Các trường hợp cơ sở đào tạo không được tăng chỉ tiêu tuyển sinh

Ngày 18/01/2022, Bộ Giáo dục và Đào tạo ban hành Thông tư 03/2022/TT-BGDĐT quy định về việc xác định chỉ tiêu tuyển sinh đại học, thạc sĩ, tiến sĩ và chỉ tiêu tuyển sinh cao đẳng ngành Giáo dục Mầm non.

Theo đó, chỉ tiêu tuyển sinh được xác định dựa trên năng lực đào tạo của cơ sở đào tạo, nhu cầu sử dụng nhân lực, tỉ lệ sinh viên có việc làm trong 12 tháng kể từ khi được công nhận tốt nghiệp (với đào tạo chính quy trình độ cao đẳng, đại học), kết quả tuyển sinh của năm tuyển sinh trước liền kề với năm xác định chỉ tiêu và tổ chức tuyển sinh của cơ sở đào tạo.

Tổng chỉ tiêu tuyển sinh của cơ sở đào tạo theo từng trình độ và theo từng lĩnh vực (với chỉ tiêu đại học) hoặc theo từng ngành (với chỉ tiêu thạc sĩ, tiến sĩ) không được tăng so với năm tuyển sinh trước liền kề với năm xác định chỉ tiêu và tổ chức tuyển sinh của cơ sở đào tạo nếu cơ sở đào tạo đủ điều kiện về thời gian để thực hiện kiểm định cơ sở đào tạo nhưng chưa được công nhận đạt chuẩn kiểm định chất lượng.

Bên cạnh đó, chỉ tiêu tuyển sinh của lĩnh vực không được tăng so với năm tuyển sinh trước liền kề với năm xác định chỉ tiêu và tổ chức tuyển sinh của lĩnh vực đó nếu tỉ lệ số sinh viên tốt nghiệp trình độ đại học có việc làm trong 12 tháng kể từ khi được công nhận tốt nghiệp của lĩnh vực đó đạt dưới 80% hoặc tỉ lệ thực hiện chỉ tiêu tuyển sinh của lĩnh vực đó ở năm tuyển sinh liền kề trước năm tuyển sinh đạt dưới 80% (với xác định chỉ tiêu tuyển sinh đại học, trừ 1 số trường hợp).

Thông tư có hiệu lực từ ngày 04/3/2022.

Quy định về việc xác định chỉ tiêu tuyển sinh đại học, thạc sĩ, tiến sĩ và chỉ tiêu tuyển sinh cao đẳng ngành Giáo dục Mầm non

Căn cứ Luật Giáo dục ngày 14 tháng 6 năm 2019;

Căn cứ Luật Giáo dục đại học ngày 18 tháng 6 năm 2012 và Luật sửa đổi, bổ sung một số điều của Luật Giáo dục đại học ngày 19 tháng 11 năm 2018;

Căn cứ Nghị định số 69/2017/NĐ-CP ngày 25 tháng 5 năm 2017 của Chính phủ quy định chức năng, nhiệm vụ, quyền hạn và cơ cấu tổ chức của Bộ Giáo dục và Đào tạo;

Căn cứ Nghị định số 99/2019/NĐ-CP ngày 30 tháng 12 năm 2019 của Chính phủ quy định chi tiết và hướng dẫn thi hành một số điều của Luật sửa đổi, bổ sung một số điều của Luật Giáo dục đại học;

Theo đề nghị của Vụ trưởng Vụ Giáo dục Đại học;

Bộ trưởng Bộ Giáo dục và Đào tạo ban hành Thông tư quy định về việc xác định chỉ tiêu tuyển sinh đại học, thạc sĩ, tiến sĩ và chỉ tiêu tuyển sinh cao đẳng ngành Giáo dục Mầm non.

Điều 1. Phạm vi điều chỉnh và đối tượng áp dụng

1. Thông tư này quy định về việc xác định chỉ tiêu tuyển sinh đại học, thạc sĩ, tiến sĩ và chỉ tiêu tuyển sinh cao đẳng ngành Giáo dục Mầm non.

2. Thông tư này áp dụng đối với các cơ sở giáo dục đại học; các cơ sở giáo dục khác được phép đào tạo đại học, thạc sĩ, tiến sĩ; viện hàn lâm, viện do Thủ tướng Chính phủ thành lập theo quy định của Luật Khoa học và Công nghệ được phép đào tạo tiến sĩ; các trường cao đẳng được phép đào tạo cao đẳng ngành Giáo dục Mầm non (sau đây gọi chung là cơ sở đào tạo); các tổ chức và cá nhân có liên quan.

Điều 2. Mục tiêu

1. Cơ sở đào tạo căn cứ vào các điều kiện bảo đảm chất lượng đào tạo và yêu cầu phát triển kinh tế - xã hội, thực hiện quyền tự chủ và trách nhiệm giải trình trong việc xác định và thực hiện chỉ tiêu tuyển sinh hằng năm.

2. Thực hiện công khai, minh bạch các điều kiện bảo đảm chất lượng đào tạo, cơ sở để xác định chỉ tiêu tuyển sinh, tỉ lệ sinh viên có việc làm sau khi tốt nghiệp của cơ sở đào tạo để các cơ quan quản lý nhà nước thanh tra, kiểm tra, xã hội giám sát và người học lựa chọn cơ sở đào tạo dự tuyển.

Điều 3. Giải thích từ ngữ
Trong Thông tư này, các từ ngữ dưới đây được hiểu như sau:

1. Danh mục thống kê ngành đào tạo là Danh mục giáo dục, đào tạo cấp IV đối với các trình độ của giáo dục đại học, do Bộ Giáo dục và Đào tạo ban hành.

2. Ngành đào tạo là tập hợp kiến thức và kỹ năng chuyên môn trong phạm vi hoạt động nghề nghiệp, khoa học và công nghệ, được thống kê, phân loại trong Danh mục thống kê ngành đào tạo.

3. Nhóm ngành đào tạo là tập hợp một số ngành đào tạo có những đặc điểm chung về chuyên môn, trong phạm vi hoạt động nghề nghiệp, khoa học và công nghệ, được thống kê, phân loại trong Danh mục giáo dục, đào tạo cấp III thuộc Danh mục giáo dục, đào tạo của hệ thống giáo dục quốc dân theo quy định của Thủ tướng Chính phủ.

4. Lĩnh vực đào tạo là tập hợp các nhóm ngành đào tạo có những đặc điểm chung về kiến thức, kỹ năng chuyên môn trong phạm hoạt động nghề nghiệp, khoa học và công nghệ được thống kê, phân loại trong Danh mục giáo dục đào tạo cấp II thuộc Danh mục giáo dục, đào tạo của hệ thống giáo dục quốc dân.

5. Giảng viên toàn thời gian trong xác định chỉ tiêu tuyển sinh bao gồm giảng viên cơ hữu và giảng viên ký hợp đồng lao động xác định thời hạn từ đủ 12 tháng trở lên đang làm việc toàn thời gian tại cơ sở đào tạo (sau đây gọi chung là giảng viên toàn thời gian), cụ thể như sau:

a) Giảng viên cơ hữu được xác định theo quy định tại điểm e khoản 1 Điều 10 của Nghị định số 99/2019/NĐ-CP ngày 30 ngày 12 tháng 2019 của Chính phủ quy định chi tiết và hướng dẫn thi hành một số điều của Luật sửa đổi, bổ sung một số điều của Luật Giáo dục đại học;

b) Giảng viên ký hợp đồng lao động xác định thời hạn từ đủ 12 tháng trở lên, làm việc toàn thời gian tại cơ sở đào tạo theo quy định hiện hành của Bộ Giáo dục và Đào tạo quy định về chế độ làm việc của giảng viên đại học cho năm xác định chỉ tiêu tuyển sinh (bao gồm cả giảng viên hướng dẫn thực hành, thí nghiệm), đồng thời không ký hợp đồng lao động có thời hạn từ 3 tháng trở lên với đơn vị sử dụng lao động khác.

6. Giảng viên thỉnh giảng trong xác định chỉ tiêu tuyển sinh là người không thuộc diện theo quy định tại khoản 5 Điều này, trực tiếp tham gia giảng dạy, hướng dẫn người học của cơ sở đào tạo theo hợp đồng thỉnh giảng với cơ sở đào tạo theo quy định của pháp luật cho năm xác định chỉ tiêu tuyển sinh.

7. Sinh viên, học viên, nghiên cứu sinh dự kiến tốt nghiệp trong xác định chỉ tiêu tuyển sinh là số sinh viên, học viên, nghiên cứu sinh dự kiến sẽ tốt nghiệp trong năm xác định chỉ tiêu tuyển sinh và được tính trên cơ sở quy mô đào tạo của từng ngành/lĩnh vực/hình thức đào tạo chia cho số năm đào tạo tương ứng với từng ngành/lĩnh vực/hình thức đào tạo đó.

Bổ sung

Điều 4. Nguyên tắc xác định chỉ tiêu tuyển sinh

1. Cơ sở đào tạo xác định chỉ tiêu tuyển sinh cao đẳng ngành Giáo dục Mầm non, chỉ tiêu tuyển sinh đại học, thạc sĩ, tiến sĩ theo quy định tại Thông tư này và các quy định hiện hành của pháp luật; công bố công khai, chịu trách nhiệm trước pháp luật và trách nhiệm giải trình về việc xác định chỉ tiêu tuyển sinh, các điều kiện bảo đảm chất lượng đào tạo và cam kết chuẩn đầu ra đáp ứng nhu cầu xã hội của cơ sở đào tạo, đồng thời chịu sự giám sát của các cơ quan quản lý và xã hội.

2. Chỉ tiêu tuyển sinh được xác định theo từng năm và độc lập theo từng trình độ đào tạo. Căn cứ chỉ tiêu đã xác định theo từng trình độ, cơ sở đào tạo phải công bố công khai chỉ tiêu tuyển sinh đã xác định theo ngành/nhóm ngành trong đề án và kế hoạch tuyển sinh, chịu trách nhiệm giải trình trước xã hội và cơ quan quản lý trực tiếp.

