VỀ VIỆC ĐIỀU ƯỚC QUỐC TẾ CÓ HIỆU LỰC

 

Thực hiện quy định tại Điều 56 của Luật Điều ước quốc tế năm 2016, Bộ Ngoại giao trân trọng thông báo:

Hiệp định giữa nước Cộng hòa xã hội chủ nghĩa Việt Nam và Cộng hòa Mô-dăm-bích về dẫn độ, ký tại Ma-pu-tô ngày 09 tháng 12 năm 2019, có hiệu lực từ ngày 12 tháng 5 năm 2021.

Bộ Ngoại giao trân trọng gửi bản sao Hiệp định theo quy định tại Điều 59 của Luật nêu trên./.

Lời nói đầu

Cộng hòa xã hội chủ nghĩa Việt Nam và Cộng hòa Mô-dăm-bích (sau đây gọi là “các Bên);

Mong muốn duy trì và tăng cường mối quan hệ của hai nước;

Mong muốn hợp tác có hiệu quả hơn nữa giữa hai nước trong truy tố tội phạm và thi hành hình phạt, đặc biệt là trong đấu tranh chống tội phạm có tổ chức và khủng bố;

Khẳng định sự tôn trọng chủ quyền, bình đẳng và cùng có lợi giữa hai nước;

Tuân thủ các nguyên tắc của pháp luật quốc tế, tôn trọng hệ thống pháp luật và thể chế tư pháp của mỗi nước;

Đã thỏa thuận như sau:

ĐIỀU 1

NGHĨA VỤ DẪN ĐỘ

Theo quy định của Hiệp định này, mỗi Bên đồng ý dẫn độ bất kỳ người nào đang có mặt trên lãnh thổ của mình mà Bên kia yêu cầu để truy cứu trách nhiệm hình sự hoặc thi hành hình phạt vì một tội có thể bị dẫn độ.

ĐIỀU 2

CÁC TỘI BỊ DẪN ĐỘ

1. Các tội có thể bị dẫn độ theo quy định của Hiệp định này là các tội, cho dù được mô tả như thế nào, theo quy định pháp luật của cả hai Bên có thể bị xử phạt tù với thời hạn từ một (01) năm trở lên hoặc nghiêm khắc hơn tại thời điểm yêu cầu dẫn độ.

2. Trong trường hợp yêu cầu dẫn độ liên quan tới một người để thi hành hình phạt tù, thì việc dẫn độ chỉ được thực hiện nếu thời hạn chấp hành hình phạt còn lại ít nhất sáu (06) tháng.

3. Phù hợp với quy định của Điều này, một tội phạm bị coi là tội phạm theo pháp luật của cả hai Bên được xác định như sau:

a) Không yêu cầu pháp luật của cả hai Bên quy định hành vi cấu thành tội phạm phải thuộc cùng một nhóm tội hoặc cùng một tội danh;

b) Tất cả hành vi phạm tội của người bị yêu cầu dẫn độ phải được xem xét một cách toàn diện và không nhất thiết các yếu tố cấu thành của tội phạm đó theo pháp luật của các Bên phải giống nhau.

4. Việc dẫn độ có thể được thực hiện theo quy định của Hiệp định này với điều kiện là:

a) Hành vi được yêu cầu dẫn độ cấu thành một tội phạm ở Bên yêu cầu vào thời điểm hành vi đó xảy ra; và

b) Hành vi đó nếu được thực hiện trên lãnh thổ của Bên được yêu cầu tại thời điểm nhận được yêu cầu dẫn độ sẽ cấu thành tội phạm ở Bên đó.

5. Trong trường hợp tội phạm được thực hiện bên ngoài lãnh thổ của Bên yêu cầu thì việc dẫn độ người phạm tội theo quy định của Hiệp định này sẽ được chấp thuận khi pháp luật của Bên được yêu cầu cũng quy định hình phạt đối với tội phạm đó nếu thực hiện bên ngoài lãnh thổ của mình trong điều kiện tương tự, Trường hợp pháp luật của Bên được yêu cầu không quy định như vậy, thì Bên được yêu cầu có thể tự quyết định chấp thuận việc dẫn độ.

6. Trong trường hợp yêu cầu dẫn độ liên quan đến bản án gồm cả hình phạt tù và hình phạt tiền, Bên được yêu cầu có thể chấp thuận việc dẫn độ để thi hành cả hình phạt tù và hình phạt tiền.

7. Nếu yêu cầu dẫn độ liên quan đến một số tội và mỗi tội đều có thể bị xử phạt theo pháp luật của cả hai Bên, nhưng có một số tội không đáp ứng các điều kiện quy định tại khoản 1 và khoản 2 Điều này, thì việc dẫn độ chỉ được chấp thuận với điều kiện có ít nhất một tội là tội có thể bị dẫn độ.

ĐIỀU 3

CƠ QUAN TRUNG ƯƠNG

1. Cơ quan trung ương của Cộng hòa xã hội chủ nghĩa Việt Nam là Bộ Công an; Cơ quan trung ương của Cộng hòa Mô-dăm-bích là Văn phòng Tổng chưởng lý.

2. Bên ký kết có thể thay đổi Cơ quan trung ương của mình nhưng phải thông báo cho Bên kia về sự thay đổi đó thông qua đường ngoại giao.

3. Các cơ quan trung ương sẽ liên hệ trực tiếp với nhau khi thực hiện Hiệp định này.

ĐIỀU 4

CÁC TRƯỜNG HỢP BẮT BUỘC TỪ CHỐI DẪN ĐỘ

Việc dẫn độ sẽ bị từ chối trong các trường hợp sau:

a) Bên được yêu cầu có căn cứ xác đáng để cho rằng yêu cầu dẫn độ đối với một tội phạm thông thường được đưa ra nhằm truy cứu trách nhiệm hình sự hoặc trừng phạt một người vì lý do chủng tộc, dân tộc, giới tính, ngôn ngữ, tôn giáo, quốc tịch, quan điểm chính trị hay các tình trạng khác, hoặc làm người đó bị ảnh hưởng bởi các lý do trên;

b) Một người đã được tuyên vô tội hoặc được ân xá hoặc đã thi hành hình phạt về tội mà người này bị yêu cầu dẫn độ theo pháp luật của Bên được yêu cầu, hay của Bên thứ ba;

c) Theo pháp luật của Bên yêu cầu hoặc Bên được yêu cầu, người bị yêu cầu dẫn độ được miễn truy tố, xét xử hoặc miễn hình phạt do hết thời hiệu hoặc vì những lý do hợp pháp khác;

d) Trường hợp yêu cầu dẫn độ liên quan đến nhiều tội phạm và mỗi tội đều có thể bị truy cứu trách nhiệm hình sự theo quy định của pháp luật Bên yêu cầu nhưng không đáp ứng các quy định tại Điều 2 của Hiệp định này;

e) Bên được yêu cầu có căn cứ xác đáng để tin rằng người bị yêu cầu dẫn độ đã hoặc có thể sẽ bị tra tấn, đối xử hay trừng phạt tàn bạo, vô nhân đạo hoặc hạ nhục ở Bên yêu cầu; hoặc

f) nếu tội phạm bị yêu cầu dẫn độ bị coi là tội phạm quân sự tại Bên được yêu cầu nhưng không được coi là tội phạm theo pháp luật hình sự.

