This is the penalty prescribed in Decree No. 283/2026/ND-CP of the Government prescribing penalties for administrative violations in the fields of labor, social insurance, and Vietnamese employees going to work abroad under contracts.
Specifically, Article 12 of Decree No. 283/2026/ND-CP prescribes the following penalties for violations of regulations on labor registration and adjustment of labor registration information:
A fine ranging from VND 1 million to VND 2 million shall be imposed on an employee subject to compulsory social insurance who fails to provide information, provides incomplete information, or provides inaccurate information as required for labor registration.
Employers that fail to register or adjust employees' labor registration information when submitting dossiers for registration or adjustment of social insurance participation information shall be subject to the following fines:
- From VND 5 million to VND 10 million for violations involving 01 to 50 employees;
- From VND 10 million to VND 15 million for violations involving 51 to 100 employees;
- From VND 15 million to VND 20 million for violations involving 101 employees or more.
The statute of limitations for imposing administrative penalties in the fields of labor, social insurance, and Vietnamese employees going to work abroad under contracts is prescribed as follows:
- 01 year for administrative violations in the fields of labor and social insurance;
- 02 years for administrative violations relating to Vietnamese employees going to work abroad under contracts.
Decree No. 283/2026/ND-CP takes effect on September 10, 2026.
