Ngày 03/05/2017, Bộ Y tế đã ban hành Thông tư số 07/2017/TT-BYT về Danh mục các loại thuốc không kê đơn, có hiệu lực từ ngày 01/07/2017.
Theo đó, thuốc trong Danh mục thuốc không kê đơn là những loại thuốc có độc tính thấp, trong quá trình bảo quản và khi vào trong cơ thể người không tạo ra các sản phẩm phân hủy có độc tính, không có những phản ứng có hại nghiêm trọng; Thuốc có phạm vi liều dùng rộng, an toàn cho các nhóm tuổi, ít có ảnh hưởng đến việc chẩn đoán và điều trị các bệnh cần theo dõi lâm sàng; Thuốc được chỉ định trong điều trị các bệnh không phải là bệnh nghiêm trọng và người bệnh có thể tự điều trị; Đường dùng, dạng thuốc đơn giản mà người sử dụng có thể tự dùng với hàm lượng, nồng độ thích hợp; Thuốc ít tương tác với các thuốc khác và thức ăn, đồ uống thông dụng; Thuốc ít có khả năng gây tình trạng lệ thuộc hoặc nguy cơ bị lạm dụng; Thuốc đã được lưu hành tại Việt Nam tối thiểu từ 05 năm.
Danh mục thuốc không kê đơn bao gồm 243 thuốc hóa dược và sinh phẩm; trong đó có thể kể đến như: Vitamin A và tiền Vitamin A dạng đơn thành phần và phối hợp với các vitamin; Panthenol; Paracetamol đơn thành phần; Men tiêu hóa; Berberin...
Thông tư này thay thế Thông tư số 23/2014/TT-BYT ngày 30/06/2014.

Căn cứ Luật dược ngày 06 tháng 4 năm 2016;
Căn cứ Nghị định số 63/2012/NĐ-CP ngày 31 tháng 8 năm 2012 của Chính phủ quy định chức năng nhiệm vụ, quyền hạn và cơ cấu tổ chức của Bộ Y tế;
Theo đề nghị của Cục trưởng Cục Quản lý Dược, Bộ trưởng Bộ Y tế ban hành “Thông tư ban hành Danh mục thuốc không kê đơn”.
Điều 1. Phạm vi điều chỉnh
Thông tư này quy định nguyên tắc xây dựng, tiêu chí lựa chọn thuốc không kê đơn; Danh mục thuốc không kê đơn; mục đích ban hành và trách nhiệm thực hiện.
Điều 2. Nguyên tắc xây dựng và tiêu chí lựa chọn thuốc vào Danh mục thuốc không kê đơn
1. Nguyên tắc xây dựng Danh mục thuốc không kê đơn:
a) Bảo đảm an toàn cho người sử dụng;
b) Bảo đảm việc tiếp cận thuốc kịp thời cho người dân;
c) Phù hợp với thực tế sử dụng, cung ứng thuốc của Việt Nam;
d) Hòa hợp với các nguyên tắc, quy định phân loại thuốc không kê đơn của các nước trong khu vực và trên thế giới.
2. Tiêu chí lựa chọn đưa thuốc vào Danh mục thuốc không kê đơn
Thuốc được xem xét lựa chọn vào Danh mục thuốc không kê đơn khi đáp ứng các tiêu chí sau đây:
a) Thuốc có độc tính thấp, trong quá trình bảo quản và khi vào trong cơ thể người không tạo ra các sản phẩm phân hủy có độc tính, không có những phản ứng có hại nghiêm trọng đã được biết hoặc được Tổ chức Y tế thế giới, cơ quan quản lý có thẩm quyền của Việt Nam hoặc nước ngoài khuyến cáo có phản ứng có hại dẫn đến một trong những hậu quả sau đây:
- Tử vong;
- Đe dọa tính mạng;
- Buộc người bệnh phải nhập viện để điều trị hoặc kéo dài thời gian nằm viện của người bệnh;
- Để lại di chứng nặng nề hoặc vĩnh viễn cho người bệnh;
- Gây dị tật bẩm sinh ở thai nhi;
- Bất kỳ phản ứng có hại khác gây hậu quả nghiêm trọng về mặt lâm sàng cho người bệnh do người hành nghề khám bệnh, chữa bệnh đánh giá, nhận định.
