areas must be included in land-use master plans and plans.

In addition, it must help maintain national defense, security, sovereignty, sovereign rights, jurisdiction and national interests at sea and comply with relevant laws and treaties of which the Socialist Republic of Vietnam is a State Party.

Sea encroachment activities must also be based on the adequate evaluation of socio-economic and environmental protection reality, thereby ensuring sustainable national development, biodiversity and natural elements, and take into account impacts of disasters, climate change and sea level rise.

The Decree also requests reasonable exploitation and efficient use of marine resources, ensuring the harmony of interests of organizations and individuals engaged in sea encroachment activities and related organizations and individuals, while guaranteeing the people’s and communities’ rights to access the sea.

Provincial-level People’s Committees will be responsible for determining and including to-be-encroached sea areas in their land allocation and zoning plans depending on functional zones and land categories in district-level administrative units specified in provincial- and district-level land-use master plans and plans.

In case a to-be-encroached sea area is already included in a provincial-level master plan, construction master plan or urban master plan but has yet to be included in a district-level land-use master plan, the provincial-level People’s Committee will direct its inclusion in such district-level land-use master plan.

In case a sea area identified for sea encroachment has yet to be included in a provincial-level master plan, the provincial-level People’s Committee will direct the district-level People’s Committee to include such area in the annual district-level land-use master plan and plan.