ĐIỀU 5

CÁC TRƯỜNG HỢP CÓ THỂ TỪ CHỐI DẪN ĐỘ

Việc dẫn độ có thể bị từ chối trong các trường hợp sau:

a) Theo pháp luật quốc gia của mình, Bên được yêu cầu có thẩm quyền tài phán đối với tội phạm nêu trong yêu cầu dẫn độ. Trong trường hợp này, cơ quan có thẩm quyền của Bên được yêu cầu sẽ tiến hành các thủ tục tố tụng để truy cứu trách nhiệm hình sự đối với người bị yêu cầu dẫn độ;

b) Khi tội bị yêu cầu dẫn độ được cho là đã được thực hiện toàn bộ hoặc một phần trong lãnh thổ của Bên được yêu cầu theo pháp luật của Bên đó;

c) Nếu việc truy tố, xét xử người bị yêu cầu dẫn độ về tội bị yêu cầu dẫn độ đang được tiến hành ở Bên được yêu cầu;

d) Hành vi do người bị yêu cầu dẫn độ thực hiện không phải là tội phạm theo quy định pháp luật của Bên được yêu cầu;

e) Bên được yêu cầu xét mức độ nghiêm trọng của tội phạm và những lợi ích của Bên yêu cầu cho rằng, việc dẫn độ sẽ không công bằng hoặc sẽ mang tính áp bức hoặc trong các trường hợp ngoại lệ, sẽ không phù hợp với các nguyên tắc nhân đạo do hoàn cảnh cá nhân của người bị yêu cầu dẫn độ, có tính đến độ tuổi, sức khỏe và các tình trạng cá nhân khác; hoặc

f) Nếu Bên được yêu cầu cho rằng việc dẫn độ người này có thể gây bất lợi cho chủ quyền, an ninh, trật tự công cộng hoặc các lợi ích thiết yếu khác.

ĐIỀU 6

DẪN ĐỘ CÔNG DÂN

1. Mỗi Bên sẽ từ chối dẫn độ công dân của mình.

2. Khi Bên được yêu cầu từ chối dẫn độ công dân của mình, nếu như Bên kia yêu cầu và pháp luật của Bên được yêu cầu cho phép, Bên được yêu cầu sẽ đưa vụ việc ra cơ quan có thẩm quyền để quyết định việc truy tố, xét xử người này về tất cả hoặc bất kỳ tội phạm nào mà yêu cầu dẫn độ đã đưa ra.

3. Theo quy định tại Điều này, quốc tịch của người bị yêu cầu dẫn độ được xác định căn cứ vào thời điểm thực hiện hành vi phạm tội bị yêu cầu dẫn độ nếu người đó có nhiều hơn một quốc tịch.

ĐIỀU 7

THỦ TỤC DẪN ĐỘ VÀ CÁC TÀI LIỆU CẦN THIẾT

1. Yêu cầu dẫn độ phải lập bằng văn bản và được gửi thông qua Cơ quan trung ương quy định tại Điều 3 của Hiệp định này. Yêu cầu dẫn độ phải có các thông tin sau đây:

a) Ngày, tháng, năm và địa điểm lập yêu cầu;

b) Lý do yêu cầu dẫn độ;

c) Tên và địa chỉ của cơ quan có thẩm quyền yêu cầu dẫn độ;

d) Tên và địa chỉ của cơ quan có thẩm quyền yêu cầu dẫn độ được gửi đến; và

e) Các thông tin cần thiết khác về người bị yêu cầu dẫn độ, cụ thể là: họ, tên, giới tính, ngày, tháng, năm sinh, quốc tịch và nơi cư trú.

2. Yêu cầu dẫn độ phải kèm theo các tài liệu sau:

a) Văn bản về vụ án trong đó mô tả các nội dung liên quan đến hành vi phạm tội và quá trình tố tụng của vụ án;

b) Các điều luật áp dụng để xác định các yếu tố cấu thành tội phạm và tội danh, quy định về hình phạt, thời hiệu truy cứu trách nhiệm hình sự hoặc thi hành hình phạt;

c) Các quy định pháp luật về thiết lập quyền tài phán hình sự đối với tội phạm khi tội phạm xảy ra ngoài lãnh thổ của Bên yêu cầu;

d) Văn bản nêu các thời hạn có thể áp dụng;

e) Các thông tin cần thiết để xác định đặc điểm nhận dạng và quốc tịch của người bị yêu cầu dẫn độ gồm cả ảnh và dấu vân tay nếu có thể; và

f) Văn bản về nơi cư trú hiện tại của người đó, nếu đã biết.

3. Trường hợp yêu cầu dẫn độ đối với người chưa bị kết án thì còn phải kèm theo:

a) Lệnh bắt người đó hoặc bản sao của lệnh bắt hoặc bất kỳ tài liệu nào có giá trị và hiệu lực tương đương của cơ quan có thẩm quyền của Bên yêu cầu dẫn độ;

b) Một bản sao bản cáo trạng, bản buộc tội hoặc các tài liệu buộc tội khác, nếu có; và

c) Văn bản xác nhận người bị yêu cầu dẫn độ là người được nêu trong lệnh bắt hoặc giam giữ.

4. Trường hợp yêu cầu dẫn độ đối với người đã bị kết án vắng mặt, thì phải kèm theo:

a) Một văn bản của tòa án hoặc văn bản khác, hoặc bản sao của văn bản đó, cho phép bắt giữ người này và văn bản nêu các thủ tục có sẵn để người này kháng án hoặc hình thức khác để phản đối bản án và hình phạt áp dụng;

b) Bản sao bản án kết tội do tòa án của Bên yêu cầu dẫn độ tuyên; và

c) Văn bản xác nhận người bị yêu cầu dẫn độ là người đã bị kết án.

5 Trường hợp yêu cầu dẫn độ đối với người đã bị kết án có mặt và đã bị tuyên án, thì còn phải kèm theo:

(a) Bản sao bản án kết tội do Tòa án của Bên yêu cầu dẫn độ tuyên;

(b) Văn bản xác nhận bản án đã có hiệu lực pháp luật và không còn thủ tục tố tụng nào chưa được giải quyết xong, đồng thời, xác định phần hình phạt chưa thi hành; và

(c) Văn bản xác nhận người bị yêu cầu dẫn độ là người đã bị kết án.

6. Yêu cầu dẫn độ và tất cả các tài liệu kèm theo phải được chứng thực theo quy định tại Điều 9 Hiệp định này và được sao thành ba bộ. Tuy nhiên, các bản sao không cần phải chứng thực.

7. Yêu cầu dẫn độ và tài liệu kèm theo phải được gửi kèm với một bản dịch ra ngôn ngữ chính thức của Bên được yêu cầu hoặc tiếng Anh.

ĐIỀU 8

DẪN ĐỘ ĐƠN GIẢN

Trong phạm vi pháp luật của Bên được yêu cầu cho phép, việc dẫn độ một người có thể được thực hiện theo các điều khoản của Hiệp định này mặc dù các yêu cầu tại khoản 1 và khoản 2 của Điều 7 của Hiệp định này chưa được đáp ứng đầy đủ với điều kiện là người bị yêu cầu dẫn độ đồng ý với việc ra lệnh dẫn độ.

ĐIỀU 9

CHỨNG THỰC CÁC TÀI LIỆU HỖ TRỢ

1. Phù hợp với Điều 7 của Hiệp định này, tài liệu kèm theo một yêu cầu dẫn độ, nếu được chứng thực, sẽ được chấp nhận là bằng chứng trong bất kỳ thủ tục dẫn độ nào ở lãnh thổ của Bên được yêu cầu.

