CIRCULAR
PROMULGATING REGULATION ON ASSESSMENT AND CLASSIFICATION OF SECONDARY SCHOOLS AND HIGH SCHOOL STUDENTS
Pursuant to the Education Law dated June 14, 2005, the Law amending and supplementing some Articles of the Education Law dated November 25, 2009;
Pursuant to Decree No.32/2008/ND-CP dated March 19, 2008 of the Government regulating functions, duties, powers and organizational structure of Ministry of Education and Training;
Pursuant to Decree No.75/2006/ND-CP dated August 02, 2006 of the Government detailing and guiding the implementation of some Articles of the Education Law; Decree No.31/2011/ND-CP dated May 11, 2011 of the Government amending and supplementing some Articles of Decree No.75/2006/ND-CP dated August 02, 2006 of the Government detailing and guiding the implementation of some Articles of the Law on Education;
At the proposal of the Director of School Education,
Minister of Education and Training makes a decision:
Article 1. To issue together with this Circular Regulation on assessment and classification of secondary school and high school students.
Article 2. This Circular takes effect from January 26, 2012. This Circular replaces Decision No.40/2006/QD-BGDDT dated October 05, 2006 of the Minister of Education and Training promulgating Regulations on assessment and classification of secondary school and high school students and Circular No.51/2008/QD-BGDDT dated 15/9/2008 of the Minister of Education and Training amending and supplementing some Articles of the Regulation on assessment and classification of secondary school and high school students issued together with Decision No.40/2006/QD-BGDDT dated October 05, 2006 of the Minister of Education and Training.
Article 3. Chief Office, Director of Department of School Education, Heads of relevant units under the Ministry of Education and Training, Chairmen of People's Committees of provinces and cities under central authority, the Director of Department of Education and Training are responsible for the implementation of this Circular./.

REGULATION
ON ASSESSMENT AND CLASSIFICATION OF SECONDARY SCHOOLS AND HIGH SCHOOL STUDENTS

Chapter I
GENERAL PROVISIONS
Article 1. Scope of governing and application subjects
1. This Regulation provides for assessment and classification of secondary school students (secondary school) and high school students (high school) including: assessment, classification of conduct; assessment, classification of learning capacity; use of results of assessment, classification; responsibilities of teachers, education managers and the management agencies of education.
2. This Regulation applies to students of secondary schools, high schools; students of high school and secondary school levels have many levels; students of Specialized High Schools; students of high school and secondary school levels in ethnic boarding high schools and ethic semi-boarding high schools.
Article 2. Purposes, bases, and principles of assessment and classification
1. Assessment of the quality of education for students after each semester, each school year to promote students to train and learn.
2. Bases for assessment and classification of students are based on the following grounds:
a) Objectives of education of school levels;
b) The program and plan of education of school levels;
c) Charters of schools;
d) The results of training and learning of students.
3. Assurance of the principles of objectivity, fairness, openness, the right quality in the assessment and classification of conduct, students’ learning capacity.
Chapter II
ASSESSMENT AND CLASSIFICATION OF CONDUCT
Article 3. Bases for evaluation and classification of conduct
1. Bases for evaluation and classification of conduct:
a) Assessment of students’ conduct based on the specific expression of attitudes and ethical behavior; behavior in relationships with teachers, officials and public employees, with family, friends and social relationships and sense to strive in learning; the result of participating in labor, the collective activities of the classes, schools and of society; doing exercise, keeping hygiene and environmental protection;
b) The results of commenting the expressions in attitudes, behaviors of students for teaching contents of the citizens education subject provided for in the general education program for secondary school, high school levels issued by the Minister of Education and training.
2. Classification of conduct:
Conduct is classified into 4 categories: Good grade (G), rather good grade (R), medium grade (I), weak grade (W) after each semester and the school year. The classification of conduct for the school year is mainly based on conduct classification of the second semester and the student's progress.