3. Chỉ tiêu tuyển sinh đại học xác định theo từng ngành, nhóm ngành và phải bảo đảm quy mô đào tạo không vượt quá năng lực đào tạo của lĩnh vực đào tạo tương ứng. Chỉ tiêu tuyển sinh thạc sĩ, tiến sĩ; chỉ tiêu tuyển sinh cao đẳng, ngành Giáo dục Mầm non và chỉ tiêu tuyển sinh đại học các ngành đào tạo giáo viên xác định theo từng ngành đào tạo, bảo đảm quy mô đào tạo không vượt quá năng lực đào tạo của ngành đào tạo đó.

4. Chỉ tiêu tuyển sinh được xác định trên cơ sở năng lực đào tạo của cơ sở đào tạo, nhu cầu sử dụng nhân lực, tỉ lệ sinh viên có việc làm trong khoảng thời gian 12 tháng kể từ khi được công nhận tốt nghiệp (đối với đào tạo chính quy trình độ cao đẳng, đại học), kết quả tuyển sinh của năm tuyển sinh trước liền kề với năm xác định chỉ tiêu và tổ chức tuyển sinh của cơ sở đào tạo, cụ thể:

a) Chỉ tiêu tuyển sinh của cơ sở đào tạo được xác định phù hợp với năng lực đào tạo của cơ sở đào tạo theo quy định từ Điều 7 đến Điều 12 Thông tư này;

b) Chỉ tiêu tuyển sinh của cơ sở đào tạo không được tăng trong các trường hợp sau:
- Tổng chỉ tiêu tuyển sinh của cơ sở đào tạo theo từng trình độ và theo từng lĩnh vực (đối với chỉ tiêu đại học) hoặc theo từng ngành (đối với chỉ tiêu thạc sĩ, tiến sĩ) không được tăng so với năm tuyển sinh trước liền kề với năm xác định chỉ tiêu và tổ chức tuyển sinh của cơ sở đào tạo nếu cơ sở đào tạo đủ điều kiện về thời gian để thực hiện kiểm định cơ sở đào tạo nhưng chưa được công nhận đạt chuẩn kiểm định chất lượng theo quy định hiện hành của pháp luật;
- Chỉ tiêu tuyển sinh của lĩnh vực không được tăng so với năm tuyển sinh trước liền kề với năm xác định chỉ tiêu và tổ chức tuyển sinh của lĩnh vực đó nếu tỉ lệ số sinh viên tốt nghiệp trình độ đại học có việc làm trong khoảng thời gian 12 tháng kể từ khi được công nhận tốt nghiệp của lĩnh vực đó đạt dưới 80% hoặc tỉ lệ thực hiện chỉ tiêu tuyển sinh của lĩnh vực đó ở năm tuyển sinh liền kề trước năm tuyển sinh đạt dưới 80% (áp dụng đối với xác định chỉ tiêu tuyển sinh đại học, trừ trường hợp ngành đào tạo ở trình độ đại học có chương trình đào tạo được công nhận đạt chuẩn kiểm định chất lượng theo quy định của pháp luật).

5. Cơ sở đào tạo vi phạm quy định về đối tượng, điều kiện, chỉ tiêu tuyển sinh theo quy định tại điểm c khoản 1 Điều 34 của Luật Giáo dục đại học (đã được sửa đổi, bổ sung năm 2018) không được tự xác định chỉ tiêu tuyển sinh trong thời hạn 05 năm, kể từ khi có kết luận của cơ quan nhà nước có thẩm quyền về vi phạm của cơ sở đào tạo. Trường hợp này, Bộ Giáo dục và Đào tạo xác định và thông báo chỉ tiêu tuyển sinh cho cơ sở đào tạo theo quy định như sau:

a) Cơ sở đào tạo đăng ký chỉ tiêu tuyển sinh bảo đảm tuân thủ đầy đủ nguyên tắc xác định chỉ tiêu tuyển sinh theo quy định tại các khoản 1, 2, 3 và khoản 4 Điều này sau đó trừ đi số lượng chỉ tiêu đã vi phạm về đối tượng, điều kiện, chỉ tiêu tuyển sinh của cơ sở đào tạo;

b) Bộ Giáo dục và Đào tạo xác định và thông báo chỉ tiêu tuyển sinh đối với cơ sở đào tạo theo quy định tại các khoản 1, 2, 3, 4 và điểm a khoản 5 Điều này.

6. Đối với các ngành đào tạo trình độ cao đẳng ngành Giáo dục Mầm non, trình độ đại học mới được mở ngành trong năm tuyển sinh, chỉ tiêu được xác định cho ngành đó nằm trong năng lực đào tạo của lĩnh vực đào tạo tương ứng và không vượt quá 30% năng lực đào tạo của ngành theo quy định.

7. Đối với các ngành thuộc nhóm ngành Đào tạo giáo viên, Bộ Giáo dục và Đào tạo xác định và thông báo chỉ tiêu tuyển sinh theo từng ngành đào tạo ở trình độ cao đẳng, trình độ đại học hình thức chính quy trên cơ sở năng lực đào tạo của cơ sở đào tạo, nhu cầu sử dụng của các địa phương và cả nước. Cơ sở đào tạo tự chủ xác định chỉ tiêu tuyển sinh cao đẳng, đại học hình thức vừa làm vừa học và chỉ tiêu tuyển sinh thạc sĩ, tiến sĩ theo quy định tại Thông tư này và các quy định của pháp luật có liên quan.

8. Đối với các ngành đào tạo thuộc lĩnh vực An ninh, quốc phòng, cơ quan quản lý trực tiếp cơ sở đào tạo xác định và thông báo chỉ tiêu tuyển sinh đào tạo các trình độ và hình thức đào tạo đối với các cơ sở đào tạo trên cơ sở năng lực đào tạo của cơ sở đào tạo và nhu cầu sử dụng, bảo đảm phù hợp với quy định tại Thông tư này và quy định của cơ quan quản lý trực tiếp cơ sở đào tạo cùng các quy định khác có liên quan của pháp luật.

9. Tỉ lệ sinh viên có việc làm đối với sinh viên tốt nghiệp cao đẳng, đại học quy định tại khoản 4 Điều này được xác định theo từng ngành đào tạo, được khảo sát ở năm liền kề trước năm tuyển sinh, đối tượng khảo sát là sinh viên đã tốt nghiệp ở năm trước cách năm tuyển sinh một năm và được xác định bằng tỉ lệ giữa số lượng sinh viên chính quy có việc làm trong khoảng thời gian 12 tháng kể từ khi được cơ sở đào tạo ra quyết định công nhận tốt nghiệp so với tổng số sinh viên chính quy tương ứng của ngành và trình độ đào tạo đã tốt nghiệp trong năm đó.

Điều 5. Quy định giảng viên trong xác định chỉ tiêu tuyển sinh

1. Mỗi giảng viên của cơ sở đào tạo được xếp vào một lĩnh vực đào tạo tham gia giảng dạy chính ở trình độ đại học (trừ các ngành thuộc nhóm ngành Đào tạo giáo viên và đào tạo trình độ cao đẳng ngành Giáo dục Mầm non mỗi giảng viên được xếp vào một ngành đào tạo tham gia giảng dạy chính); được xếp vào một ngành đào tạo tham gia giảng dạy chính ở trình độ thạc sĩ, trình độ tiến sĩ để xác định chỉ tiêu tuyển sinh. Việc sắp xếp giảng viên vào một lĩnh vực đào tạo/một ngành đào tạo phải phù hợp về chuyên môn và tương ứng với quy mô đào tạo của lĩnh vực đào tạo/ngành đào tạo đó.

2. Quy định giảng viên trong xác định chỉ tiêu trình độ đại học, trình độ cao đẳng:

a) Tổng số giảng viên quy đổi theo lĩnh vực đào tạo (trừ đào tạo trình độ đại học các ngành thuộc nhóm ngành Đào tạo giáo viên và đào tạo trình độ cao đẳng ngành Giáo dục Mầm non quy đổi theo ngành đào tạo) để xác định chỉ tiêu tuyển sinh của cơ sở đào tạo, bao gồm giảng viên toàn thời gian quy đổi và giảng viên thỉnh giảng quy đổi tương ứng của lĩnh vực đào tạo đó hoặc của ngành đào tạo đó;

b) Số lượng giảng viên thỉnh giảng quy đổi để xác định chỉ tiêu tuyển sinh được tính tối đa bằng 10% tổng số giảng viên toàn thời gian quy đổi của cơ sở đào tạo xác định theo lĩnh vực đào tạo. Riêng các ngành đào tạo đặc thù thuộc lĩnh vực Nghệ thuật và các ngành đào tạo đặc thù có nhu cầu cao về nhân lực trình độ đại học (quy định tại Phụ lục 2 ban hành kèm theo Thông tư này), số lượng giảng viên thỉnh giảng quy đổi để xác định chỉ tiêu tuyển sinh được tính tối đa bằng 40% tổng số giảng viên toàn thời gian quy đổi của cơ sở đào tạo xác định theo lĩnh vực đào tạo; các ngành đào tạo thuộc nhóm ngành Đào tạo giáo viên, giảng viên thỉnh giảng không được tính để xác định chỉ tiêu tuyển sinh;

c) Hệ số quy đổi giảng viên toàn thời gian, giảng viên thỉnh giảng tham gia giảng dạy trình độ cao đẳng ngành Giáo dục Mầm non, trình độ đại học của cơ sở đào tạo có chức danh, trình độ khác nhau quy định tại Bảng 1, Phụ lục 1 ban hành kèm theo Thông tư này; trong đó mỗi giảng viên chỉ được tính quy đổi một lần ở mức quy đổi cao nhất;

d) Đối với ngành đào tạo đặc thù có nhu cầu cao về nhân lực trình độ đại học đáp ứng yêu cầu phát triển kinh tế - xã hội của đất nước, bao gồm: ngành đào tạo thuộc lĩnh vực Máy tính và công nghệ thông tin, lĩnh vực Du lịch, khách sạn, thể thao và dịch vụ cá nhân (quy định tại Phụ lục 2 kèm theo Thông tư này) và các ngành đào tạo theo đề án được Thủ tướng chính phủ phê duyệt (Bộ Giáo dục và Đào tạo công bố trong từng giai đoạn và được điều chỉnh, bổ sung trên cơ sở căn cứ nhu cầu nhân lực nhằm đáp ứng yêu cầu phát triển kinh tế - xã hội của đất nước theo chủ trương, định hướng của Nhà nước), giảng viên thỉnh giảng được xác định bao gồm cả các chuyên gia, cán bộ kỹ thuật, cán bộ quản lý là những người lao động có bằng tốt nghiệp trình độ đại học cùng ngành hoặc cùng nhóm ngành với ngành tham gia đào tạo, đồng thời có từ 05 năm trở lên về kinh nghiệm hoạt động nghề nghiệp tại doanh nghiệp, hiệp hội nghề nghiệp gắn với ngành và lĩnh vực đào tạo làm giảng viên trợ giảng và được tính hệ số để xác định chỉ tiêu theo quy định tại điểm c khoản này.