2. Một văn bản được chứng thực theo quy định của Hiệp định này nếu: được ký bởi người có thẩm quyền và được đóng dấu chính thức của cơ quan có thẩm quyền.

3. Trừ khi có quy định trong Hiệp định này, yêu cầu dẫn độ và các tài liệu kèm theo không cần phải chứng nhận hoặc hợp pháp hóa lãnh sự nếu pháp luật trong nước của các Bên cho phép.

ĐIỀU 10

THÔNG TIN BỔ SUNG

1. Trường hợp Bên được yêu cầu cho rằng thông tin đã cung cấp kèm theo yêu cầu dẫn độ là không đầy đủ để tiến hành dẫn độ theo Hiệp định này, thì có thể yêu cầu cung cấp thêm thông tin trong thời hạn do Bên được yêu cầu ấn định.

2. Trường hợp người bị yêu cầu dẫn độ đang bị bắt giữ và các thông tin bổ sung đã cung cấp theo Hiệp định này không đầy đủ hoặc không nhận được trong khoảng thời gian đã ấn định, thì người bị bắt giữ có thể được trả tự do. Việc trả tự do cho người bị yêu cầu dẫn độ nói trên không cản trở Bên yêu cầu đưa ra yêu cầu mới về dẫn độ người đó.

3. Trong trường hợp trả tự do cho người bị yêu cầu dẫn độ theo khoản 2 Điều này, Bên được yêu cầu sẽ thông báo cho Bên yêu cầu trong thời gian sớm nhất có thể.

ĐIỀU 11

BẮT KHẨN CẤP

1. Trong trường hợp khẩn cấp, khi có căn cứ hợp lý để cho rằng người bị yêu cầu dẫn độ sẽ bỏ trốn hoặc gây khó khăn, cản trở cho việc xem xét yêu cầu dẫn độ, một Bên có thể, thông qua Tổ chức Cảnh sát hình sự quốc tế (INTERPOL), qua kênh ngoại giao hoặc trực tiếp giữa các Cơ quan trung ương yêu cầu bắt khẩn cấp người bị yêu cầu để dẫn độ trong khi chờ yêu cầu dẫn độ chính thức qua Cơ quan trung ương. Yêu cầu bắt khẩn cấp sẽ được lập bằng văn bản và được chuyển thông qua bất kỳ phương tiện nào kể cả các phương tiện điện tử.

2. Yêu cầu bắt khẩn cấp phải có các nội dung sau:

a) Tên cơ quan đưa ra yêu cầu;

b) Văn bản về lý do cấp thiết của việc gửi yêu cầu;

c) Mô tả về người bị yêu cầu bắt để dẫn độ, bao gồm cả ảnh và dấu vân tay nếu có thể;

d) Nơi cư trú của người bị yêu cầu, nếu đã biết;

e) Văn bản về các tội phạm được cho là do người này thực hiện hoặc tội phạm mà người này bị kết án;

f) Văn bản mô tả tóm tắt về hành vi phạm tội;

g) Văn bản về lệnh bắt hoặc bản luận tội/cáo trạng hoặc bản án đối với người đó;

h) Văn bản về hình phạt có thể hoặc đã được áp dụng đối với các tội phạm đó;

i) Văn bản khẳng định sẽ gửi yêu cầu dẫn độ đối với người bị bắt; và

j) Các nguyên tắc pháp lý có thể được áp dụng trong vụ án.

3. Sau khi nhận được yêu cầu bắt khẩn cấp, Bên được yêu cầu sẽ tiến hành các thủ tục cần thiết để bảo đảm việc bắt giữ người bị yêu cầu và thông báo ngay kết quả cho Bên yêu cầu.

4. Một người bị bắt giữ theo yêu cầu bắt khẩn cấp có thể được trả tự do sau bốn mươi lăm (45) ngày kể từ ngày người đó bị bắt giữ nếu Bên được yêu cầu không nhận được yêu cầu dẫn độ cùng các tài liệu như quy định tại Điều 7 của Hiệp định này. Thời hạn này có thể được gia hạn thêm mười lăm (15) ngày theo yêu cầu chính đáng, hợp lệ của Bên yêu cầu.

5. Việc trả tự do cho một người theo khoản 4 của Điều này sẽ không cản trở việc lập các thủ tục tố tụng để dẫn độ người này nếu sau đó lại nhận được yêu cầu dẫn độ.

ĐIỀU 12

NHIỀU YÊU CẦU DẪN ĐỘ ĐỐI VỚI MỘT NGƯỜI

1. Trong trường hợp nhận được yêu cầu dẫn độ từ hai hay nhiều quốc gia đối với cùng một người thì Bên được yêu cầu sẽ quyết định dẫn độ người đó cho một trong các quốc gia nói trên và thông báo quyết định của mình cho Bên yêu cầu.

2. Khi quyết định quốc gia để dẫn độ người đó, thì Bên được yêu cầu phải xem xét tất cả các yếu tố liên quan và, đặc biệt là:

a) Quốc tịch của người bị yêu cầu dẫn độ và người bị hại;

b) Mức độ nghiêm trọng của các tội phạm trong trường hợp các yêu cầu liên quan đến các tội phạm khác nhau;

c) Thời gian và địa điểm thực hiện mỗi tội phạm;

d) Ngày đưa ra yêu cầu dẫn độ;

e) Nơi thường trú của người bị yêu cầu dẫn độ;

f) Các yêu cầu được lập theo Hiệp định;

g) Lợi ích của các quốc gia yêu cầu; và

h) Khả năng dẫn độ người này đến quốc gia yêu cầu khác.

ĐIỀU 13

QUYẾT ĐỊNH VÀ THÔNG BÁO

1. Ngay sau khi có quyết định về yêu cầu dẫn độ, Bên được yêu cầu sẽ thông báo quyết định đó cho Cơ quan trung ương của Bên yêu cầu.

2. Trong trường hợp từ chối toàn bộ hoặc một phần yêu cầu dẫn độ thì phải nêu rõ lý do.

ĐIỀU 14

CHUYỂN GIAO NGƯỜI BỊ DẪN ĐỘ

1. Khi yêu cầu dẫn độ được chấp thuận, Bên được yêu cầu sẽ chuyển giao người bị dẫn độ ở một địa điểm trên lãnh thổ của mình theo thỏa thuận của hai Bên, không quá ba mươi (30) ngày kể từ ngày thông báo chấp thuận yêu cầu dẫn độ.

2. Bên yêu cầu sẽ đưa người bị dẫn độ ra khỏi lãnh thổ của Bên được yêu cầu trong một thời hạn theo quy định của pháp luật trong nước của các Bên, nếu hết thời hạn trên mà người đó chưa được chuyển đi thì Bên được yêu cầu có thể trả tự do cho người đó và thông báo cho Bên yêu cầu, đồng thời, có thể từ chối dẫn độ người đó về cùng một tội phạm.

3. Nếu có tình huống phát sinh vượt quá khả năng kiểm soát của một Bên, cản trở Bên đó chuyển giao hay di chuyển người bị dẫn độ thì phải thông báo cho Bên kia biết. Các Bên sẽ cùng nhau thỏa thuận để đưa ra thời hạn chuyển giao mới, và sẽ áp dụng các quy định tại khoản 2 của Điều này.

4. Vào thời điểm chuyển giao người bị dẫn độ, Bên được yêu cầu sẽ thông báo cho Bên yêu cầu về tổng số thời gian mà người bị dẫn độ đã bị giam giữ để thực hiện việc dẫn độ.