Article 4. Standards for classification of conduct
1. Good grade:
a) Strictly observing the rules of the school; strictly observing the laws and regulations on order and social safety, traffic safety; actively involving in fighting against the negative action, prevention and combat of crime, social evils;
b) Always respecting teachers, and adults; love and help young children, having sense to build the collective, uniting, being trusted by friends;
c) Positively training morality, having a healthy, simple, unpretentious lifestyle; helping, caring for families;
d) Completing fully the task of learning, having sense of striving, honesty in life, in study;
đ) Actively doing exercise, keeping hygiene and protecting environment;
e) Fully participating in educational activities, activities organized by the schools; actively participating in the activities of the Ho Chi Minh Young Pioneers, Youth Union of Ho Chi Minh Communist;
g) Having attitudes and appropriate behavior in training ethic, lifestyle according to contents of the citizen education subject.
2. Rather good grade:
Implementing the provisions in clause 1 of this Article but having not reached the level of Good; incomplete but timely taking remedy after the teachers and friends comment.
3. Medium grade:
There are some shortcomings in the implementation of the provisions in clause 1 of this Article but their levels are not serious; after being prompted, educated, they are absorbed, overcome but their progress is slow.
4. Weak grade:
Not being obtained standard of medium grade or having one of the following defects:
a) Having mistakes of the serious nature or repeated in the implementation of the provisions in clause 1 of this Article, be educated, but not taking remedy;
b) Having impoliteness, hurting dignity, honor, or hurting the body of teachers, school staffs; hurting the honor and dignity of friend or others;
c) Having fraud in the study, examination, contest;
d) Fighting, disturbing order and security in schools or society; violating traffic safety; causing damage to public property or property of others.
Chapter III
ASSESSMENT AND CLASSIFICATION OF LEARNING CAPACITY
Article 5. Based on evaluation and classification of learning capacity
1. Bases for evaluation and classification of learning capacity:
a) The level to complete the program of subjects and educational activities in education plan of secondary school, high school levels;
b) The result of the tests.
2. Learning capacity is classified into 5 categories: Good grade (G), rather good grade (R), medium grade (M), weak grade (W), poor grade (P).
Article 6. Assessment form and results of the subjects after a semester, school year
1. Form of assessment:
a) Assessment by comment of learning results (hereinafter referred to as assessment by comments) for the subjects of Music, Art, Physical Education.
Based on the standard of knowledge and skills of subjects specified in the program of general education, positive attitude and the progress of students to review the test results in two levels:
- Satisfaction (S): If making sure at least one of the two following conditions:
+ Implementing basically the requirements of knowledge standard and skills for the contents in the test;
+ Having attempts, positive learning, and significant progress in implementing the requirements of knowledge standard and skills for the contents in the test.
- No satisfaction (NS): The remaining cases.
b) Combination with the assessment and comment of learning outcomes for citizens education subject:
- Assessment by scoring the performance of the requirements of standard of knowledge, skills and attitudes for each topic of Citizens subject provided for in the general education program for secondary school, high school levels issued by the Ministry Minister of Education and Training;
- Assessment by commenting the progress of attitudes, behavior in training ethic, the lifestyle of students in according to the content of citizenship education subject provided for in the general education program for secondary school, high school levels issued by the Ministry Minister of Education and Training in each semester, the school year.
The results of comment on the progress of attitudes, behavior in training ethic, the lifestyle of students are not recorded into book of the names and points, but evaluated and recorded by teachers of citizen education subjects in transcripts and in collaboration with the class teachers to consult after each semester when rating conduct.
c) Assessment by scoring for the remaining subjects.
d) The tests are scored on a scale of 0 to point 10; if using other scale must be converted to this scale.
2. Result of subject and results of subjects after each semester, the school year:
a) For the subjects assessed by scoring: to calculate average point of subject and grade average point of the subjects after each semester, the school year;
b) For the subjects evaluated by comments: Comment each subject after each semester, the school year in two categories: Satisfaction (S) and No Satisfaction (NS); comment on ability (if any).
Article 7. Inspection form, the types of tests, the coefficient of point of the test
1. Inspection form:
Quiz (test by question-answer), written test, practice test.
2. The types of tests:
a) Regular tests (KTtx) include quiz; written test under one class hour; and practice test less than one class hour;
b) Periodic tests (KTdk) include written test from one class hour or more; semester test (KThk).
3. Coefficient of points of the types of tests:
a) For the subjects assessed by scoring: The regular inspection point is calculated coefficient of 1, the points of written test and practice test from one class hour or more are calculated coefficient of 2, the point of semester is calculated coefficient of 3.
b) For the subjects evaluated by comments: comment results of the tests are calculated once as classifying subjects per semester.