3. Quy định giảng viên trong xác định chỉ tiêu trình độ thạc sĩ, tiến sĩ:

a) Tổng số giảng viên theo ngành đào tạo để xác định chỉ tiêu tuyển sinh của cơ sở đào tạo, bao gồm giảng viên toàn thời gian và giảng viên thỉnh giảng của cơ sở đào tạo có trình độ/chức danh đáp ứng yêu cầu của giảng viên giảng dạy chương trình thạc sĩ, tiến sĩ và phù hợp về chuyên môn tương ứng của ngành đào tạo đó;

b) Số lượng giảng viên thỉnh giảng để xác định chỉ tiêu tuyển sinh được tính tối đa bằng 10% tổng số giảng viên toàn thời gian của cơ sở đào tạo xác định theo ngành đào tạo. Riêng các ngành đào tạo đặc thù thuộc lĩnh vực Nghệ thuật, số lượng giảng viên thỉnh giảng để xác định chỉ tiêu tuyển sinh được tính tối đa bằng 40% tổng số giảng viên toàn thời gian của cơ sở đào tạo xác định theo ngành đào tạo; các ngành đào tạo thuộc nhóm ngành Đào tạo giáo viên, giảng viên thỉnh giảng không được tính để xác định chỉ tiêu tuyển sinh.

4. Đối với các ngành đào tạo giáo viên tiếng dân tộc thiểu số Việt Nam, ngành đào tạo Ngôn ngữ văn học và văn hóa Việt Nam, ngành đào tạo Ngôn ngữ văn học và văn hóa nước ngoài, ngành đào tạo Thể dục thể thao (theo quy định tại Danh mục thống kê ngành đào tạo), ngành đào tạo đặc thù thuộc lĩnh vực Nghệ thuật quy định giảng viên trong xác định chỉ tiêu thực hiện theo quy định tại khoản 2, 3 Điều này và theo quy định sau:

a) Giảng viên trợ giảng là Nghệ sĩ ưu tú, Nghệ sĩ Nhân dân, Nghệ nhân ưu tú, Nghệ nhân Nhân dân, Nhà giáo ưu tú, Nhà giáo Nhân dân được Nhà nước công nhận, trao tặng, đồng thời có bằng tốt nghiệp trình độ đại học cùng ngành hoặc cùng nhóm ngành với ngành tham gia đào tạo được tính hệ số để xác định chỉ tiêu tương ứng hệ số tính chỉ tiêu của giảng viên có trình độ thạc sĩ (đối với giảng viên trợ giảng trong xác định chỉ tiêu đại học);

b) Giảng viên là Nghệ sĩ Nhân dân, Nghệ nhân Nhân dân, Nhà giáo Nhân dân được Nhà nước công nhận, trao tặng, đồng thời có bằng tốt nghiệp trình độ thạc sĩ cùng ngành hoặc cùng nhóm ngành với ngành tham gia đào tạo được tính hệ số để xác định chỉ tiêu tương ứng hệ số tính chỉ tiêu của giảng viên có trình độ tiến sĩ (trong xác định chỉ tiêu đại học), được tính để xác định chỉ tiêu tương ứng với giảng viên có trình độ tiến sĩ (trong xác định chỉ tiêu thạc sĩ, tiến sĩ);

c) Giảng viên có danh hiệu là Nghệ sĩ Nhân dân, Nghệ nhân Nhân dân, Nhà giáo Nhân dân được Nhà nước công nhận, trao tặng, đồng thời có bằng tiến sĩ cùng ngành hoặc cùng nhóm ngành với ngành tham gia đào tạo được tính hệ số để xác định chỉ tiêu tương ứng hệ số tính chỉ tiêu của giảng viên có chức danh phó giáo sư (trong xác định chỉ tiêu đại học), được tính để xác định chỉ tiêu tương ứng với giảng viên có chức danh phó giáo sư (trong xác định chỉ tiêu thạc sĩ, tiến sĩ);

d) Giảng viên có danh hiệu là Nghệ sĩ Nhân dân, Nghệ nhân Nhân dân, Nhà giáo Nhân dân được Nhà nước công nhận, trao tặng, đồng thời có bằng tiến sĩ và học hàm phó giáo sư cùng ngành hoặc cùng nhóm ngành với ngành tham gia đào tạo được tính hệ số để xác định chỉ tiêu tương ứng hệ số tính chỉ tiêu của giảng viên có chức danh giáo sư (trong xác định chỉ tiêu đại học), được tính để xác định chỉ tiêu tương ứng với giảng viên có chức danh giáo sư (trong xác định chỉ tiêu thạc sĩ, tiến sĩ).

5. Riêng đối với các ngành đào tạo ngôn ngữ dân tộc thiểu số Việt Nam thuộc nhóm ngành Ngôn ngữ, văn học và văn hóa Việt Nam, giảng viên là người dân tộc thiểu số hoặc người có hiểu biết về ngôn ngữ, văn hóa dân tộc thiểu số phù hợp với ngôn ngữ văn hóa dân tộc thiểu số của ngành tham gia đào tạo; đồng thời có bằng tốt nghiệp trình độ đại học cùng ngành hoặc cùng nhóm ngành với ngành tham gia đào tạo được tính hệ số để xác định chỉ tiêu tương ứng hệ số tính chỉ tiêu của giảng viên có trình độ thạc sĩ (đối với giảng viên trợ giảng trong xác định chỉ tiêu đại học); đồng thời có bằng tốt nghiệp trình độ thạc sĩ cùng ngành hoặc cùng nhóm ngành với ngành tham gia đào tạo được tính hệ số để xác định chỉ tiêu tương ứng hệ số tính chỉ tiêu của giảng viên có trình độ tiến sĩ (trong xác định chỉ tiêu đại học), được tính để xác định chỉ tiêu tương ứng với giảng viên có trình độ tiến sĩ (trong xác định chỉ tiêu thạc sĩ, tiến sĩ); đồng thời có bằng tiến sĩ cùng ngành hoặc cùng nhóm ngành với ngành tham gia đào tạo được tính hệ số để xác định chỉ tiêu tương ứng hệ số tính chỉ tiêu của giảng viên có chức danh phó giáo sư (trong xác định chỉ tiêu đại học), được tính để xác định chỉ tiêu tương ứng với giảng viên có chức danh phó giáo sư (trong xác định chỉ tiêu thạc sĩ, tiến sĩ); đồng thời có bằng tiến sĩ và học hàm phó giáo sư cùng ngành hoặc cùng nhóm ngành với ngành tham gia đào tạo được tính hệ số để xác định chỉ tiêu tương ứng hệ số tính chỉ tiêu của giảng viên có chức danh giáo sư (trong xác định chỉ tiêu đại học), được tính để xác định chỉ tiêu tương ứng với giảng viên có chức danh giáo sư (trong xác định chỉ tiêu thạc sĩ, tiến sĩ).

6. Ngành đào tạo thuộc lĩnh vực Sức khỏe (theo quy định tại Danh mục thống kê ngành đào tạo) quy định giảng viên trong xác định chỉ tiêu thực hiện theo quy định tại khoản 2, khoản 3 Điều này và theo quy định sau:

a) Đối với cơ sở đào tạo có tổ chức đào tạo thực hành trong đào tạo lĩnh vực Sức khỏe được xác định người giảng dạy thực hành của cơ sở thực hành công lập thuộc trường hợp quy định tại khoản 2 Điều 10 Nghị định số 111/2017/NĐ-CP ngày 05 tháng 01 năm 2017 về tổ chức đào tạo thực hành trong đào tạo khối ngành Sức khỏe là giảng viên toàn thời gian của cơ sở đào tạo nếu đã được bổ nhiệm kiêm nhiệm chức danh lãnh đạo, quản lý từ cấp bộ môn trở lên tại cơ sở đào tạo;

b) Giảng viên có bằng bác sĩ nội trú, bằng chuyên khoa cấp I các chuyên ngành thuộc ngành tham gia đào tạo được tính hệ số để xác định chỉ tiêu tương ứng hệ số tính chỉ tiêu của giảng viên có trình độ thạc sĩ (trong xác định chỉ tiêu đại học); giảng viên có bằng chuyên khoa cấp II các chuyên ngành thuộc ngành tham gia đào tạo được tính hệ số để xác định chỉ tiêu tương ứng hệ số tính chỉ tiêu của giảng viên có trình độ tiến sĩ (trong xác định chỉ tiêu đại học), được tính để xác định chỉ tiêu tương ứng với giảng viên có trình độ tiến sĩ (trong xác định chỉ tiêu thạc sĩ, tiến sĩ).