ĐIỀU 15

CHUYỂN GIAO HOẶC CHUYỂN GIAO TẠM THỜI TÀI SẢN LIÊN QUAN ĐẾN NGƯỜI BỊ DẪN ĐỘ

1. Trong phạm vi pháp luật của Bên được yêu cầu cho phép và trên cơ sở tôn trọng quyền lợi của các bên thứ ba, tất cả các tài sản do phạm tội mà có hoặc cần để làm vật chứng được tìm thấy trên lãnh thổ của Bên được yêu cầu sẽ được chuyển giao theo đề nghị của Bên yêu cầu nếu việc dẫn độ được chấp thuận.

2. Theo khoản 1 Điều này, những tài sản nêu trên sẽ được chuyển giao cho Bên yêu cầu nếu Bên yêu cầu đề nghị, kể cả khi việc dẫn độ không thể thực hiện được, bao gồm nhưng không giới hạn bởi những lý do như người bị yêu cầu dẫn độ chết, mất tích hoặc trốn thoát.

3. Khi pháp luật của Bên được yêu cầu quy định hoặc vì quyền lợi của các bên thứ ba, các tài sản đã chuyển giao sẽ được hoàn trả lại miễn phí cho Bên được yêu cầu nếu Bên đó đề nghị.

4. Trường hợp các tài sản nêu trên cần thiết để phục vụ điều tra hoặc truy tố, xét xử người phạm tội ở Bên được yêu cầu, việc chuyển giao tài sản có thể trì hoãn cho đến khi kết thúc việc điều tra hoặc truy tố, xét xử, hoặc có thể chuyển giao với điều kiện sẽ phải trả lại sau khi kết thúc thủ tục tố tụng ở Bên yêu cầu.

ĐIỀU 16

HOÃN DẪN ĐỘ VÀ DẪN ĐỘ TẠM THỜI

1. Khi người bị yêu cầu dẫn độ đang bị điều tra, truy cứu trách nhiệm hình sự hoặc đang chấp hành bản án trên lãnh thổ của Bên được yêu cầu về một tội phạm không phải là tội bị yêu cầu dẫn độ, Bên được yêu cầu có thể hoãn việc dẫn độ người đó để tiến hành các thủ tục tố tụng hoặc để người đó có thể chấp hành xong hình phạt. Trong những trường hợp này, Bên được yêu cầu sẽ thông báo bằng văn bản cho Bên yêu cầu. Khi điều kiện hoãn dẫn độ không còn nữa thì Bên được yêu cầu phải thông báo ngay bằng văn bản cho Bên yêu cầu và tiếp tục quy trình dẫn độ nếu không có thông báo khác của Bên yêu cầu.

2, Khi cơ quan y tế có thẩm quyền của Bên được yêu cầu cho rằng người bị yêu cầu dẫn độ không thể chuyển giao từ Bên được yêu cầu đến Bên yêu cầu vì có thể nguy hiểm đến tính mạng do bị ốm nặng, việc chuyển giao người này sẽ bị hoãn lại cho đến khi mức độ nguy hiểm đã giảm đáng kể.

3. Khi người bị yêu cầu dẫn độ đang thi hành hình phạt trong lãnh thổ của Bên được yêu cầu về một tội khác với tội bị yêu cầu dẫn độ, nếu việc hoãn dẫn độ có thể gây cản trở nghiêm trọng quá trình tố tụng ở Bên yêu cầu do hết thời hiệu hoặc gây khó khăn nghiêm trọng cho việc tiến hành truy cứu trách nhiệm hình sự, thì theo đề nghị của Bên yêu cầu, Bên được yêu cầu có thể dẫn độ tạm thời người đó cho Bên yêu cầu để truy tố, xét xử về tội bị yêu cầu dẫn độ. Người bị dẫn độ tạm thời đó sẽ được giam giữ trong lãnh thổ của Bên yêu cầu và phải được trao trả lại cho Bên được yêu cầu sau khi kết thúc các thủ tục tố tụng đối với người đó theo các điều kiện mà hai Bên đã thỏa thuận bằng văn bản hoặc hết thời hạn thỏa thuận dẫn/độ tạm thời. Khi có yêu cầu, Bên được yêu cầu có thể gia hạn thời hạn đã thỏa thuận ban đầu nếu cho rằng có lý do chính đáng cho việc gia hạn này.

4. Người được trao trả lại cho Bên được yêu cầu sau khi dẫn độ tạm thời, sẽ bị dẫn độ cho Bên yêu cầu để chấp hành bất kỳ hình phạt nào đã tuyên phù hợp với các quy định của Hiệp định này.

ĐIỀU 17

DẪN ĐỘ LẠI

Nếu người bị dẫn độ trốn tránh các thủ tục tố tụng hình sự ở Bên yêu cầu và quay trở lại lãnh thổ của Bên được yêu cầu thì Bên yêu cầu có thể đưa ra yêu cầu dẫn độ lại người đó về cùng một tội phạm.

ĐIỀU 18

QUY TẮC ĐẶC BIỆT

1. Một người bị dẫn độ theo Hiệp định này sẽ không bị giam giữ, xét xử hoặc trừng phạt tại Bên yêu cầu vì bất kỳ tội phạm nào được thực hiện trước khi bị dẫn độ, trừ các trường hợp:

a) Tội phạm đó chính là tội phạm bị yêu cầu dẫn độ hoặc là một tội phạm có thể bị dẫn độ khác mà người này có thể bị kết án dựa trên các chứng cứ của vụ án mà yêu cầu dẫn độ đã được chấp nhận với cùng mức hình phạt hoặc với hình phạt nhẹ hơn tội phạm bị dẫn độ;

b) Tội phạm có thể bị dẫn độ mà cơ quan có thẩm quyền của Bên được yêu cầu đồng ý việc giam giữ, xét xử hoặc trừng phạt người này. Vì mục đích của Điều này:

(i) Bên được yêu cầu có thể yêu cầu nộp tài liệu nêu tại Điều 7; và

(ii) Người bị dẫn độ có thể bị giam giữ ở Bên yêu cầu trong sáu mươi (60) ngày, hoặc một thời hạn dài hơn mà Bên được yêu cầu có thể cho phép, để chờ xử lý yêu cầu.

2. Khoản 1 của Điều này sẽ không áp dụng trong trường hợp:

a) Người bị dẫn độ tự nguyện quay trở lại lãnh thổ của Bên yêu cầu sau khi rời khỏi lãnh thổ đó; hoặc

b) Người đó đã có cơ hội rời khỏi lãnh thổ của Bên yêu cầu và đã không rời khỏi trong thời hạn bốn mươi lăm (45) ngày kể từ ngày người đó được miễn truy cứu về tội bị yêu cầu dẫn độ. Tuy nhiên, thời hạn này không bao gồm thời gian người đó đã không thể rời khỏi lãnh thổ của Bên yêu cầu vì các trường hợp bất khả kháng.