b) Thuốc có phạm vi liều dùng rộng, an toàn cho các nhóm tuổi, ít có ảnh hưởng đến việc chẩn đoán và điều trị các bệnh cần theo dõi lâm sàng;
c) Thuốc được chỉ định trong điều trị các bệnh không phải là bệnh nghiêm trọng và người bệnh có thể tự điều trị, không nhất thiết phải có sự kê đơn và theo dõi của người hành nghề khám bệnh, chữa bệnh;
d) Đường dùng, dạng thuốc đơn giản mà người sử dụng có thể tự dùng (chủ yếu là đường uống, dùng ngoài da) với hàm lượng, nồng độ thích hợp cho việc tự điều trị;
đ) Thuốc ít tương tác với các thuốc khác và thức ăn, đồ uống thông dụng;
e) Thuốc ít có khả năng gây tình trạng lệ thuộc;
g) Thuốc ít có nguy cơ bị lạm dụng, sử dụng sai mục đích làm ảnh hưởng đến sự an toàn của người sử dụng;
h) Thuốc đã có thời gian lưu hành tại Việt Nam tối thiểu từ 05 năm trở lên.
Điều 3. Danh mục thuốc không kê đơn
Thuốc không kê đơn quy định tại Danh mục ban hành kèm theo Thông tư này.
Điều 4. Mục đích ban hành Danh mục thuốc không kê đơn
1. Danh mục thuốc không kê đơn là cơ sở để phân loại thuốc không kê đơn và thuốc kê đơn. Các thuốc không thuộc Danh mục thuốc không kê đơn được phân loại là thuốc kê đơn.
2. Danh mục thuốc không kê đơn là cơ sở để cơ quan quản lý nhà nước xây dựng và ban hành các quy định, hướng dẫn đối với thuốc không kê đơn trong đăng ký thuốc, sản xuất, xuất khẩu, nhập khẩu, lưu thông phân phối thuốc, thông tin quảng cáo thuốc, thanh tra, kiểm tra, xử lý vi phạm và các hoạt động khác có liên quan.
Điều 5. Hiệu lực thi hành
1. Thông tư này có hiệu lực thi hành kể từ ngày 01 tháng 7 năm 2017.
2. Thông tư số 23/2014/TT-BYT ngày 30 tháng 6 năm 2014 của Bộ trưởng Bộ Y tế ban hành Danh mục thuốc không kê đơn hết hiệu lực thi hành kể từ ngày Thông tư này có hiệu lực.
Điều 6. Điều khoản chuyển tiếp
1. Kể từ ngày Thông tư này có hiệu lực, các thuốc trong Danh mục thuốc không kê đơn ban hành kèm theo Thông tư này được phép cấp phát, bán lẻ và sử dụng không cần đơn thuốc, trừ trường hợp thuốc đang được phân loại là thuốc kê đơn trên nhãn (bao gồm cả tờ hướng dẫn sử dụng thuốc) thì phải cấp phát, bán lẻ và sử dụng theo đơn thuốc.
2. Đối với các thuốc đã được cấp giấy đăng ký lưu hành tại Việt Nam hoặc được cấp giấy phép nhập khẩu trước ngày Thông tư này có hiệu lực thực hiện như sau:
a) Đối với các thuốc thuộc Danh mục thuốc không kê đơn theo quy định tại Thông tư số 23/2014/TT-BYT nhưng không thuộc Danh mục thuốc không kê đơn ban hành kèm theo Thông tư này, các cơ sở đứng tên trên giấy đăng ký lưu hành thuốc, cơ sở nhập khẩu thuốc phải phân loại, cập nhật, bổ sung các thông tin liên quan đến việc phân loại thuốc theo quy định của Thông tư này trên nhãn và tờ hướng dẫn sử dụng thuốc theo lộ trình quy định tại Thông tư quy định về ghi nhãn thuốc, nguyên liệu làm thuốc do Bộ trưởng Bộ Y tế ban hành trước khi đưa thuốc ra lưu thông trên thị trường.