Điều 6. Tiêu chí và cách tính theo tiêu chí xác định chỉ tiêu tuyển sinh cao đẳng, đại học hình thức chính quy

1. Tiêu chí số sinh viên chính quy tính trên một giảng viên quy đổi của cơ sở đào tạo theo từng lĩnh vực đào tạo:

a) Sinh viên chính quy trong xác định chỉ tiêu tuyển sinh gồm: Sinh viên đại học chính quy, sinh viên cao đẳng chính quy ngành Giáo dục Mầm non, sinh viên liên thông chính quy (bao gồm sinh viên liên thông từ trình độ trung cấp, trình độ cao đẳng lên trình độ đại học chính quy; liên thông từ trình độ trung cấp các ngành đào tạo giáo viên lên trình độ cao đẳng ngành Giáo dục Mầm non; người đã có bằng tốt nghiệp trình độ cao đẳng các ngành đào tạo giáo viên khác theo học trình độ cao đẳng ngành Giáo dục Mầm non; người đã có bằng tốt nghiệp trình độ đại học trở lên theo học trình độ đại học ngành khác); không tính sinh viên hệ cử tuyển theo học tại cơ sở đào tạo;

b) Số sinh viên theo học trình độ đại học hình thức chính quy trên một giảng viên quy đổi theo lĩnh vực đào tạo được xác định tối đa theo định mức tại Bảng 2, Phụ lục 1 ban hành kèm theo Thông tư này;

c) Số sinh viên theo học trình độ cao đẳng hình thức chính quy ngành Giáo dục Mầm non trên một giảng viên quy đổi không vượt quá 25 sinh viên;

d) Cách tính:
Lấy tổng quy mô sinh viên chính quy theo lĩnh vực đào tạo chia cho tổng số giảng viên quy đổi của lĩnh vực đào tạo đó.

2. Tiêu chí diện tích sàn xây dựng trực tiếp phục vụ đào tạo của cơ sở đào tạo tính trên một sinh viên chính quy của các hạng mục công trình và yêu cầu về chủng loại, số lượng học liệu, trang thiết bị tối thiểu theo yêu cầu của chương trình đào tạo và nghiên cứu khoa học:

a) Diện tích sàn xây dựng trực tiếp phục vụ đào tạo thuộc sở hữu tính trên một sinh viên chính quy không thấp hơn 2,8 m2;

b) Các hạng mục được tính diện tích sàn xây dựng trực tiếp phục vụ đào tạo và yêu cầu về chủng loại và số lượng tài liệu/trang thiết bị tối thiểu của từng hạng mục như sau:
- Hội trường, giảng đường, phòng học các loại, phòng đa năng, phòng làm việc của giáo sư, phó giáo sư, giảng viên của cơ sở đào tạo;
- Thư viện, trung tâm học liệu;
- Trung tâm nghiên cứu, phòng thí nghiệm, thực nghiệm, cơ sở thực hành, thực tập, luyện tập;

c) Cách tính:
Lấy tổng diện tích sàn xây dựng các hạng mục công trình được xác định tại điểm b khoản này chia cho tổng quy mô sinh viên chính quy của cơ sở đào tạo.

3. Đối với các ngành đào tạo thí điểm chủ yếu bằng phương thức trực tuyến, ứng dụng các thành tựu khoa học và công nghệ hiện đại trong đào tạo theo đề án của cơ sở đào tạo nhằm đáp ứng nhu cầu nhân lực trình độ đại học phục vụ phát triển kinh tế - xã hội của địa phương/ngành/đất nước được Bộ Giáo dục và Đào tạo phê duyệt trong từng giai đoạn, các tiêu chí xác định chỉ tiêu tuyển sinh đại học chính qui theo quy định tại khoản 1 và khoản 2 Điều này do Bộ trưởng Bộ Giáo dục và Đào tạo xem xét, quyết định.

4. Tiêu chí nhu cầu lao động của thị trường, yêu cầu phát triển kinh tế - xã hội: Cơ sở đào tạo xác định chỉ tiêu tuyển sinh phải căn cứ nhu cầu lao động của thị trường, yêu cầu phát triển kinh tế - xã hội của quốc gia, địa phương và của ngành.

Điều 7. Xác định chỉ tiêu tuyển sinh cao đẳng, đại học chính quy

1. Chỉ tiêu tuyển sinh cao đẳng ngành Giáo dục Mầm non và chỉ tiêu tuyển sinh đại học chính quy hằng năm được xác định tối đa bằng tổng quy mô đào tạo hình thức chính quy xác định trên cơ sở năng lực đào tạo của từng lĩnh vực đào tạo (của từng ngành đào tạo đối với các ngành thuộc nhóm ngành đào tạo giáo viên), đáp ứng đồng thời các tiêu chí quy định tại Điều 6 Thông tư này trừ đi tổng quy mô sinh viên chính quy đang đào tạo tại cơ sở đào tạo và cộng thêm số sinh viên dự kiến sẽ tốt nghiệp trong năm tuyển sinh, đồng thời phải bảo đảm phù hợp với các nguyên tắc chung theo quy định tại Điều 4 Thông tư này.

2. Chỉ tiêu tuyển sinh đào tạo liên thông trình độ đại học hình thức chính quy nằm trong tổng chỉ tiêu tuyển sinh đại học chính quy, trong đó tỉ lệ chỉ tiêu đào tạo liên thông từ trình độ trung cấp, trình độ cao đẳng lên trình độ đại học xác định theo quy định hiện hành của Chính phủ, Thủ tướng Chính phủ. Chỉ tiêu tuyển sinh đào tạo liên thông trình độ cao đẳng hình thức chính quy ngành Giáo dục Mầm non nằm trong tổng chỉ tiêu tuyển sinh cao đẳng chính quy của cơ sở đào tạo.

3. Đối với chỉ tiêu đào tạo liên thông chính quy thực hiện Nghị định số 71/2020/NĐ-CP ngày 30 tháng 3 năm 2020 của Chính phủ quy định lộ trình thực hiện nâng trình độ chuẩn được đào tạo của giáo viên mầm non, tiểu học, trung học cơ sở, Bộ trưởng Bộ Giáo dục và Đào tạo xem xét, quyết định và thông báo cho cơ sở đào tạo trên cơ sở nhu cầu của các địa phương và năng lực đào tạo của các cơ sở đào tạo.

Điều 8. Xác định chỉ tiêu cao đẳng, đại học các ngành đào tạo giáo viên chính quy

1. Cơ sở đào tạo được phép đào tạo các ngành đào tạo giáo viên xác định chỉ tiêu tuyển sinh cao đẳng ngành Giáo dục Mầm non, chỉ tiêu tuyển sinh đại học các ngành đào tạo giáo viên hình thức chính quy theo quy định tại Thông tư này và các quy định hiện hành của pháp luật, báo cáo về Bộ Giáo dục và Đào tạo để đăng ký chỉ tiêu tuyển sinh các ngành đào tạo giáo viên của cơ sở đào tạo.

2. Bộ Giáo dục và Đào tạo xác định và thông báo chỉ tiêu tuyển sinh cao đẳng ngành Giáo dục Mầm non, chỉ tiêu tuyển sinh đại học các ngành đào tạo giáo viên hình thức chính quy theo ngành đào tạo cho từng cơ sở đào tạo trên cơ sở năng lực đào tạo của cơ sở đào tạo, nhu cầu sử dụng của địa phương và cả nước, phù hợp với quy định tại Thông tư này và các quy định hiện hành của pháp luật có liên quan.

Điều 9. Xác định chỉ tiêu tuyển sinh cao đẳng, đại học vừa làm vừa học

1. Chỉ tiêu tuyển sinh cao đẳng ngành Giáo dục Mầm non hình thức vừa làm vừa học (bao gồm đào tạo cho đối tượng đã tốt nghiệp trung học phổ thông hoặc đối tượng đã có bằng tốt nghiệp trình độ cao đẳng và đào tạo liên thông trình độ cao đẳng cho đối tượng đã có bằng tốt nghiệp trình độ trung cấp) được xác định tối đa không quá 50% tổng chỉ tiêu tuyển sinh cao đẳng chính quy.

2. Chỉ tiêu tuyển sinh đại học vừa làm vừa học (bao gồm đào tạo cho đối tượng đã tốt nghiệp trung học phổ thông hoặc đối tượng đã có bằng tốt nghiệp trình độ đại học và đào tạo liên thông từ trình độ trung cấp, trình độ cao đẳng lên trình độ đại học) được xác định tối đa không vượt quá 30% chỉ tiêu tuyển sinh chính quy theo từng lĩnh vực đào tạo trình độ đại học của cơ sở đào tạo. Đối với lĩnh vực Nghệ thuật và nhóm ngành Đào tạo giáo viên, chỉ tiêu tuyển sinh đại học hình thức vừa làm vừa học của cơ sở đào tạo được xác định tối đa không vượt quá 50% chỉ tiêu tuyển sinh đại học chính quy theo từng lĩnh vực đào tạo (theo từng ngành đào tạo đối với nhóm ngành Đào tạo giáo viên) trình độ đại học của cơ sở đào tạo.

3. Chỉ tiêu tuyển sinh đào tạo liên thông trình độ đại học hình thức vừa làm vừa học nằm trong tổng chỉ tiêu tuyển sinh đại học vừa làm vừa học của cơ sở đào tạo, trong đó tỉ lệ chỉ tiêu đào tạo liên thông từ trình độ trung cấp, trình độ cao đẳng lên trình độ đại học hình thức vừa làm vừa học xác định theo quy định hiện hành của Chính phủ, Thủ tướng Chính phủ. Chỉ tiêu tuyển sinh đào tạo liên thông trình độ cao đẳng ngành Giáo dục Mầm non hình thức vừa làm vừa học nằm trong tổng chỉ tiêu tuyển sinh cao đẳng vừa làm vừa học của cơ sở đào tạo.

4. Đối với chỉ tiêu đào tạo liên thông hình thức vừa làm vừa học thực hiện Nghị định số 71/2020/NĐ-CP ngày 30 tháng 3 năm 2020 của Chính phủ quy định lộ trình thực hiện nâng trình độ chuẩn được đào tạo của giáo viên mầm non, tiểu học, trung học cơ sở, Bộ trưởng Bộ Giáo dục và Đào tạo xem xét, quyết định và thông báo cho cơ sở đào tạo trên cơ sở nhu cầu của các địa phương và năng lực đào tạo của các cơ sở đào tạo.