ĐIỀU 19

CHUYỂN GIAO CHO NƯỚC THỨ BA

1. Khi một người đã được dẫn độ cho Bên yêu cầu, Bên yêu cầu sẽ không được dẫn độ người đó cho bất kỳ nước thứ ba nào vì một tội thực hiện trước khi người đó bị dẫn độ trừ khi:

a) Bên được yêu cầu chấp thuận với việc dẫn độ - đề nghị chấp thuận sẽ gửi kèm theo các văn bản quy định tại Điều 7 của Hiệp định này theo yêu cầu của Bên được yêu cầu;

b) Người đó đã có cơ hội rời khỏi lãnh thổ của Bên yêu cầu và đã không rời khỏi trong thời hạn 45 ngày kể từ ngày người đó được miễn truy cứu về tội bị yêu cầu dẫn độ. Tuy nhiên, thời hạn này không bao gồm thời gian người đó đã không thể rời khỏi lãnh thổ của Bên yêu cầu vì các lý do vượt quá khả năng kiểm soát của người đó; hoặc

c) Người đó tự nguyện quay trở lại lãnh thổ của Bên yêu cầu sau khi rời khỏi lãnh thổ đó.

2. Bên được yêu cầu có thể để nghị Bên yêu cầu đưa ra các tài liệu do nước thứ ba cung cấp để làm căn cứ cho việc chấp thuận theo điểm a khoản 1 Điều này.

ĐIỀU 20

THÔNG BÁO KẾT QUẢ

Bên yêu cầu sẽ thông báo cho Bên được yêu cầu các thông tin liên quan đến việc truy cứu trách nhiệm hình sự hoặc thi hành án đối với người bị dẫn độ hoặc việc dẫn độ tại người đó cho Nước thứ ba.

ĐIỀU 21

QUÁ CẢNH

1. Khi một người bị dẫn độ tới một Bên từ Nước thứ ba thông qua lãnh thổ của Bên kia, Bên mà người được dẫn độ tới sẽ yêu cầu Bên kia cho phép quá cảnh người này qua lãnh thổ của Bên đó. Yêu cầu quá cảnh có thể được gửi bằng bất kỳ phương tiện nào dưới dạng văn bản và việc quá cảnh chỉ được thực hiện sau khi có văn bản chấp nhận việc quá cảnh đó.

2. Trên cơ sở nhận được đề nghị cho phép quá cảnh, Bên được yêu cầu sẽ chấp thuận trừ khi Bên này có những lý do hợp lý để từ chối việc quá cảnh.

3. Không phải xin phép quá cảnh trong trường hợp sử dụng đường hàng không và không dự định hạ cánh trên lãnh thổ của Bên quá cảnh. Nếu tiến hành hạ cánh không dự định trước trên lãnh thổ của Bên quá cảnh thì Bên này có thể yêu cầu Bên kia gửi yêu cầu xin quá cảnh theo quy định tại khoản 1 của Điều này. Bên đó phải giam giữ người bị dẫn độ đang chờ quá cảnh cho đến khi nhận được yêu cầu quá cảnh và việc quá cảnh được cho phép, với điều kiện là phải nhận được yêu cầu trong vòng 04 ngày (90 giờ) từ lúc hạ cánh không dự định trước.

4. Việc cho phép quá cảnh một người sẽ, phù hợp với pháp luật của Bên được yêu cầu, bao gồm cả việc cho phép giam giữ người đó trong thời gian quá cảnh.

5. Khi một người bị giam giữ theo khoản 4 Điều này, Bên mà người này bị giam giữ có thể ra lệnh thả người này nếu việc chuyển giao không được tiếp tục trong thời gian hợp lý.

6. Bên mà người này được dẫn độ tới sẽ bồi hoàn cho Bên kia mọi chi phí phát sinh liên quan đến việc quá cảnh mà Bên kia phải gánh chịu.

ĐIỀU 22

CHI PHÍ

1. Bên được yêu cầu sẽ thực hiện tất cả các thủ tục cần thiết và sẽ chịu chi phí về các thủ tục phát sinh từ yêu cầu dẫn độ và sẽ là đại diện cho các lợi ích của Bên yêu cầu.

2. Bên được yêu cầu sẽ chịu các chi phí phát sinh trong lãnh thổ của mình liên quan đến việc bắt và giam giữ người bị yêu cầu dẫn độ cho đến khi người này được chuyển giao cho một người được Bên yêu cầu chỉ định.

3. Bên yêu cầu sẽ chịu các chi phí phát sinh trong việc di chuyển người bị dẫn độ từ lãnh thổ của Bên được yêu cầu và chi phí quá cảnh.

ĐIỀU 23

MỐI QUAN HỆ VỚI CÁC ĐIỀU ƯỚC QUỐC TẾ ĐA PHƯƠNG

Hiệp định này sẽ không ảnh hưởng đến bất kỳ nghĩa vụ nào theo các điều ước quốc tế đa phương mà hai Bên là thành viên.

ĐIỀU 24

THAM VẤN

Các Cơ quan trung ương theo quy định tại Điều 3 hoặc những người được ủy quyền bởi các Cơ quan trung ương có thể tham vấn trực tiếp với nhau trong quá trình xử lý từng vụ việc cụ thể và trong tăng cường hiệu quả thực hiện Hiệp định này.

ĐIỀU 25

GIẢI QUYẾT BẤT ĐỒNG

1. Các Cơ quan trung ương sẽ nỗ lực cùng nhau giải quyết mọi bất đồng phát sinh từ việc giải thích, áp dụng hoặc thực hiện Hiệp định này.

2. Trường hợp các Cơ quan trung ương không giải quyết được bất đồng, các Bên sẽ giải quyết thông qua kênh ngoại giao.

ĐIỀU 26

SỬA ĐỔI, BỔ SUNG

Hiệp định này có thể được sửa đổi, bổ sung bằng văn bản qua kênh ngoại giao theo sự đồng thuận của các Bên. Bất kỳ sửa đổi hoặc bổ sung nào đối với Hiệp định này được các Bên thống nhất sẽ có hiệu lực theo cùng cách thức như chính Hiệp định này. Các sửa đổi, bổ sung đó sẽ trở thành một phần của Hiệp định này.

ĐIỀU 27

HIỆU LỰC VÀ CHẤM DỨT HIỆU LỰC CỦA HIỆP ĐỊNH

1. Mỗi Bên sẽ thông báo cho Bên kia thông qua công hàm khi hoàn thành tất cả các thủ tục cần thiết để Hiệp định này có hiệu lực. Hiệp định này sẽ có hiệu lực vào ngày thứ 30 kể từ ngày nhận được công hàm sau cùng.

2. Hiệp định này sẽ áp dụng đối với bất kỳ yêu cầu nào được đưa ra sau ngày Hiệp định có hiệu lực, kể cả với những yêu cầu liên quan đến hành vi xảy ra trước ngày có hiệu lực của Hiệp định này.

3. Hiệp định này có giá trị vô thời hạn. Tuy nhiên, mỗi Bên có thể chấm dứt Hiệp định này vào bất cứ thời điểm nào bằng việc gửi thông báo bằng văn bản cho Bên kia thông qua kênh ngoại giao. Việc chấm dứt sẽ có hiệu lực vào ngày thứ 180 sau ngày gửi thông báo đó.

4. Trong trường hợp Hiệp định này chấm dứt, Hiệp định vẫn tiếp tục được áp dụng đối với các yêu cầu dẫn độ đã được gửi trước ngày việc chấm dứt Hiệp định có hiệu lực.

Để làm bằng, những người ký tên dưới đây, được Nhà nước của mình ủy quyền đầy đủ, đã ký Hiệp định này.

Hiệp định này được làm thành hai (02) bản tại thành phố Maputo vào ngày 09 tháng 12 năm 2019 bằng tiếng Việt, tiếng Bồ Đào Nha và tiếng Anh, các bản đều có giá trị như nhau. Trường hợp nảy sinh bất đồng trong việc giải thích Hiệp định, thì sẽ căn cứ vào bản tiếng Anh.

