Guiding the implementation of trade remedies in the RCEP Agreement

On March 23, 2022, the Ministry of Industry and Trade issues the Circular No. 07/2022/TT-BCT guiding the implementation of trade remedies in the Regional Comprehensive Economic Partnership (RCEP).

On March 23, 2022, the Ministry of Industry and Trade issues the Circular No. 07/2022/TT-BCT guiding the implementation of trade remedies in the Regional Comprehensive Economic Partnership (RCEP)

Accordingly, the Circular guides the anti-dumping measures and countervailing measures as follows:

- Notice: The investigating authority is obliged to notify at least 7 days in advance to the related parties about the plan and contents of the on-site investigation to verify the information provided by the related parties, provided that the notification does not affect the prescribed time limit for investigation of the case.

- Methods for calculation of the dumping margin:  When calculating the dumping margin, the investigating authority must include all the individual margins, regardless of the positive or negative results, to the overall margin of each foreign manufacturer or exporter.

- Announcement of material data:  At least 10 days before the last decision is issued, the investigating authority is obligated to announce in writing material data in the draft final investigation conclusion.  

- Processing confidential information Upon providing confidential information to the investigating authority, related parties must provide a written summary of such confidential information....

This Circular takes effect on May 08, 2022.