Điều 10. Xác định chỉ tiêu tuyển sinh đại học đào tạo từ xa

1. Cơ sở đào tạo bảo đảm đáp ứng đầy đủ các yêu cầu tối thiểu để thực hiện chương trình đào tạo từ xa, đồng thời đáp ứng đầy đủ các điều kiện ứng dụng công nghệ thông tin trong quản lý, tổ chức đào tạo qua mạng máy tính, bao gồm: hệ thống học liệu điện tử kết hợp với học liệu chính, bài giảng trực tuyến và hệ thống quản lý học tập (LMS) hỗ trợ cho người học và các quy định khác có liên quan theo quy định hiện hành của Bộ Giáo dục và Đào tạo được xác định chỉ tiêu tuyển sinh đào tạo từ xa đối với các ngành đã được phép đào tạo trình độ đại học theo hình thức chính quy theo quy định tại các khoản 2, 3, 4 Điều này và các quy định hiện hành của pháp luật có liên quan, đồng thời chịu trách nhiệm giải trình về việc quyết định đào tạo từ xa với từng ngành đào tạo.

2. Chỉ tiêu tuyển sinh đào tạo từ xa trình độ đại học hàng năm của cơ sở đào tạo được xác định theo từng lĩnh vực đào tạo từ xa và tính tối đa bằng tổng quy mô đào tạo từ xa xác định trên cơ sở năng lực đào tạo của từng lĩnh vực đào tạo, đáp ứng đồng thời các tiêu chí theo quy định tại khoản 3 và khoản 4 Điều này, trừ đi tổng quy mô sinh viên đào tạo từ xa trình độ đại học thực tế đang đào tạo tại cơ sở đào tạo và các trạm đào tạo từ xa của lĩnh vực đào tạo tương ứng, cộng thêm số sinh viên đào tạo từ xa trình độ đại học dự kiến sẽ tốt nghiệp trong năm tuyển sinh của lĩnh vực đào tạo đó.

3. Tiêu chí số sinh viên đào tạo từ xa trình độ đại học trên một giảng viên quy đổi theo lĩnh vực đào tạo:

a) Giảng viên trong xác định chỉ tiêu đào tạo từ xa là giảng viên toàn thời gian và giảng viên thỉnh giảng tham gia giảng dạy, hướng dẫn cho đào tạo từ xa của cơ sở đào tạo với thời gian trung bình từ 08 giờ làm việc trở lên trong một tuần; những người tham gia với thời gian trung bình ít hơn 08 giờ làm việc trong một tuần được tính quy đổi theo tỉ lệ tương ứng với thời gian tham gia;

b) Hệ số quy đổi theo trình độ và chức danh cho giảng viên tham gia đào tạo từ xa, bao gồm cả giảng viên thỉnh giảng, được áp dụng như hệ số quy đổi giảng viên toàn thời gian để xác định chỉ tiêu tuyển sinh theo quy định tại Điều 5 Thông tư này;

c) Số sinh viên đào tạo từ xa trên một giảng viên tham gia đào tạo từ xa quy đổi theo lĩnh vực đào tạo được xác định tối đa như hình thức chính quy theo quy định tại điểm b khoản 1 Điều 6 Thông tư này.

4. Tiêu chí số sinh viên đào tạo từ xa trình độ đại học trên một cán bộ quản lý, nhân viên hỗ trợ chuyên trách về đào tạo từ xa (tính cho cả cơ sở đào tạo):

a) Cán bộ quản lý, nhân viên hỗ trợ chuyên trách về đào tạo từ xa là các cán bộ, nhân viên đã ký hợp đồng lao động xác định thời hạn từ đủ 12 tháng trở lên trong năm tuyển sinh và làm việc toàn thời gian (theo quy định tại Bộ Luật lao động hiện hành về thời gian làm việc, thời gian nghỉ ngơi đối với người lao động) cho công tác quản lý, hỗ trợ đào tạo từ xa của cơ sở đào tạo và các trạm đào tạo từ xa của cơ sở đào tạo; những người làm việc không toàn thời gian cho đào tạo từ xa được tính quy đổi theo tỉ lệ tương ứng với thời gian kiêm nhiệm tham gia quản lý, hỗ trợ đào tạo từ xa;

b) Hệ số quy đổi theo trình độ và chức danh cho cán bộ quản lý, nhân viên hỗ trợ chuyên trách về đào tạo từ xa được áp dụng như hệ số quy đổi giảng viên toàn thời gian để xác định chỉ tiêu tuyển sinh theo quy định tại Điều 5 Thông tư này;

c) Số sinh viên đại học đào tạo từ xa trên một cán bộ quản lý, nhân viên hỗ trợ chuyên trách đào tạo từ xa quy đổi không vượt quá 200 sinh viên.

Điều 11. Xác định chỉ tiêu tuyển sinh thạc sĩ, tiến sĩ

1. Chỉ tiêu tuyển sinh thạc sĩ tối đa của cơ sở đào tạo được xác định theo từng ngành đào tạo, được tính bằng quy mô đào tạo thạc sĩ tối đa theo năng lực đào tạo của ngành đào tạo đó, đáp ứng đồng thời các tiêu chí quy định tại khoản 03 Điều này và bảo đảm tỉ lệ số học viên trên một người hướng dẫn luận văn có đầy đủ tiêu chuẩn của người hướng dẫn luận văn theo quy định tại quy chế tuyển sinh và đào tạo trình độ thạc sĩ hiện hành của Bộ Giáo dục và Đào tạo.

2. Chỉ tiêu tuyển sinh tiến sĩ tối đa của cơ sở đào tạo được xác định theo từng ngành đào tạo, được tính bằng quy mô đào tạo tiến sĩ tối đa theo năng lực đào tạo của ngành đào tạo đó, đáp ứng đồng thời các tiêu chí quy định tại khoản 03 Điều này trừ đi quy mô đào tạo tiến sĩ hiện tại cộng thêm với số nghiên cứu sinh dự kiến sẽ tốt nghiệp trong năm tuyển sinh của ngành đào tạo đó.

3. Tiêu chí xác định chỉ tiêu tuyển sinh thạc sĩ, tiến sĩ

a) Tiêu chí số nghiên cứu sinh, học viên cao học tối đa trên 01 giảng viên toàn thời gian và giảng viên thỉnh giảng theo trình độ, chức danh và phù hợp về chuyên môn để tính chỉ tiêu tuyển sinh của cơ sở đào tạo được xác định tối đa theo quy định tại Bảng 3 (đối với giảng viên toàn thời gian), Bảng 4 (đối với giảng viên thỉnh giảng), Phụ lục 1 ban hành kèm theo Thông tư này;

b) Tiêu chí về cơ sở vật chất thiết bị: Cơ sở đào tạo phải bảo đảm có đủ cơ sở vật chất, phòng thí nghiệm, trang thiết bị thực hành, thư viện, giảng đường, phòng làm việc của giảng viên, người hướng dẫn, nghiên cứu sinh và học viên cao học phù hợp với yêu cầu của ngành, chuyên ngành và loại chương trình đào tạo;

c) Tiêu chí nhu cầu lao động của thị trường, yêu cầu phát triển kinh tế - xã hội: Cơ sở đào tạo xác định chỉ tiêu tuyển sinh phải căn cứ nhu cầu của thị trường lao động và yêu cầu phát triển kinh tế - xã hội của quốc gia, địa phương và của ngành.

Điều 12. Xác định và công bố chỉ tiêu tuyển sinh của cơ sở đào tạo

1. Cơ sở đào tạo xác định và công bố chỉ tiêu tuyển sinh của cơ sở đào tạo theo các quy định tại Thông tư này và các quy định hiện của pháp luật có liên quan, trong đó hội đồng trường chịu trách nhiệm giải trình về định hướng phương thức tuyển sinh và việc phát triển tăng hoặc giảm quy mô đào tạo theo nhóm ngành và lĩnh vực đào tạo, phù hợp với định hướng phát triển của cơ sở đào tạo, đáp ứng nhu cầu xã hội, bảo đảm phù hợp với nhu cầu nguồn nhân lực của các Bộ, ngành, địa phương và cả nước, bảo đảm hội nhập quốc tế; giám đốc, viện trưởng, hiệu trưởng cơ sở đào tạo quyết định việc xác định chỉ tiêu và chịu trách nhiệm giải trình về số lượng chỉ tiêu cụ thể của từng ngành, nhóm ngành và lĩnh vực đào tạo, bảo đảm phù hợp với năng lực đào tạo của cơ sở đào tạo theo quy định tại Thông này và các quy định khác có liên quan của pháp luật.

2. Cơ sở đào tạo cập nhật đầy đủ các thông tin, số liệu chi tiết về các tiêu chí xác định chỉ tiêu tuyển sinh, chỉ tiêu tuyển sinh đã được xác định, kết quả thực hiện chỉ tiêu tuyển sinh vào phần mềm quản lý của Bộ Giáo dục và Đào tạo.

3. Cơ sở đào tạo công bố công khai, minh bạch các điều kiện bảo đảm chất lượng đào tạo, cơ sở dữ liệu và tiêu chí xác định chỉ tiêu tuyển sinh, chỉ tiêu tuyển sinh, đề án và kế hoạch tuyển sinh, tỉ lệ sinh viên có việc làm trong khoảng thời gian 12 tháng kể từ khi được công nhận tốt nghiệp và các thông tin cần thiết khác của cơ sở đào tạo trên trang thông tin điện tử của cơ sở đào tạo và cập nhật cơ sở dữ liệu vào phần mềm quản lý của Bộ Giáo dục và Đào tạo. Đối với các ngành đào tạo thuộc lĩnh vực An ninh, quốc phòng, cơ sở đào tạo công bố công khai, minh bạch các điều kiện bảo đảm chất lượng đào tạo và các thông tin cần thiết khác theo quy định của cơ quan quản lý trực tiếp cơ sở đào tạo và cập nhật cơ sở dữ liệu vào phần mềm quản lý của Bộ Giáo dục và Đào tạo.