AGREEMENT

BETWEEN THE SOCIALIST REPUBLIC OF VIET NAM AND THE REPUBLIC OF MOZAMBIQUE ON EXTRADITION

 

PREAMBLE

The Socialist Republic of Viet Nam and the Republic of Mozambique (hereinafter referred as the “Parties”),

Desiring to maintain and strengthen the ties of two countries;

Desiring to establish more effective cooperation between the two States in the prosecution of crime and the execution of sentences, especially in the fight against organized crime and terrorism;

Affirming their mutual respect for sovereignty and equality and mutual benefit;

Respecting the principles of international laws, each other's legal system and judicial institutions;

HAVE AGREED as follows:

ARTICLE 1

OBLIGATION TO EXTRADITE

Each Party agrees to extradite to the other Party, in accordance with the provisions of this Agreement, any person who is found in its territory and sought by the other Party for prosecution against or enforcement of the sentence for an extraditable offence.

ARTICLE 2

EXTRADITABLE OFFENCES

1. For the purpose of this Agreement extraditable offences are offences however described which are punishable under the laws of both Parties by imprisonment for a maximum period of at least one year (01) or by a more severe penalty at the time of the request.

2. Where the request for extradition relates to a person who is wanted for the enforcement of a sentence of imprisonment, extradition shall be granted only if a period of at least six (6) months of such penalty remains to be served.

3. For the purpose of this Article, in determining whether an offence is an offence against the laws of both Parties:

a) it shall not matter whether the laws of the Parties place the conduct constituting the offence within the same category of offence or denominate the offence by the same terminology;

b) the totality of the conduct alleged against the person whose extradition is sought shall be taken into account and it shall not matter whether, under the laws of the Parties, the constituent elements of the offence differ.

4. Extradition may be granted under this Agreement provided that:

a) the conduct in respect of which extradition is sought constituted an offence in the requesting Party at the time it occurred; and

b) the conduct would, if it had taken place in the territory of the Requested Party at the time the request for extradition was received, have constituted an offence in that Party.

5. Where the offence has been committed outside the territory of the Requesting Party, extradition shall be granted, pursuant to this Agreement, where the law of the Requested Party provides for the punishment of an offence committed outside its territory in similar circumstances. Where the law of the Requested Party does not so provide, the Requested Party may, in its discretion, grant extradition.

6. If the request for extradition relates to a sentence of both imprisonment and a pecuniary sanction, the Requested Party may grant extradition for the enforcement of both the imprisonment and the pecuniary sanction.

7. If the request for extradition refers to several offences, each of which is punishable under the laws of both Parties, but some of which do not fulfil the other conditions set out in paragraphs 1 and 2 of this Article, extradition may be granted, provided that the person sought is to be extradited for at least one extraditable offence.

ARTICLE 3

CENTRAL AUTHORITIES

1. The Central Authority for the Socialist Republic of Viet Nam is the Ministry of Public Security. The Central Authority for the Republic of Mozambique is the Attorney General’s Offices.

2. Either Party may change its Central Authority, in which case it shall notify the other of the change through diplomatic channels.

3. The Central Authorities may communicate directly with each other for the purpose of this Agreement.

ARTICLE 4

MANDATORY REFUSAL OF EXTRADITION

Extradition shall not be granted in any of the following circumstances:

a) the Requested Party has substantial grounds for believing that a request for extradition for an ordinary criminal offence has been made for the purpose of prosecuting or punishing a person on account of that person's race, ethnic origin, gender, language, religion, nationality, political opinion or other status, or that person's position may be prejudiced for any of those reasons;

b) the person has been acquitted or pardoned, or has undergone the punishment provided by the law of the Requested Party, or a third State, in respect of the offence for which the person's extradition is sought;

c) the person whose extradition is sought has, according to the law of either Party, become immune from prosecution or punishment by reason of lapse of time or for other legitimate grounds;

d) the request for extradition relates to more than one offense and each of which is punishable under the law of the Requesting Party but does not fall under the scope of Article 2 of this Agreement;

e) the Requested Party has substantial grounds for believing that the person sought has been or will probably be subjected to torture or other cruel, inhuman or humiliating treatment or punishment in the Requesting Party; or

f) if the offense for which extradition is requested is considered by the Requested Party to be a military crime; but is not considered to be the offense under criminal law.

ARTICLE 5

DISCRETIONARY REFUSAL OF EXTRADITION

Extradilion may be refused if:

a) the Requested Party in accordance with its law has jurisdiction over the offence for which the request for extradition is made. In this case, the competent authority of the Requested Party shall prosecute against the person sought;

b) the offence for which extradition is sought is regarded under the law of the Requested Party as having been committed in whole or in part within that Party;

c) a prosecution in respect of the offence for which extradition is sought is pending in the Requested Party against the person whose extradition is sought;

d) the conduct committed by the person whose extradition is requested does not constitute an offence under the law of the Requested Party; or

e) the Requested Party, while taking into account the seriousness of the offence and the interests of the Requesting Party, considers that the extradition of the person would be unjust or oppressive, or, in exceptional cases, because of the personal circumstances of the person sought, the extradition would be incompatible with humanitarian considerations taking account the age, health and other personal situation;

f) If the Requested Party considers that extradition of a person may be detrimental to its sovereignty, security, public order or other essential interests.

ARTICLE 6

EXTRADITION OF NATIONALS

1. Each Party shall refuse to grant extradition of its nationals.

2. Where the Requested Party refuses to extradite a national of that Party it shall, if the other Party so requests and the laws of the Requested Party allow, submit the case to its competent authorities to determine whether proceedings for the prosecution of the person in respect of all or any of the offences for which extradition has been sought may be taken.

3. For the purpose of this Article, nationality of the person sought shall be determined at the time of the commission of the offence for which extradition is requested if that person have more than one nationality.

ARTICLE 7

EXTRADITION PROCEDURE AND REQUIRED DOCUMENT

1. A request for extradition shall be made in writing and communicated through the Central Authorities defined in Article 3 of this Agreement. The request for extradition shall include the following particulars:

a) date and place of the request for extradition;

b) reasons for requesting extradition;

c) name and address of the competent authority requesting extradition;

d) name and address of the competent authority to which the request for extradition is made; and

e) necessary information about the person sought, particularly his or her name, sex, date of birth, nationality and residence.

2. The request for extradition shall be accompanied:

a) a statement of the case describing the facts related to the infringements and historical procedural of the case;

b) a statement of the laws describing the constituent elements and the designation of the offence, the punishment for the offence, and the time limit for prosecution or enforcement of the sentence imposed;

c) legal provisions establishing criminal jurisdiction over the offence where the offence occurred outside the territory of the Requesting Party;

d) a statement regarding any applicable time limitations;

e) the details necessary io establish identity and nationality of the person sought including, when possible, photographs and fingerprints; and

f) a statement of the current location of the person, if known.

3. If the request relates to an accused person, it must also be accompanied by:

a) a warrant for the arrest of the person, or a copy thereof or any document having the same force and effect, issued by a competent authority of the Requesting Party;

b) a copy of the indictment, charge sheet or other charging document, if any; and

c) a written certification document certifying that the person sought is the person to whom the warrant of arrest or detention refers.

