Accordingly, Clause 4, Article 2 of Decree No. 390/2026/ND-CP amends and supplements Point dd.4, Clause 10, Article 14 of Decree No. 24/2012/ND-CP as follows:
“4. An enterprise registered to produce and process gold jewelry and art crafts, and having a contract for processing gold jewelry and art crafts with a foreign party shall be considered by the State Bank for the grant of the permit for gold material import for performance of the processing contract and export of the processed products, provided that its demand for importing gold material is consistent with such contract.”
Thus, enterprises and commercial banks granted permits for gold export and import may sell imported gold material to enterprises registered for the production of gold jewelry and art crafts.
Previously, Point dd.4 Clause 10 Article 14 of Decree No. 24/2012/ND-CP, as amended and supplemented under Clause 9 Article 1 of Decree No. 232/2025/ND-CP, specified that purchasers must be enterprises granted certificates of eligibility for the production of gold jewelry and art crafts.
Accordingly, the condition for enterprises to purchase imported gold material has changed from holding a certificate of eligibility to being registered for the production of gold jewelry and art crafts.

In addition to changing the eligible purchasers, Clause 5 Article 2 of Decree No. 390/2026/ND-CP amends and supplements Point e Clause 10 Article 14, requiring the establishment of an information system for complete and accurate processing and storing of:
- Data on export, import, trading, use and inventory of imported gold material;
- Data on gold material purchase and sale transactions.
Enterprises and commercial banks subject to this provision must connect and provide information to the State Bank in accordance with regulations of the Governor of the State Bank.
The previous provision focused on data on gold material export, import, and purchase and sale transactions, including information on counterparties, volume, gold content, and transaction value. The new provision expressly adds requirements for managing data on the use and inventory of imported gold material.
Article 5 of Decree No. 390/2026/ND-CP amends and supplements Article 20 of Decree No. 24/2012/ND-CP, expressly adding reporting requirements on the purchase and sale, use and inventory of imported gold material.
Where a gold material import permit has been granted, reports must also cover the performance of contracts for processing or exporting gold jewelry and art crafts.
Compared with the previous provision, the amended Article 20 no longer separately lists reports on the production, purchase and sale of gold jewelry and art crafts. Reporting shall comply with the regulations of the State Bank and competent agencies.