4. Cơ sở đào tạo xây dựng báo cáo xác định chỉ tiêu tuyển sinh hằng năm theo các mẫu báo cáo (quy định tại Phụ lục 4 ban hành kèm theo Thông tư này) và thực hiện việc báo cáo theo công văn hướng dẫn của Bộ Giáo dục và Đào tạo.

Điều 13. Trách nhiệm của cơ sở đào tạo

1. Thực hiện đúng quy trình xác định và công bố chỉ tiêu.

2. Bảo đảm tính trung thực, chính xác của số liệu báo cáo và căn cứ xác định chỉ tiêu tuyển sinh, kết quả thực hiện chỉ tiêu tuyển sinh hằng năm và chịu trách nhiệm giải trình trước cơ quan quản lý nhà nước và xã hội.

3. Thực hiện chỉ tiêu tuyển sinh theo từng lĩnh vực đào tạo đối với trình độ đại học (trừ các ngành thuộc nhóm ngành Đào tạo giáo viên trình độ đại học và ngành Giáo dục Mầm non trình độ cao đẳng tuyển sinh theo từng ngành), theo từng ngành đối với trình độ thạc sĩ, tiến sĩ đảm bảo phù hợp với chỉ tiêu đã được cơ sở đào tạo xác định và công bố công khai, đồng thời nằm trong năng lực đào tạo theo quy định của Thông tư này.

4. Cung cấp đầy đủ thông tin về xác định, thực hiện chỉ tiêu tuyển sinh khi có yêu cầu xác thực thông tin, thanh tra, kiểm tra của Bộ Giáo dục và Đào tạo và của cơ quan có thẩm quyền.

5. Các cơ sở đào tạo được triển khai đào tạo các ngành đặc thù có nhu cầu cao về nhân lực trình độ đại học đáp ứng yêu cầu phát triển kinh tế - xã hội của đất nước phải xây dựng và đăng tải công bố công khai thông tin triển khai trong Đề án tuyển sinh của cơ sở đào tạo và các minh chứng bảo đảm chất lượng trên trang thông tin điện tử của trường theo đúng quy định của Quy chế tuyển sinh hiện hành.

6. Giám đốc, viện trưởng, hiệu trưởng cơ sở đào tạo chịu trách nhiệm giải trình trước Bộ Giáo dục và Đào tạo và xã hội về việc xác định và thực hiện chỉ tiêu tuyển sinh của cơ sở đào tạo theo đúng quy định hiện hành.

Điều 14. Thanh tra, kiểm tra và xử lý vi phạm

1. Bộ Giáo dục và Đào tạo tổ chức thanh tra, kiểm tra việc xác định chỉ tiêu tuyển sinh của các cơ sở đào tạo theo quy định của pháp luật.

2. Cơ sở giáo dục vi phạm quy định về việc xác định chỉ tiêu tuyển sinh sẽ bị xử lý theo quy định của pháp luật. Giám đốc, viện trưởng, hiệu trưởng cơ sở đào tạo có xảy ra sai phạm về xác định chỉ tiêu tuyển sinh và cá nhân thực hiện hành vi vi phạm quy định về xác định chỉ tiêu tuyển sinh sẽ bị xử lý theo quy định của pháp luật.

Điều 15. Hiệu lực thi hành

1. Thông tư này có hiệu lực thi hành từ ngày 04 tháng 3 năm 2022 và áp dụng đối với các khóa tuyển sinh trình độ cao đẳng ngành Giáo dục Mầm non; trình độ đại học, thạc sĩ, tiến sĩ từ năm 2022 trở đi.

2. Thông tư này thay thế Thông tư số 06/2018/TT-BGDĐT ngày 28 tháng 02 năm 2018 của Bộ trưởng Bộ Giáo dục và Đào tạo ban hành Quy định về việc xác định chỉ tiêu tuyển sinh trình độ trung cấp, cao đẳng các ngành đào tạo giáo viên; trình độ đại học, thạc sĩ, tiến sĩ, được sửa đổi, bổ sung tại Thông tư số 01/2019/TT-BGDĐT ngày 25 tháng 02 năm 2019 và Thông tư số 07/2020/TT-BGDĐT ngày 20 tháng 3 năm 2020.

3. Chánh Văn phòng, Vụ trưởng Vụ Giáo dục Đại học, thủ trưởng các đơn vị có liên quan thuộc Bộ Giáo dục và Đào tạo; bộ, ngành có liên quan; giám đốc các đại học, học viện; hiệu trưởng các trường đại học; hiệu trưởng các trường cao đẳng đào tạo trình độ cao đẳng ngành Giáo dục Mầm non; viện trưởng viện được phép đào tạo trình độ tiến sĩ; thủ trưởng trường của cơ quan nhà nước, tổ chức chính trị, tổ chức chính trị - xã hội, lực lượng vũ trang nhân dân được phép đào tạo các trình độ giáo dục đại học chịu trách nhiệm thi hành Thông tư này.

CIRCULAR

Prescribing the calculation of enrollment quotas for bachelor’s, master’s, doctoral degree students and Early Childhood Education associate degree students

Pursuant to the Law on Education dated June 14, 2019;

Pursuant to the Law on Higher Education dated June 18, 2012 and the Law dated November 19, 2018 amending and supplementing a number of articles of the Law on Higher Education;

Pursuant to Decree No. 69/2017/ND-CP dated May 25, 2017 of the Government defining the functions, tasks, powers and organizational structure of the Ministry of Education and Training;

Pursuant to Decree No. 99/2019/ND-CP dated December 30, 2019 of the Government detailing and guiding the implementation of a number of articles of the Law Amending and Supplementing a Number of Articles of the Law on Higher Education;

At the proposal of the Director of the Higher Education Department;

The Minister of Education and Training hereby promulgates the Circular prescribing the calculation of enrollment quotas for bachelor’s, master’s, doctoral degree students and Early Childhood Education associate degree students.

Article 1. Scope of regulation and subjects of application

1. This Circular prescribes the calculation of enrollment quotas for bachelor’s, master’s, doctoral degree students and Early Childhood Education associate degree students.

2. This Circular applies to higher education institutions; other educational institutions that are permitted to offer bachelor’s, master’s and doctoral degree courses; academies and institutes established by the Prime Minister under the provisions of the Law on Science and Technology and permitted to offer doctoral degree courses; junior colleges that are permitted to offer Early Childhood Education associate degree course (hereinafter referred to as educational institutions); relevant organizations and individuals.

Article 2. Objectives

1. Educational institutions shall calculate and fulfill their enrollment quotas depending on the requirements for education quality assurance and socio-economic development while exercising the autonomy and taking the accountability for the calculation and fulfillment of the enrollment quotas.

2. Publicly and transparently satisfying the education quality assurance requirements as well as the grounds for calculating enrollment quotas and the percentage of students who have jobs after graduation from the educational institutions for the State management agencies to conduct inspections and examinations, for the society to supervise, and for the learners to choose suitable educational institutions to enroll in.

Article 3. Interpretation of terms

The terms used in this Circular are construed as follows:

1. List of disciplines means the level-4 classification of education at higher education levels promulgated by the Ministry of Education and Training.

2. Discipline means a combination of professional knowledge and skills within the scope of vocational or science and technology activities; which are listed and categorized in the list of disciplines.

3. Group of disciplines means a collection of some disciplines sharing common professional characteristics within the scope of vocational or science and technology activities, which are listed and categorized in the level-3 classification of education in the List of education classifications of the national education system prescribed by the Prime Minister.

4. Field of study means a collection of discipline groups sharing common characteristics in terms of professional knowledge and skills within the scope of vocational or science and technology activities, which are listed and categorized in the level-2 classification of education in the List of education classifications of the national education system.

5. Full-time lecturers in calculating enrollment quotas are permanent lecturers and lecturers who sign labor contracts with a definite term of full 12 months or more working full-time at an educational institution (hereinafter referred to as full-time lecturers) as follows:

a) Full-time lecturers identified in accordance with the provisions of Point e, Clause 1, Article 10 of the Government’s Decree No. 99/2019/ND-CP dated December 30, 2019 detailing and guiding the implementation of a number of articles of the Law Amending and Supplementing a Number of Articles of the Law on Higher Education;

b) Lecturers who sign labor contracts with a definite term of full 12 months or more working full-time at an educational institution in accordance with the current regulations of the Ministry of Education and Training on working regimes of university lecturers in the year the enrollment quotas are calculated (including instructors for practice and experiments), and at the same time do not sign labor contracts with a definite term of 3 months or more with another employer.

6. Visiting lecturer in calculating enrollment quotas means a person who is not specified in Clause 5 of this Article and directly participates in teaching and guiding learners of an educational institution under a visiting contract with such educational institution in accordance with the law provisions in the year the enrollment quotas are calculated.

7. Students, trainees, doctoral students expected to graduate in calculating enrollment quotas are those expected to graduate in the year the enrollment quotas are calculated, the number of whom is calculated by dividing the training scale of each discipline/field of study/form of training by the number of academic years for such discipline/field of study/form of training.

Article 4. Principles for calculating enrollment quotas

1. An educational institution shall calculate the enrollment quotas for Early Childhood Education associate degree students and the enrollment quotas for bachelor’s, master’s and doctoral degree students in accordance with the provisions of this Circular and current law provisions; publicly announce, take accountability to the laws and be accountable for the calculation of the enrollment quotas, the education quality assurance requirements and the educational institution’s commitments to output standards meeting the social demand, and at the same time be subject to the supervision of management agencies and the society.

2. Enrollment quotas shall be calculated annually and independently for each education level. Based on the quotas calculated for each level, an educational institution shall publicly announce the enrollment quotas calculated for each discipline/group of disciplines in the enrollment scheme and plan and be accountable to the society and the agency directly managing it.