4. If a person has been convicted of an offence in his or her absence, it shall also be accompanied by:

a) a judicial or other document, or a copy thereof, authorizing the apprehension of the person and a statement setting out the procedures available to that person to appeal against or otherwise challenge the conviction and the sentence imposed;

b) a copy of the judgment of conviction imposed by a court in the Requesting Party; and

c) a written certification that the person sought is the one already convicted.

5. If the person has been convicted of an offence in his or her presence and has been sentenced, it shall also be accompanied by:

a) a copy of the judgment of conviction imposed by a court in the requesting Party;

b) a statement that the judgment is final and no further proceedings are pending and showing how much of the sentence has not been carried out; and

c) a written certification that the person sought is the one already sentenced.

6. Extradition request and all documents submitted in support of a request for extradition shall be authenticated in accordance with Article 9. Three copies of the request and supporting documents shall also be provided. However, the copies do not require authentication.

7. The request for extradition and documents submitted in its support shall be accompanied by a translation into the official language of the Requested Party or English.

ARTICLE 8

SIMPLIFIED EXTRADITION

To the extent permitted by the law of the Requested Party, extradition of a person may be granted pursuant to the provisions of this Agreement notwithstanding that the requirements of Paragraph 1 and 2 of Article 7 have not been complied with provided that the person claimed consents to an order for extradition being made.

ARTICLE 9

AUTHENTICATION OF SUPPORTING DOCUMENTS

1. A document that, in accordance with Article 7 of this Agreement, accompanies a request for extradition shall be admitted in evidence, if authenticated, in any extradition proceedings in the territory of the Requested Party.

2. A document is authenticated for the purpose of this Agreement if: it is signed by a competent person and affixed an official seal of a competent authority of the Party.

3. Except as provided by the present Agreement, a request for extradition and its supported documents as well as other documents shall not require consular certification or authentication as the domestic laws of the Parties allowed.

ARTICLE 10

ADDITIONAL INFORMATION

1. If the Requested Party considers that the information furnished in support of a request for extradition is not sufficient, in accordance with this Agreement to enable extradition to be granted, that Party may request that additional information be furnished within such time as it specifies.

2. If the person whose extradition is sought is under arrest and the additional information furnished is not sufficient in accordance with this Agreement or is not received within the time specified, the person may be released from custody. Such release shall not preclude the Requesting Party from making a fresh request for the extradition of the person.

3. Where the person is released from custody in accordance with paragraph 2, the Requested Party shall notify the Requesting Party as soon as practicable.

ARTICLE 11

PROVISIONAL ARREST

1. In case of urgency, when there’s reasonable ground to believe that the sought person flees or causes difficulties, obstacles for the consideration of an extradition request, a Party may apply by means of the facilities of the International Criminal Police Organization (INTERPOL), the diplomatic channel or directly between the Central Authorities for the provisional arrest of the person sought pending the presentation of the request for extradition through the Central Authorities. The application shall be in writing and transmitted by any means including electronic means.

2. The application for provisional arrest shall contain:

a) the name of the requesting authority;

b) a statement about the reasons for urgency prompting the making of the application;

c) a description of the person sought, including, if possible, photographs or fingerprints;

d) the location of the person sought, if known;

e) a statement of the offences allegedly committed by the person, or of which he or she has been convicted;

f) a concise statement of the conducts alleged to constitute each offence;

g) a statement of the existence of a warrant of arrest, or finding of guilt/indictment or judgment of conviction against the person sought;

h) a statement of the punishment that can be, or has been, imposed for the offences;

i) a statement that a request for the extradition of the person is to follow; and

j) the applicable legal principles for the case.

3. On receipt of such an application, the Requested Party shall take the necessary steps to secure the arrest of the person sought and the Requesting Party shall be promptly notified of the result of its application.

4. A person arrested upon such an application may be set at liberty upon the expiration of forty-five (45) days from the date of that person's arrest if a request for extradition, supported by the documents specified in Article 7 of this Agreement, has not been received. This period may be extended for fifteen (15) days, at the duly justified request of the Request Party.

5. The release of a person pursuant to paragraph 4 of this Article shall not prevent the institution of proceedings to extradite the person sought if the extradition request is subsequently received.

ARTICLE 12

CONCURRENT REQUESTS

1. Where requests are received from two or more states for the extradition of the same person, the Requested Party shall determine to which of those states the person is to be extradited and shall notify the Requesting Party of its decision.

2. In determining to which state a person is to be extradited, the Requested Party shall have regard to all relevant circumstances and, in particular, to:

a) the nationality of the person sought and the victim;

b) the relative seriousness of the offences if the requests relate to different offences;

c) the time and place of commission of each offence;

d) the respective dates of the requests;

e) the ordinary place of residence of the person;

f) whether the requests were made pursuant to an Agreement;

g) the respective interests of the Requesting States; and

h) the possibility of any of the Requesting States extraditing the person to another State.

ARTICLE 13

DECISION AND NOTIFICATION

1. The Requested Party shall, as soon as a decision on the request for extradition has been made, communicate that decision to the Central Authority of the Requesting Party.

2. Reasons shall be given for any complete or partial refusal of an extradition request.

ARTICLE 14

SURRENDER OF THE PERSON

1. Where extradition is granted, the Requested Party shall surrender the person no later than thirty (30) days from the date of notification of acceptance of the positive decision on the request, from a point of departure in its territory acceptable to both Parties.

2. The Requesting Party shall remove the person from the territory of the Requested Party within period established by the domestic law of the Parties, if the person is not removed within that period, the Requested Party may set that person at liberty and shall inform the Requesting Party, and may refuse to extradite that person for the same offence.

3. If circumstances beyond its control prevent a Party from surrendering or removing the person to be extradited, it shall notify the other Party. The Parties shall agree upon a new date of surrender, and the provision of paragraph 2 of this Article shall apply.

4. At the time of the surrender of the person, the Requested Party shall inform the Requesting Party of the total period of time that person had been detained with a view to his or her extradition.

ARTICLE 15

SURRENDER OR TEMPORARY TRANSFER OF PROPERTY RELATING TO AN EXTRADITED PERSON

1. To the extent permitted under the law of the Requested Party and subject to the rights of third parties which shall be duly respected, all property found in the Requested Party that has been acquired as a result of the offence or may be required as evidence shall be surrendered if extradition is granted and the Requesting Party so requests.

2. Subject to paragraph 1 of this Article, the above mentioned property shall, if the Requesting Party so requests, be surrendered to the Requesting Party even if the extradition cannot be carried out, including but not limited to circumstances where the extradition cannot be carried out because of the death, disappearance or escape of the person sought.

3. Where the law of the Requested Party or the rights of third parties so require, any articles so surrendered shall be returned to the Requested Party free of charge if that Party so requests.

4. If the abovementioned property is required for an investigation or prosecution of an offence in the Requested Party, then the delivery of that property may be delayed until the completion of the investigation or prosecution or it may be delivered on condition that it shall be returned after the conclusion of the proceedings in the Requesting Party.

ARTICLE 16

POSTPONEMENT OF EXTRADITION AND TEMPORARY SURRENDER

1. When the person sought is being investigated, prosecuted or has been tried or is serving a sentence in the Requested Party for an offence other than that for which extradition is requested, the Requested Party may postpone the surrender of that person in order to proceed against that person, or so that the person may serve a sentence. In such eases the Requested Party shall inform the Requesting Party in writing accordingly. When the conditions of the postponement no longer exist, the Requested Party shall inform as soon as practicable the Requesting Party in writing and resume the process for extradition unless otherwise informed by the Requesting Party.

