Maximum brokerage service fees for sending Vietnamese workers abroad

From June 30, 2026, the regulations on the maximum service prices under brokerage contracts for sending Vietnamese workers abroad under contracts are officially governed by Circular No. 09/2026/TT-BNV.

Compared with the previous regulations, the calculation of the maximum brokerage service price based on the worker's working period and wage remains unchanged. However, the appendices, forms and market-specific provisions have been revised and replaced.

Under Clause 3, Article 1 of Circular No. 09/2026/TT-BNV, which amends Article 7 of Circular No. 21/2021/TT-BLDTBXH, the maximum service price under a brokerage contract is determined based on the agreement between the service enterprise and the intermediary organization or individual, provided that it does not exceed the prescribed ceiling.

Specifically, the maximum service price under a brokerage contract must not exceed 0.5 of the worker's monthly wage stated in the labor contract for each 12 working months. For labor contracts with a definite term of 36 months or more, the maximum service price must not exceed 1.5 of the worker's monthly wage stated in the labor contract.

In addition to the general ceiling above, separate maximum service price levels apply to certain labor markets, professions, occupations and jobs in accordance with Appendix X issued together with the Circular.

Accordingly, where a worker signs a 24-month labor contract, the maximum brokerage service price is equivalent to one month's wage stated in the labor contract. For labor contracts with a definite term of 36 months or more, the maximum service price is 1.5 months' wage stated in the labor contract.

Compared with Article 7 of Circular No. 21/2021/TT-BLDTBXH (as amended and supplemented by Circular No. 02/2024/TT-BLDTBXH), the maximum brokerage service price remains substantially unchanged. Previously, the law also capped the brokerage service price at 0.5 of the worker's monthly wage for each 12 working months, while for labor contracts with a definite term of 36 months or more, the maximum service price was 1.5 of the worker's monthly wage stated in the labor contract.

Accordingly, a comparison between the previous and the new regulations shows that the ceiling on brokerage service prices that service enterprises may agree upon remains unchanged. However, Circular No. 09/2026/TT-BNV has replaced a number of appendices and forms while continuing to prescribe separate maximum service price levels for specific labor markets, professions, occupations and jobs under Appendix X issued together with the new Circular.