b) Đối với các thuốc không thuộc Danh mục thuốc không kê đơn theo quy định tại Thông tư số 23/2014/TT-BYT nhưng thuộc Danh mục thuốc không kê đơn ban hành kèm theo Thông tư này, kể từ ngày Thông tư này có hiệu lực, khuyến khích cơ sở đứng tên trên giấy đăng ký lưu hành thuốc, cơ sở nhập khẩu thuốc phân loại, cập nhật, bổ sung các thông tin liên quan đến việc phân loại thuốc theo quy định của Thông tư này trên nhãn và tờ hướng dẫn sử dụng thuốc trước khi đưa thuốc ra lưu thông trên thị trường; hoặc các cơ sở được phép sản xuất nhập khẩu các thuốc có thông tin liên quan đến phân loại thuốc trên nhãn và tờ hướng dẫn sử dụng như đã được phê duyệt để lưu hành đến hết hạn dùng của thuốc.
3. Đối với hồ sơ đăng ký thuốc tại Việt Nam và hồ sơ nhập khẩu thuốc chưa có giấy đăng ký lưu hành tại Việt Nam đã nộp tại Cục Quản lý Dược trước ngày Thông tư này có hiệu lực nhưng chưa được cấp giấy đăng ký lưu hành hoặc chưa được cấp giấy phép nhập khẩu thực hiện như sau:
a) Đối với các thuốc thuộc Danh mục thuốc không kê đơn theo quy định tại Thông tư số 23/2014/TT-BYT nhưng không thuộc Danh mục thuốc không kê đơn ban hành kèm theo Thông tư này thì phải thực hiện phân loại thuốc theo quy định tại Thông tư này;
b) Đối với các thuốc không thuộc Danh mục thuốc không kê đơn theo quy định tại Thông tư số 23/2014/TT-BYT nhưng thuộc Danh mục thuốc không kê đơn ban hành kèm theo Thông tư này, cơ sở được tiếp tục thực hiện phân loại thuốc theo hồ sơ đã nộp hoặc thực hiện phân loại thuốc theo quy định của Thông tư này.
Điều 7. Trách nhiệm thi hành
1. Trách nhiệm của cơ sở dược, cơ sở khám bệnh, chữa bệnh:
a) Thực hiện các quy định tại Thông tư này;
h) Đề xuất sửa đổi, bổ sung Danh mục thuốc không kê đơn cho phù hợp tình hình thực tế, bảo đảm đáp ứng kịp thời thuốc phục vụ cho công tác phòng bệnh, chữa bệnh.
2. Trách nhiệm của Cục Quản lý Dược:
a) Chủ trì, phối hợp với các cơ quan chức năng thực hiện Thông tư này;
b) Rà soát Danh mục thuốc không kê đơn, trừ thuốc cổ truyền không kê đơn và báo cáo Bộ trưởng Bộ Y tế trên cơ sở đề xuất sửa đổi, bổ sung của các đơn vị quy định tại Khoản 1 Điều này hoặc kết luận của Hội đồng tư vấn cấp giấy đăng ký lưu hành thuốc, nguyên liệu làm thuốc.
3. Trách nhiệm của Cục Quản lý Y, Dược cổ truyền:
a) Phối hợp với Cục Quản lý Dược và các cơ quan chức năng thực hiện Thông tư này;
b) Rà soát Danh mục thuốc cổ truyền không kê đơn và báo cáo Bộ trưởng Bộ Y tế trên cơ sở đề xuất sửa đổi, bổ sung của các đơn vị quy định tại Khoản 1 Điều này hoặc kết luận của Hội đồng tư vấn cấp giấy đăng ký lưu hành thuốc, nguyên liệu làm thuốc.
Trong quá trình thực hiện nếu có vấn đề vướng mắc, đề nghị các cơ quan, tổ chức, cá nhân kịp thời phản ánh về Cục Quản lý Dược hoặc Cục Quản lý Y, Dược cổ truyền (đối với thuốc cổ truyền) để xem xét, giải quyết./.