3. Enrollment quotas for bachelor’s degree students shall be calculated for each discipline or group of disciplines and ensure that the training scale does not exceed the training capacity of the respective field of study. Enrollment quotas for master’s, doctoral degree students and Early Childhood Education associate degree students as well as enrollment quotas for bachelor’s degree students in teaching disciplines shall be calculated for each discipline, given that the training scale does not exceed the training capacity of such discipline.

4. Enrollment quotas shall be calculated according to the educational institution’s training capacity, the demand for workers, and the percentage of students who have jobs within 12 months after graduation (as for full-time associate or bachelor’s degree students), the admissions of the year preceding the enrollment year the quotas are calculated, and the enrollment organization of the educational institution, specifically as follows:

a) The enrollment quotas of the educational institution shall be calculated in line with the training capacity of the educational institution as prescribed in Articles 7 to 12 of this Circular;

b) The enrollment quotas of the educational institution shall not be increased in the following cases:

- The overall enrollment quotas of the educational institution for each education level and each field of study (as for bachelor’s degree students) or for each discipline (as for master’s and doctoral degree students) shall not be increased compared to the enrollment year preceding the year of quota calculation and enrollment of the educational institution, if such educational institution meets the conditions in terms of time to conduct the educational institution accreditation but has not yet been recognized as meeting the quality accreditation standards prescribed by the current law provisions;

- The enrollment quotas of a field of study shall not be increased compared to that of such field in the enrollment year preceding the year of quota calculation and enrollment, if the percentage of bachelor’s degree students in such field who have jobs within 12 months after the graduation is less than 80% or the enrollment rate of such field in the preceding enrollment year is less than 80% (applicable to the calculation of enrollment quotas for bachelor’s degree students, unless the training program of such bachelor’s degree discipline is recognized as meeting the quality accreditation standards prescribed by the law provisions).

5. An educational institution that violates the regulations on enrollment subjects, requirements and quotas as prescribed at Point c, Clause 1, Article 34 of the Law on Higher Education (amended and supplemented in 2018) shall not be permitted to self-calculate the enrollment quotas within 05 years from the date the competent state agencies make conclusions on the violations committed by such educational institution. In this case, the Ministry of Education and Training shall calculate and notify the enrollment quotas to the educational institution as follows:

a) The educational institution shall register its enrollment quotas which must fully comply with the principles of calculating enrollment quotas as prescribed in Clauses 1, 2, 3 and 4 of this Article, then deduct the number of enrollment quotas related to the violations against regulations on enrollment subjects, requirements and quotas it has committed;

b) The Ministry of Education and Training shall calculate and announce enrollment quotas for such educational institution in accordance with Clauses 1, 2, 3, 4 and Point a, Clause 5 of this Article.

6. For Early Childhood Education associate degree disciplines or bachelor’s degree disciplines which are newly opened in the respective enrollment year, the enrollment quotas shall be calculated in line with the training capacity of the respective field of study and not exceed 30% of the training capacity of the disciplines as prescribed.

7. For the disciplines in the group of teacher training disciplines, the Ministry of Education and Training shall calculate and announce the enrollment quotas for each full-time associate degree or bachelor’s degree discipline depending on the training capacity of the educational institution as well as the demand of the locality and the whole country. The educational institution shall autonomously calculate the enrollment quotas for part-time associate and bachelor’s degree students and the enrollment quotas for master’s and doctoral degree students in accordance with this Circular and relevant law provisions.

8. For disciplines in the field of security and national defense, the agencies directly managing the educational institutions shall calculate the enrollment quotas at all levels and of all forms of training on the basis of the educational institutions’ training capacity and the demand for employees in accordance with the provisions of this Circular, the regulations of the agencies directly managing the educational institutions and other relevant law provisions, then notify the quotas to such educational institutions.

9. The percentage of students who have jobs after graduation with associate or bachelor’s degrees as prescribed in Clause 4 of this Article shall be, as for each discipline, surveyed in the year preceding the enrollment year, the surveying subjects of which are students graduated in two year before the respective enrollment year, and equal to the ratio of full-time students who have jobs within 12 months after their graduation, recognized under a decision of the educational institution, to the total full-time students of the respective discipline and education level who graduate in that year.

Article 5. Regulations on lecturers in calculating enrollment quotas

1. Each lecturer of the educational institution shall be categorized into a bachelor’s degree field of study that he/she is mainly teaching (other than lecturers teaching disciplines in the group of teacher training disciplines and lecturers teaching Early Childhood Education associate degree students, each of whom shall be categorized to the discipline he/she is mainly teaching); be categorized into a master’s or doctoral degree discipline that he/she is mainly teaching in order to calculate enrollment quotas. The categorization of lecturers into a field of study/discipline shall be in line with their expertise and in proportion to the training scale of such field of study/discipline.

2. Regulations on lecturers in calculating enrollment quotas for bachelor’s and associate degree students:

a) The total number of converted lecturers for each field of study (other than lecturers teaching bachelor’s degree disciplines in the group of teacher training disciplines and lecturers teaching Early Childhood Education associate degree students, who shall be converted for each discipline they are categorized into), used to calculate the enrollment quotas of an educational institution, covers the number of converted full-time lecturers and the number of respectively converted visiting lecturers of such field of study/discipline;

b) The number of converted visiting lecturers used to calculate the enrollment quotas shall be at most equal to 10% of the total number of converted full-time lecturers of the educational institution, as for each field of study. Particularly, for specialized disciplines in the field of Arts and specialized disciplines to meet the high demand for workers with bachelor’s degrees (specified in Appendix 2 to this Circular), the number of converted visiting lecturers used to calculate the enrollment quotas shall be at most equal to 40% of the total number of converted full-time lecturers of such educational institution, as for each field of study; visiting lecturers teaching disciplines in the group of teacher training disciplines shall not be counted to calculate enrollment quotas;

c) The coefficient used to convert the number of full-time lecturers and visiting lecturers, who have different titles and qualifications, teaching Early Childhood Education associate degree students and bachelor’s degree students at an educational institution is specified in Table 1 of Appendix 1 to this Circular; in which each lecturer shall only be converted once with the highest possible conversion coefficient;

d) As for specialized disciplines to meet the high demand for workers with bachelor’s degrees serving the country’s socio-economic development, including disciplines in the fields of computing and information technology; information, tourism, hospitality, sports and personal services (specified in Appendix 2 to this Circular), and disciplines included in the schemes approved by the Prime Minister (which shall be announced by the Ministry of Education and Training in each period as well as adjusted and supplemented on the basis of the demand for workers serving the country’s socio-economic development under the guidelines and orientations of the State), visiting lecturers also mean experts, technicians, and managers who are workers with bachelor’s degrees in the same discipline or group of disciplines as the one they are teaching and have at least 5 years of professional experience at enterprises or professional associations related to the discipline and field of study in which they are assistant lecturers, and the number of them shall be converted with the coefficient as specified at Point c of this Clause to calculate the enrollment quotas.

3. Regulations on lecturers in calculating enrollment quotas for master’s and doctoral degree students:

a) The total number of lecturers of each discipline, used to calculate the enrollment quotas of an educational institution, covers full-time lecturers and visiting lecturers of such educational institution with the qualifications/titles satisfying the requirements for lecturers who teach master’s and doctoral degree students and the expertise suitable to the respective discipline;

b) The number of visiting lecturers used to calculate the enrollment quotas shall be at most equal to 10% of the total full-time lecturers of the educational institution, as for each discipline. As for specialized disciplines in the field of Arts, the number of visiting lecturers used to calculate the enrollment quotas shall be at most equal to 40% of the total full-time lecturers of the educational institution, as for each discipline; visiting lecturers teaching disciplines in the group of teacher training disciplines shall not be counted to calculate the enrollment quotas.

4. For disciplines training teachers to teach languages of Vietnam’s ethnic minority groups as well as Vietnamese language, literature and culture disciplines, foreign language, literature and culture disciplines, physical training and sports disciplines (specified in the list of disciplines), and specialized disciplines in the field of Arts, the number of lecturers used to calculate enrollment quotas shall comply with Clauses 2 and 3 of this Article and the following regulations:

a) Assistant lecturers who are recognized and granted the title of Meritorious Artist, People’s Artist, Elite Artisan, People’s Artisan, Meritorious Teacher, People’s Teacher by the Government, and concurrently hold bachelor’s degrees in the same discipline or group of disciplines as the one they are teaching shall be converted to calculate the enrollment quotas with the same coefficient as that for lecturers holding master’s degrees (as for assistant lecturers in calculating enrollment quotas for bachelor’s degree students);

b) Lecturers who are recognized and granted the title of People’s Artist, People’s Artisan, and People’s Teacher by the Government, concurrently holding master’s degrees in the same discipline or group of disciplines as the one they are teaching shall be converted to calculate the enrollment quotas with the same coefficient as that for lecturers holding doctoral degrees (in calculating enrollment quotas for bachelor’s degree students), and counted as lecturers holding doctoral degrees to calculate the enrollment quotas (in calculating the enrollment quotas for master’s and doctoral degree students);

c) Lecturers who are recognized and granted the title of People’s Artist, People’s Artisan, and People’s Teacher by the Government, concurrently holding doctoral degrees in the same discipline or group of disciplines as the one they are teaching shall be converted to calculate the enrollment quotas with the same coefficient as that for lecturers who are associate professors (in calculating enrollment quotas for bachelor’s degree students), and counted as associate professors to calculate the enrollment quotas (in calculating the enrollment quotas for master’s and doctoral degree students);

d) Lecturers who are recognized and granted the title of People’s Artist, People’s Artisan, and People’s Teacher by the Government, concurrently holding doctoral degrees and being associate professors in the same discipline or group of disciplines as the one they are teaching shall be converted to calculate the enrollment quotas with the same coefficient as that for lecturers who are professors (in calculating enrollment quotas for bachelor’s degree students), and counted as professors to calculate the enrollment quotas (in calculating the enrollment quotas for master’s and doctoral degree students);

