Decree 217/2025/ND-CP on specialized inspection issued

Decree No. 217/2025/ND-CP on specialized inspection activities was officially promulgated on August 5, 2025.

According to Article 3 of the Decree, specialized inspection is conducted with the following purposes:

(1) Specialized inspection means the examination, assessment, and handling conducted by competent authorities or persons regarding the compliance with sectoral laws by agencies, organizations, and individuals under state management in specific sectors or fields.

(2) Specialized inspection aims to rectify and enhance compliance with sectoral laws; to prevent, detect, and timely handle violations through the application or recommendation of lawful measures by competent authorities; thereby contributing to improving the effectiveness and efficiency of state management.

Through specialized inspections, competent authorities may request or recommend inspection authorities to carry out inspections where necessary; in case signs of criminal offenses are detected, the matter shall be referred for criminal prosecution and relevant case files and documents shall be transferred to investigation authorities for further consideration and decision on prosecution in accordance with law.

Article 6 of the Decree stipulates the competence for specialized inspection as follows:

  • Ministers and heads of ministerial-level agencies have the authority to conduct specialized inspections within their respective state management scope.

  • Heads of affiliated units under ministries or ministerial-level agencies may conduct specialized inspections over organizations and individuals within the scope delegated or authorized to them.

  • Directors of sub-departments and equivalent units under ministries or ministerial-level agencies may conduct specialized inspections over organizations and individuals within their delegated management scope.

  • Chairpersons of People's Committees at all levels have the authority to conduct specialized inspections over organizations and individuals under the state management of their respective Committees.

  • Heads of specialized agencies under People's Committees at all levels have the authority to conduct specialized inspections over organizations and individuals within the scope of state management assigned to them for advisory purposes.

  • Directors of sub-departments and equivalent units under provincial-level specialized agencies have the authority to conduct specialized inspections over organizations and individuals within their delegated management scope.
