Guidance on downsizing policies for part-time officials

On August 29, 2025, the Ministry of Home Affairs issued Official Dispatch No. 7307/BNV-TCBC providing guidance on the implementation of downsizing policies.

In response to Official Dispatch No. 1629/SNV-XDCQ dated August 15, 2025, of the Department of Home Affairs of Tay Ninh Province, requesting guidance on matters related to part-time officials at the commune level, the Ministry of Home Affairs provided the following opinions in Official Dispatch No. 7307/BNV-TCBC:

Clause 2 Article 5 of Decree No. 154/2025/ND-CP dated June 15, 2025 of the Government on downsizing stipulates: The monthly allowance currently enjoyed by part-time officials at the commune level, in village,s and residential groups is the allowance of the month immediately preceding the resignation, with the fund for allowances allocated by the central budget for payment.

Guidance on downsizing policies for part-time officials

Accordingly, the Department of Home Affairs of Tay Ninh Province is requested to base itself on Clause 1 Article 34 of Decree No. 33/2023/ND-CP providing for the Central Budget to implement the allowance fund allocation for part-time officials at commune level, in villages and residential groups entitled to allowance regimes, to calculate the allowance serving as the basis for downsizing benefits for these persons as prescribed.

The above constitutes the Ministry of Home Affairs’ guidance on the implementation of downsizing policies for part-time officials under Decree No. 154/2025/ND-CP dated June 15, 2025, of the Government on downsizing, for the Department of Home Affairs of Tay Ninh Province to study and implement.

According to Clause 1 Article 34 of Decree No. 33/2023/ND-CP:

  • A class-I commune-level administrative unit is allocated an allowance fund equal to 21.0 times the statutory pay rate.

  • A class-II commune-level administrative unit is allocated an allowance fund equal to 18.0 times the statutory pay rate;

  • A class-III commune-level administrative unit is allocated an allowance fund equal to 15.0 times the statutory pay rate.

For commune-level administrative units with an increased number of part-time officials as prescribed in Clause 2 Article 33 of this Decree, the total allowance fund shall be correspondingly increased by 1.5 times the statutory pay rate for each additional part-time official.