Article 8. Number of tests and method of scoring
1. Number of KTdkis defined in the teaching plan, including testing the chosen subjects.
2. Number of KTtx: In each semester, a student must have number of KTtx of each subject including testing the chosen subjects as follows:
a) The subject that has a class hour or less/week: at least twice;
b) The subject that has from 1 class hour to less than 3 class hours/week: at least 3 times;
c) The subject that has from 3 class hours or more/week: at least 4 times.
3. Number of tests for specialized subjects: In addition to the number of tests specified in Clause 1, Clause 2 of this Article, the principal of the specialized high schools may require some additional tests for specialized subjects.
4. The points of KTtx in the form of assay are integers, the points of KTtx by the form of multiple choices or with part of multiple choice and the points of KTdkare integers or decimal number taken to the first decimal number after being rounded.
5. Students who do not have enough tests as prescribed in clause 1, clause 2 of this Article must be examined in compensation. The tests in compensation must have forms, the levels of knowledge, skills, and time equivalent to the missing tests. Students who fail to attend the tests in compensation will be scored point of 0 (for subjects assessed by scoring) or commented at level of NS (for those subjects evaluated by comments). The tests in compensation must be completed in each semester or the end of school year.
Article 9. Examination, scoring points of the electives of the subjects
1. Electives:
The examination, scoring, calculation of point average of subject and participation in evaluating point average of subjects is performed as other subjects.
2. Self-selected topics under the subjects:
The types of self-selected topics of a certain subject shall be examined, scored and calculated point average for that subject.
Article 10. The results of the subjects of each semester, school year
1. For subjects assessed by scoring:
a) Grade point average of semester subjects (DTBmhk) is the average plus of the tests KTtx, KTdkand KThk with coefficients specified at Point a, Clause 3, Article 7 of this Regulation:

b) Grade point average of subjects of school year (DTBmcn) is the average plus of DTBmhkI with DTBmhkII, which DTBmhkII calculated the factor of 2:

c) DTBmhk and DTBmcn means an integer or decimal number taken to the first decimal number after being rounded.
2. For subjects assessed with comments:
a) Classification of semester:
- Satisfaction (S): Having enough number of tests as prescribed in Clauses 1, 2, 3, of Article 8 and 2/3 number of tests or more evaluated at D, which has the semester test.
- No satisfaction (NS): The remaining cases.
b) Classification of the school year:
- Satisfaction (S): Both semesters graded S or first semester graded NS, second semester graded S.
- No satisfaction (NS): two semesters graded NS, or first semester graded S, second semester graded NS.
c) Students who have aptitudes shall be recorded by teachers’ comments into transcripts.
3. For subjects taught in a semester, then take the results of assessment and classification of the semester to be the results of assessment and classification of the school year.
Article 11. Grade point average of subjects of semester, the school year
1. Grade point average of subjects of semester (DTBhk) is the average plus of grade point average of the subjects assessed by scoring.
2. Grade point average of subjects of school year (DTBcn) is the average plus of school year grade point average of the subjects assessed by scoring.
3. Grade point average of subjects of semester or school year is integers or decimal number taken to the first decimal number after being rounded.
Article 12. The cases exempted from learning physical education, music, art subjects, practice part of subject of defense - security education (GDQP-AN)
1. Students shall be exempted from learning physical education, music, art subjects in the curriculum if they have difficulties in learning certain subjects due to chronic illness, disability, accident or illness required to take the treatment.
2. Dossier of application for exemption from learning includes: application for exemption from learning of student and case history or certificate of injury issued by hospitals from district-level or more.
3. The permission of exemption from learning for the cases of illness or accidents is applied only during the school year; the cases of chronic illness, disability, or long-term injury are applied for the school year or school level.
4. Principals of schools allow students to be exempted from learning physical education, music, art subjects in a semester or school year. If exempted from learning for the school year, these subjects shall not be participated in evaluation and grading learning capacity of semester and school year; if exempted from learning only for a semester, then take the results evaluation and classification of the semester has learn to assess and classify for the school year.
5. For subjects of GDQP-AN:
Following the Decision No.69/2007/QD-BGDDT dated 14/11/2007 of the Minister of Education and Training promulgating Regulations on organization of teaching, learning and assessment of learning outcomes of GDQP-AN subject.