Pursuant to thePharmaceuticalLawdated April 06, 2016;
Pursuant to the Government’s Decree No. 63/2012/ND-CPdated August31,2012 defining Functions, Tasks, Powers and Organizational Structure of Ministry ofHealth;
At the request of Director ofDrug Administration of Vietnam, Minister of Health promulgates the “Circular on promulgation of list of OTC drugs”.
Article 1. Scopeof adjustment
This Circular provides for rules for compiling the list of OTC drugs, criteria for selection of OTC drugs; List of OTC drugs; purposes and implementation thereof.
Article 2. Rules for compiling List of OTC drugs and criteria for selection of OTC drugs
1. Rules for compiling List of OTC drugs
a) Ensure safety for drug users;
b) Ensure people’s timely access to OTC drugs;
c) Conform to the reality of use and supply of drugs in Vietnam;
d) Be harmonized with rules and regulations on classification of OTC drugs announced by the States in the region and the world.
2. Criteria for selection of OTC drugs
Drugs that satisfy all criteria below shall be put on the List of OTC drugs:
a) Any drug with low toxicity, does not create toxic degradation products, does not haveserious adverse reactionsthat are known or warned againstby the World Health Organization, regulatory authorities of Vietnam or foreign countries, and may cause any of the following adverse effects:
-Cause death;
-Threaten life;
- Need hospitalization or prolonged treatment;
-Cause permanent or serious impairments;
-Causecongenital malformations;
-Cause other drug adverse reactions that may cause adverse clinical effects on patients as assessed and judged by medical practitioners.
b) The dosage range is wide and safe for various age groups, does not significantly affect the diagnosis and treatment of diseases that need clinical monitoring;
c) Drugs indicated to treat common diseases which can be treated by patients themselves withoutprescription and monitoringfrommedical practitioners;
d) Drugs of which the administration routes and dosage forms are simple (oral, topical administration), and the concentration are appropriate for self-treatmentby patients;
dd) Drugs that rarely interact with other drugs or common foods and drinks;
e) Drugs that do not cause dependence;
g) Drugs that do not pose risks of overdose or misuse affecting the safety of drug users;
h) Drugs that have been selling in Vietnam for at least 05 years.
Article 3.List of OTC drugs
The List of OTC drugs is stated in the Appendix enclosed herewith.
Article 4. Purposes ofList of OTC drugs
1. The List of OTC drugs is the basis for separating OTC drugs and prescription drugs.Drugs that are not listed on theList of OTC drugsmust be classified asprescription drugs.
2. TheList of OTC drugs is the basis for formulation and promulgation of regulations and instructionsby regulatory authoritieson registration, manufacture, export, import, distribution, advertising of OTC drugs,inspection and handling of violations and other relevant activities.
Article 5. Effect
1. This Circular takes effectonfrom July 01, 2017.
2.TheCircular No. 23/2014/TT-BYTdated June 30, 2014 by Minister of Health on promulgation of List of OTC drugsshall be null and void as from thedate ofentry into force of thisCircular.
Article 6. Transitional provisions
1. Drugs on the List of OTC drugs promulgated under this Circular shall be provided, retailed and used without prescription as from the entry into force of this Circular, unless they are classified as prescription drugs as written on drug labels (and package inserts) which must be provided, retailed and used according to prescriptions.
2. With regard to drugs that have registration numbersin Vietnamor import permits before this Circular takes effect:
a) With regard to drugs that are on the List of OTC drugs promulgated under the Circular No.23/2014/TT-BYTbut not on the List of OTC drugs enclosed herewith, holders of certificate of free sales and drug importers must classify, update and provide additional information concerning drug classifications in accordance with regulations herein on drug labels and package inserts according to the roadmap prescribed in Minister of Health’s Circulars on labeling of drugs and medicinal ingredients before such drugs are sold on the market.
b) With regard to drugs that arenoton the List of OTC drugs promulgated under the Circular No. 23/2014/TT-BYT but on the List of OTC drugs enclosed herewith,since the entry into force of this Circular,holders of certificate of free sales and drug importersare encouraged toclassify, update and provide additional information concerning drug classificationsin accordance with regulations herein on drug labels and package inserts beforesellingdrugs on the market; or drugs with approved drug classifications on labels and package inserts may be manufactured, imported and sold on the market until their expiry dates.
