Pursuant to Clause 1, Article 1 of Decree 225/2025/ND-CP—as issued and effective on August 15, 2025—it amends and supplements certain provisions of Decree No. 23/2024/ND-CP LuatVietnam.
Specifically, Article 1 on the scope of regulation is amended and supplemented as follows:
- To amend Clause 3 as follows:
“3. Conditions regarding capacity and experience of members of expert panels and appraisal panels; the connection and information sharing between the national bidding network system and other information systems; and state management of bidding shall be implemented in accordance with corresponding provisions of the Government’s Decree detailing articles and implementation measures of the Bidding Law on contractor selection.”
Compared to the Decree No. 23/2024/ND-CP, the new version omits references to e-bidding techniques and violation handling, replacing them with the broader term “state management of bidding.”
- To amend Clause 3a as follows:
3a. Investor appointment and investor selection in special cases shall be conducted in accordance with the corresponding provisions in Chapters IVa and IVb of Decree No. 115/2024/ND-CP dated September 16, 2024 of the Government, which details provisions and implementation measures of the Bidding Law on investor selection for land-using investment projects.
This expands the scope from merely “investor selection in special cases” to also include “investor appointment” in such cases, and explicitly cites Chapters IVa and IVb of Decree 115/2024/ND-CP as the legal basis.
- To supplement Clause 3b (after Clause 3a):
3b. Handling of violations in investor selection processes and settlement of complaints related to investor selection shall be conducted in accordance with corresponding provisions of Article 61a and Chapter VIIIa of Decree No. 115/2024/ND-CP dated September 16, 2024 of the Government, which details provisions and implementation measures of the Bidding Law on investor selection for land-using investment projects.
This adds explicit reference to violation handling and complaint resolution in investor selection, grounded in Article 61a and Chapter VIIIa of Decree 115/2024/ND-CP.