The cases that students are free for learning practice; they shall be examined in compensation by theory for adequate point as prescribed.
Article 13. Standard for grading semester and the school year
1. Good grade, if it meets the following standards:
a) Grade point average of the subjects from 8.0 points or more in which average point of one of two subjects Mathematics, Literature shall be from 8.0 or more; separately for students of specialized classes of specialized high schools, it is required to add condition of average point of the specialized subject from 8.0 or more;
b) There are no subjects that grade point average is below 6.5;
c) The subjects evaluated by comments reached S.
2. Rather good grade, if it meets the following standard:
a) Grade point average of the subjects from 6.5 points or more in which average point of one of two subjects Mathematics, Literature shall be from 6.5 or more; separately for students of specialized classes of specialized high schools, it is required to add condition of average point of the specialized subject from 6.5 or more;
b) There are no subjects that grade point average is below 5.0;
c) The subjects evaluated by comments reached S.
3. Medium grade, if it meets the following standard:
a) Grade point average of the subjects from 5.0 points or more in which average point of one of two subjects Mathematics, Literature shall be from 5.0 or more; separately for students of specialized classes of specialized high schools, it is required to add condition of average point of the specialized subject from 5.0 or more;
b) There are no subjects that grade point average is below 3.5;
c) The subjects evaluated by comments reached S.
4. Weak grade: Grade point average of the subjects from 3.5 points or more, there are no subjects that grade point average is below 2.0.
5. Poor grade: The remaining cases.
6. If DTBhk or DTBcn reaches level of each type specified in clauses 1 and 2 of this Article but as a result of a certain subject that is lower than the level prescribed for that type, so learning capacity should be ranked lower shall be adjusted as follows:
a) If DTBhk or DTBcn reaches G but as a result of a certain subject that must be down Medium grade, it shall be adjusted into R.
b) If DTBhk or DTBcn reaches G but as a result of a certain subject that must be down Weak grade, it shall be adjusted into Medium grade.
c) If DTBhk or DTBcn reaches R but as a result of a certain subject that must be down W, it shall be adjusted into M.
d) If DTBhk or DTBcn reaches R but as a result of a certain subject that must be down P, it shall be adjusted into W.
Article 14. Assessment of students with disabilities
1. Assessment for students with disabilities is based on the principle of promotion and encouragement for the efforts and progress of students as key.
2. Students with disabilities who have the ability to meet the requirements of educational program of secondary schools and high schools are evaluated, rated by the regulations as for normal students but with mitigation requirements for learning outcomes.
3. Students with disabilities that are unable to meet the requirements of educational program of secondary schools and high schools are evaluated based on the efforts and progress of students and it shall not classify this object.
Chapter IV
USE OF RESULTS OF ASSESSMENT AND CLASSIFICATION
Article 15. Passing of grade or non-passing of grade
1. Students who meet the following conditions shall be passed their grades:
a) Conduct and learning capacity from M or more;
b) Off from class is not more than 45 sessions in a school year (on leave allowed or not allowed, on leave continuously or several times combined).
2. Students of one of the following cases shall not be passed their grades:
a) Off from class is more than 45 sessions in a school year (on leave allowed or not allowed, on leave continuously or several times combined);
b) Learning capacity of school year reached Poor grade or learning capacity and conduct of school year reached Weak grade;
c) After being reexamined a number of subjects, subjects assessed by scoring with GPA below 5.0 or the subjects assessed by comment ranked NS, to re-classify the learning capacity for school year but still not satisfactory medium grade.
d) Conduct of school year reached weak grade, but not completing the training mission in the summer holidays so still be graded weak on conduct.
Article 16. Re-examination of the subjects
Students graded conduct of the school year from Medium or more but learning capacity of school year graded weak, shall be selected a number of subjects with grade point average of the school year below 5.0 or with the NS grade for re-examination. The results of re-examination shall be replaced for the rating result of the school year of that subject to re-calculate the grade point average of the subjects of school year and re-classified learning capacity; if obtained M grade, shall be passed.
Article 17. Training conduct in summer vacation
Students graded learning capacity of the school year from Medium or more but conduct of the school year graded weak, shall train more conduct during the summer vacation, the training forms shall be prescribed by the principal. Task of training during the summer vacation shall be sent notice to the family, government, unions of communes, wards and townships (referred to as commune-level) where students reside. At the end of summer vacation, if students are recognized as completed the task by the commune-level People's Committee, the class teacher shall propose the principal to permit re-classification of conduct; if obtained M grade, shall be passed.