3. With regard to applications for drug registration in Vietnam and applications for permit to import drugs without certificate of free sale in Vietnam that are submitted to the Drug Administration of Vietnam before the date of entry into force of this Circular and are not yet processed:
a) With regard to drugs that are on the List of OTC drugs promulgated under the Circular No. 23/2014/TT-BYT but not on the List of OTC drugs enclosed herewith,applicants must carry out drug classifications under regulations herein;
b) With regard to drugs that are not on the List of OTC drugs promulgated under the Circular No. 23/2014/TT-BYT but on the List of OTC drugs enclosed herewith,applicants may carry out drug classifications according to submitted applications or in accordance with regulations herein.
Article 7. Implementation responsibilities
1.Responsibility of pharmacy establishments and health facilities:
a)Implement regulationsherein;
b) Propose revision to the List of OTC drugs in conformity with the reality to ensure the timely provision of drugs serving the prevention and treatment of diseases.
2.Responsibility of theDrug Administration of Vietnam:
a)Take charge of and cooperate withregulatory bodiesin implementing this Circular;
b) Review the List of OTC drugs, except non-prescription traditional medicines, and submit reports thereof to the Minister of Health according to proposals and suggestions of units mentioned in Clause 1 herein or conclusion of the Advisory Council for issuance of certificate of free sale of drugs and medicinal ingredients.
3. Responsibility of the Traditional Medicine Administration of Vietnam:
a) Cooperate withtheDrug Administration of Vietnamandregulatory bodies in implementing this Circular;
b) Review the List of non-prescription traditional medicines and submit reports thereof to the Minister of Health according to proposals and suggestions ofunitsmentioned in Clause 1 herein or conclusion of the Advisory Council for issuance of certificate of free sale of drugs and medicinal ingredients.
Any difficulties arising in the course ofimplementation of this Circular should be promptly reported to the Drug Administration of Vietnamor theTraditional Medicine Administration of Vietnam(if related to traditional medicines)for consideration./.

II.OTC HERBAL DRUGS, TRADITIONAL DRUGS (EXCEPT TRADITIONAL INGREDIENTS)
Herbal drugs, traditional drugs (except traditional ingredients)which meet all of the following criteria shall be classified as OTC drugs:
1.Do not contain herbal ingredients on the List of toxic herbal ingredients announced by Minister of Health.
2.Do not have any of the following indications:
a) Use as supportive drugs or for treatment of cancer or tumor;
b) Treatment of cardiovascular diseases or blood pressure diseases;
c) Treatment of liver, biliary orpancreasdiseases (excluding liver tonics);
d) Treatment ofParkinsondisease;
dd) Treatment of viral infection;
e) Treatment of fungal infections (excludingtopicalantifungal medications);
g) Treatment oftuberculosis;
h) Treatment of malaria;
i) Treatment ofgout;
k) Treatment of asthma;
l) Treatment ofendocrinediseases;
m) Treatment ofblood disorders ordiseases;
n) Treatment of blood disorders or diseases;
o) Treatment of kidneyand genitourinary systemdiseases (excluding kidney yang tonics);
p) Treatment ofbacterial contaminationdiseases (excluding topical antibiotics);
q) Treatment of chronicinsomnia;
r) Treatment of psychological disorders and mental illness;
s) Drug abuse treatment or supportive drugs for addiction treatment (including supportive drugs for detoxification);
t) Interruption of pregnancy;
u) Treatment of dangerous and emerging infectious diseases as regulated by Minister of Health.
III. OTC TRADITIONAL INGREDIENTS
Traditional ingredients that are not manufactured or made of herbal ingredients on the List of toxic herbal ingredients announced by Minister of Health shall be classified as OTC (non-prescription) drugs.