2. When, in the opinion of the competent medical authority in the Requested Party, the person whose extradition is sought cannot be transported from the Requested Party to the Requesting Party without serious danger to the person's life due to grave illness, the surrender of the person shall be postponed until such time as the danger has been sufficiently mitigated.

3. When the person is serving a sentence in the territory of the Requested Party for an offence other than an offence for which extradition is sought, as the Requesting Party requested, the Requested Party may temporarily surrender the person to the Requesting Party to be prosecuted for an offence for which extradition is sought if the postponement would seriously prejudice the legal proceeding in the Requesting State due to the lapse of the statute of limitation or would cause serious difficulties for the prosecution. The person so surrendered shall be kept in custody in the Requesting Party and shall be returned to the Requested Party after proceedings against the person have concluded, in accordance with written conditions to be mutually determined by the Parties or the mutually agreed time permitted for temporary extradition ends. The Requested Party may extend, upon request, the time period initially agreed, if it deems that reasonable grounds for such extension exist.

4. A person who is returned to the Requested Party following a temporary surrender shall be extradited to the Requesting Party to serve any sentence imposed, in accordance with the provisions of this Agreement.

ARTICLE 17

RE-EXTRADITION

Where the person extradited has absconded the criminal proceeding against him/her in the Requesting Party and returned to the territory of the Requested Party, the Requesting Party may submit a request, for re-extradition of that person for the same offence.

ARTICLE 18

RULE OF SPECIALITY

1. A person extradited under this Agreement shall not be detained, tried or punished in the Requesting Party for any offence committed before his or her extradition other than:

a) an offence for which extradition was granted or any other extraditable offence of which the person could be convicted upon proof of the same facts upon which the request for extradition was granted and be punished by the same or lesser penalty as the extradited offence;

b) an extraditable offence for which the competent authority of the Requested State consents to the person’s detention, trial, or punishment. For the purpose of this Article:

(i) the Requested Party may require the submission of the documentation referred to in Article 7; and

(ii) the person extradited may be detained by the Requesting Party for sixty (60) days or for such longer period of time as the Requested Party may authorize, pending the processing of the request.

2. Paragraph (1) shall not apply if;

(a) the person extradited leaves the territory of the Requesting Party after extradition and voluntary returns to it; or

(b) the person extradited has had an opportunity to leave the territory of the Requesting Party and has not done so within forty five (45) days of final discharge in respect of the offence for which that person was extradited. However, this period shall not include the time, for circumstances beyond his or her control, that person was unable to leave the territory of the Requesting Party.

ARTICLE 19

SURRENDER TO A THIRD STATE

1. Where a person has been extradited to the Requesting Party by the Requested Party, the first-mentioned Party shall not extradite that person to any third State for an offence committed before that person's extradition unless:

a) the Requested Party consents to the extradition - a request for consent shall be accompanied by such of the documents mentioned in Article 7 of this Agreement as are sought by the Requested Party.

b) the person has had an opportunity to leave the territory of the Requesting Party and has not done so within forty-five (45) days of final discharge in respect of the offence for which the person was extradited. However, this period shall not include the time, for reasons beyond his or her control, that person was unable to leave the territory' of the Requesting Party; or

c) The person has voluntarily returned to the territory of the Requesting Party after leaving it.

2. The Requested Party may request the Requesting Party to provide the documents submitted to it by the third State in relation to any consent sought pursuant to subparagraph 1 (a) of this Article.

ARTICLE 20

NOTIFICATION OF THE RESULTS

The Requesting Party shall notify the Requested Party of the information relating to the proceedings against or the execution of sentence upon the person extradited or the re-extradition of that person to a third State.

ARTICLE 21

TRANSIT

1. Where a person is to be extradited to a Party from a third State through the territory of the other Party, the Party to which the person is to be extradited shall request the other Party to permit the transit of that person through its territory. The request for transit may be submitted by any means affording a record in writing and this transit shall be conducted after that Party has given approval in writing.

2. Upon receipt of a request for permission for transit, the Requested Party shall grant permission unless there are reasonable grounds for refusing to do so.

3. Permission for transit shall not be required when air transport is to be used and no landing is scheduled in the territory of the Party of transit. If an unscheduled landing occurs in the territory of that Party, it may require that other Party to furnish a request for transit as provide for in paragraph 1 of this Article. That Party shall detain the person to be transferred until the request for transit is received and the transit is affected, so long as the request is received within four (04) days (96 hours) of the unscheduled landing.

4. Permission for the transit of a person shall, subject to the law of the Requested Party, include permission for the person to be held in custody during transit.

5. Where a person is being held in custody pursuant to paragraph 4 of this Article, the Party in whose territory the person is being held may direct that the person be released if transportation is not continued within a reasonable time.

6. The Party to which the person is being extradited shall reimburse the other Party for any expense incurred by the other Party in connection with the transit.

ARTICLE 22

EXPENSES

1. The Requested Party shall make all necessary arrangements for and meet the costs of any proceedings arising out of a request for extradition and shall otherwise represent the interests of the Requesting Party.

2. The Requested Party shall bear the expenses incurred in its territory in the arrest and detention of the person whose extradition is sought until that person is surrendeted to a person nominated by the Requesting Party.

3. The Requesting Party shall bear the expenses incurred in conveying the person from the territory of the Requested Party and the costs of transit.

ARTICLE 23

RELATIONSHIP WITH MULTILATERAL TREATIES/AGREEMENTS

This Agreement shall not affect any obligations of the Parties under any multilateral treaties/agreements to which they both are parlies.

ARTICLE 24

CONSULTATION

The Central Authorities provided in Article 3 or persons designated by the Central Authorities may consult with each other directly in connection with the processing of individual cases and in furtherance of efficient implementation of this Agreement.

ARTICLE 25

SETTLEMENT OF DISPUTES

1. The Central Authorities shall endeavor to mutually resolve any dispute arising out of the interpretation, application or implementation of this Agreement.

2. If the Central Authorities are unable to resolve the dispute mutually, it shall be resolve through diplomatic channel.

ARTICLE 26

AMENDMENTS, SUPPLEMENTATION

This Agreement may be amended or supplemented in writing by mutual consent through diplomatic channel. Any amendment or modification to this Agreement agreed to by the Parties shall come into force in the same manner as the Agreement itself. Such amendment or supplementation shall become an integral part of this Agreement.

ARTICLE 27

ENTRY INTO FORCE AND TERMINATION

1. Each Party shall inform the other by diplomatic note when all necessary steps have been taken for entry into force of this Agreement. This Agreement shall enter into force on the thirtieth day from the date of receipt of the later diplomatic note.

2. This Agreement applies to any requests presented after its entry into force even if the relevant conduct occurred before the entry into force of this Agreement.

3. The Agreement shall remain in force for an indefinite period. However, either Party may terminate this Agreement at any time by notice in writing to the other Party through diplomatic channels. Termination shall take effect on the one hundred and eightieth (180th) day after the date on which the notice is given.

4. Notwithstanding any termination, this Agreement continues to apply to the extradition requests made before the date on which such termination takes effect.

IN WITNESS WHEREOF, the undersigned, being duly authorized by their respective States, have signed this Agreement.

DONE IN DUPLICATE in Maputo City on this 09th day of December 2019, in the Vietnamese, Portuguese and English languages, each text being equally authentic. In case of any divergence of interpretation, the English text shall prevail.