Article 18. Review for the recognition of good students, advanced students
1. It shall be recognized good students of the semester or school year, if achieved with good conduct and good learning capacity.
2. It shall be recognized advanced students of the semester or school year, if achieved with conduct of rather good or more and learning capacity of rather good or more.
Chapter V
RESPONSIBILITIES OF TEACHERS, EDUCATIONAL MANAGERS, AND EDUCATION MANAGEMENT AGENCIES
Article 19. Responsibilities of subject teachers
1. To conduct fully the number of tests, and directly score the tests, record points or levels of comments (for the subject assessed with comments), record the content of the comments into the test, and directly record points or levels of comments (for the subject assessed with comments) in the book of names and points; for the form of oral test, teachers must comment, consult the response of students before the class, if making the decision to score or comment (for the subject assessed with comments) in the book of names and points, it must be done immediately.
2. To calculate grade point average of subjects (for subjects assessed by scoring), grade comments of subjects (for subjects assessed with comments) by the semester, the school year and directly record in the book of names and points in the transcripts.
3. To participate in the assessment and classification of the conduct of each semester, the school year of the students.
Article 20. Responsibilities of the class teachers
1. To inspect the book of name and points of the class; and help principal monitor the examination of scoring, the levels of comments under the provisions of this Regulation.
2. To calculate grade point average of subjects by the semester, the school year to certify the repair of points, repair of the subject teacher's comments in the book of names and points, in the transcripts.
3. To assess and classify conduct and learning capacity of each semester, the school year of students. To make a list of students recommended for passing, not being passed their grade; students recognized as good students, advanced students; students required to take the re-examination of the subjects, students required to train their conduct in summer vacation.
4. To make a list of students suggested rewarding at the end of semester, school year.
5. To record in the book of names and points and in the transcripts the following contents:
a) The results of assessment and classification of conduct and learning capacity of students;
b) Results of being passed or not being passed, recognized as good students, advanced students of semester, school year, being passed after re-examination or being trained their conduct during the summer vacation;
c) To review, evaluate the training result of students all sides including students with abilities of subjects evaluated by comments.
6. To coordinate with the Ho Chi Minh Young Pioneers, Communist Youth Union of Ho Chi Minh and the representatives of the class’s students’ parents to organize activities to educate students.
Article 21. Responsibilities of the Principals
1. To manage, guide teachers, staffs, students to make and disseminate to students’ families the provisions of this Regulation; to apply the provisions of this Regulation to evaluate and classify students with disabilities.
2. To inspect the implementation of regulations on examination, scoring and evaluate teachers’ comments; monthly to record comments and sign to certify in the books of names and points of the classes.
3. To inspect the assessment, classification, recording of results in the book of names and points, the transcripts of the subject teachers, class teachers; approve the repair of points, repair of the subject teachers’ comments the when certified by the class teachers.
4. To organize the re-examination of the subjects as prescribed in Article 16 of this Regulation; approve and publish a list of students to be passed their grade after having the results of the re-examination of the subjects, the result of training on conduct in the summer vacation.
5. To inspect, require the persons who are responsible for implementing this Regulation to immediately overcome errors in the following tasks:
a) To perform the inspection regime for the scoring and comments; recording of points and levels of comments in the book of names and points, transcripts; ranking of conduct, learning capacity of students;
b) To use the results of the evaluation and classification of conduct and learning capacity of students.
6. To approve list of students to be passed, not be passed their grade, to be obtained emulation titles, to be taken the re-examination of the subjects, to be trained their conduct during the summer vacation. To approve the results of the assessment and classification of students in the books of names and points and transcripts after all the subject teachers and the class teacher already recorded contents.
7. To make decisions within their competence, suggest the competent authorities to decide the handling for organizations and individuals that violate; decide the reward according to their competence, suggest the competent authorities to reward for organizations and individuals that have achievements in the implementation of this Regulation.
Article 22. The responsibilities of district-level departments of education and training and of Department of education and training
To manage, direct and inspect the schools under their jurisdiction to implement this Regulation; deal with violations under their authority.