5. Particularly, for Vietnam’s ethnic minority language disciplines in the group of Vietnam’s language, literature and culture disciplines, lecturers who are of ethnic minority groups or have knowledge about languages and cultures of ethnic minority groups related to the discipline they are teaching; if concurrently holding bachelor’s degree in the same discipline or group of disciplines as the one they are teaching, shall be converted to calculate the enrollment quotas with the same coefficient as that for lecturers holding master’s degrees (as for assistant lecturers in calculating enrollment quotas for bachelor’s degree students); if concurrently holding master’s degrees in the same discipline or group of disciplines as the one they are teaching, shall be converted to calculate the enrollment quotas with the same coefficient as lecturers holding doctoral degrees (in calculating enrollment quotas for bachelor’s degree students), and counted as lecturers holding doctoral degrees to calculate the enrollment quotas (in calculating the enrollment quotas for master’s and doctoral degree students); if concurrently holding doctoral degrees in the same discipline or group of disciplines as the one they are teaching shall be converted to calculate the enrollment quotas with the same coefficient as that for lecturers who are associate professors (in calculating enrollment quotas for bachelor’s degree students), and counted as associate professors to calculate the enrollment quotas (in calculating the enrollment quotas for master’s and doctoral degree students); if concurrently holding doctoral degrees and being associate professors in the same discipline or group of disciplines as the one they are teaching shall be converted to calculate the enrollment quotas with the same coefficient as that for lecturers who are professors (in calculating enrollment quotas for bachelor’s degree students), and counted as professors to calculate the enrollment quotas (in calculating the enrollment quotas for master’s and doctoral degree students);

6. Disciplines in the field of Health (as specified in the List of disciplines), the number of lecturers used to calculate the quotas shall comply with Clauses 2 and 3 of this Article and the following regulations:

a) An educational institution that organizes practice training in the field of Health shall define the instructors of public practice facilities, specified in Clause 2, Article 10 of Decree No. 111/2017/ND-CP dated January 5, 2017 on the organization of practical training in the field of health, as full-time lecturers of such educational institution if they are appointed to concurrently hold leading or managerial positions of faculties or higher-level departments at such educational institution;

b) Lecturers who are resident doctors or specialist level-1 doctors in the disciplines they are teaching shall be converted to calculate the enrollment quotas with the same coefficient as lecturers with master’s degree students (in calculating enrollment quotas for bachelor’s degree students); lecturers who are specialist level-2 doctors in the disciplines they are teaching shall be converted to calculate the enrollment quotas with the same coefficient as lecturers holding doctoral degrees (in calculating enrollment quotas for bachelor’s degree students), and counted as lecturers holding doctoral degrees to calculate the enrollment quotas (in calculating the enrollment quotas for master’s and doctoral degree students).

Article 6. Criteria for calculating enrollment quotas for full-time associate and bachelor’s degree students, and methods of calculation according to such criteria

1. The criteria of the number of full-time students per a converted lecturer of the educational institution in each field of study:

a) Full-time students in calculating enrollment quotas cover full-time bachelor’s degree students, full-time Early Childhood Education associate degree students, and full-time transfer students (including students transferred from professional secondary degrees or associate degrees students to full-time bachelor’s degrees; transferred from teacher training professional secondary degrees to Early Childhood Education associate degrees; graduates holding other teacher training associate degrees studying an Early Childhood Education associate degree; graduates holding bachelor’s or higher-level degrees studying another bachelor’s degree); excluding students enrolled under selection-based enrolmentt policies at such educational institution;

b) The number of full-time bachelor’s degree students per converted lecturer in each field of study shall be at most equal to the quotas in Table 2 of Appendix 1 to this Circular;

c) The number of full-time Early Childhood Education associate degree students per converted lecturer shall not exceed 25;

d) Method of calculation:

Divide the total number of full-time students in a field of study by the total number of converted lecturers of such field of study.

2. The criteria of the construction floor area directly used for educational purposes of the educational institution per full-time student, as for the work items, and requirements on the type and minimum quantity of learning materials and equipment required for training programs and scientific research:

a) The construction floor area directly used for educational purposes per full-time student shall not be less than 2.8 m2;

b) Work items of which the construction floor area directly used for educational purposes shall be calculated, and the requirements on the type and minimum quantity of learning materials/equipment of each item are specified as follows:

- Halls, lecture halls, classrooms of all kinds, multi-purpose rooms, working rooms of professors, associate professors and lecturers of the educational institution;

- Libraries, learning resource centers;

- Research centers, laboratories, practice and training facilities;

c) Method of calculation:

Divide the total construction floor area of all work items defined at Point b of this Clause by the total full-time students of the educational institution.

3. For disciplines taught mainly online on a trial basis and applied modern scientific and technological achievements under the scheme of the educational institution in order to meet the demand for workers with bachelor’s degrees serving the socio-economic development of the locality/sector/country approved by the Ministry of Education and Training in each period, the criteria for calculating the enrollment quotas for full-time bachelor’s degree students shall comply with Clauses 1 and 2 of this Article and be considered and decided by the Minister of Education and Training.

4. The criteria of the labor demand of the market and the requirements for socio-economic development: The educational institution shall calculate the enrollment quotas depending on the labor demand of the market and the requirements of socio-economic development of the country, respective locality and sector.

Article 7. Calculation of enrollment quotas for full-time associate and bachelor’s degree students

1. The annual enrollment quotas for Early Childhood Education associate degree students and full-time bachelor’s degree students shall be at most equal to the total scale of full-time training calculated according to the training capacity of each field of study (of each discipline, for those in the group of teacher training disciplines), which shall satisfy all the criteria specified in Article 6 of this Circular, minus the total number of full-time students who are currently learning at such educational institution and plus the number of students expected to graduate in the enrollment year, following the general principles prescribed in Article 4 of this Circular.

2. The enrollment quotas for full-time students transferred from other degrees to bachelor’s degrees shall be included in the overall enrollment quotas for all full-time students, of which the percentage of students transferred from professional secondary or associate degrees to bachelor’s degrees shall be calculated according to the current regulations of the Government and the Prime Minister. The enrollment quotas for full-time Early Childhood Education associate degree students shall be included in the overall enrollment quotas for all full-time associate degree students of the educational institution.

3. For the enrollment quotas of full-time transfer students in accordance with the Decree No. 71/2020/ND-CP dated March 30, 2020 of the Government prescribing the roadmap for raising the education attainments of preschool, primary school and lower secondary school teachers, the Minister of Education and Training shall consider, decide and inform the educational institutions depending on the demand of the respective localities and the training capacity of the educational institutions.

Article 8. Calculation of enrollment quotas for full-time associate and bachelor’s degree students in teacher training disciplines

1. An educational institution that is permitted to teach teacher training disciplines shall calculate the enrollment quotas for Early Childhood Education associate degree students and full-time bachelor’s degree students in teacher training disciplines in accordance with this Circular and the current law provisions, then report to the Ministry of Education and Training in order to register the enrollment quotas for teacher training disciplines of such educational institution.

2. The Ministry of Education and Training shall calculate and announce the enrollment quotas for Early Childhood Education associate degree students and the enrollment quotas for full-time bachelor’s degree students in each teacher training discipline for every educational institution depending on the training capacity of such educational institution, the demand of the respective locality and the country as well as in accordance with the provisions of this Circular and relevant current law provisions.

Article 9. Calculation of enrollment quotas for part-time associate and bachelor’s degree students

1. The enrollment quotas for part-time Early Childhood Education associate degree students (including students who have graduated from upper secondary schools or those who have obtained associate degrees, and students transferred to associate degrees after graduating from professional secondary schools) shall not exceed 50% of the overall enrollment quotas for full-time associate degree students.

2. The enrollment quotas for part-time bachelor’s degree students (including students who have graduated from upper secondary schools or those who have obtained bachelor’s degrees, and students transferred from professional secondary or associate degrees to bachelor’s degrees) shall not exceed 30% of the enrollment quotas for full-time bachelor’s degree students in each field of study of the educational institution. For the field of Arts and the group of teacher training disciplines, the educational institution’s enrollment quotas for part-time bachelor’s degree students shall not exceed 50% of the enrollment quotas for full-time bachelor’s degree students in each field of study (in each discipline, as for the group of teacher training disciplines) of the educational institution.

3. The enrollment quotas for part-time transfer bachelor’s degree students shall be included in the overall enrollment quotas for part-time bachelor’s degree students of the educational institution, in which the percentage of the enrollment quotas for part-time students transferred from professional secondary or associate degrees to bachelor’s degrees shall be calculated according to the current regulations of the Government and the Prime Minister. The enrollment quotas for part-time Early Childhood Education associate degree students transferred from other lower degrees shall be included in the overall enrollment quotas for part-time associate degree students of the educational institution.

4. For the enrollment quotas of part-time transfer students in accordance with the Decree No. 71/2020/ND-CP dated March 30, 2020 of the Government prescribing the roadmap for raising the education attainments of preschool, primary school and lower secondary school teachers, the Minister of Education and Training shall consider, decide and inform the educational institutions depending on the demand of the respective localities and the training capacity of the educational institutions.

Article 10. Calculation of the enrollment quotas for bachelor’s degree distance learners

1. An educational institution that fully meets the minimum requirements for conducting a distance learning program, and at the same time fully meets the requirements for information technology application in management and organization of teaching via computer networks, including a system of electronic learning materials combined with traditional learning materials, online lectures and a learning management system (LMS) to support learners, and complies with other relevant regulations of the Ministry of Education and Training, shall calculate the enrollment quotas for distance learners in full-time bachelor’s degree disciplines they are allowed to teach as prescribed in Clauses 2, 3, and 4 of this Article and the current relevant law provisions, and at the same time be responsible for the decision on conducting distance learning of each discipline.

2. The annual enrollment quotas for bachelor’s degree distance learners shall be calculated for each distance learning field of study and be at most equal to the total scale of distance learning calculated according to the training capacity of each field of study, which shall satisfy all the criteria specified in Clauses 3 and 4 of this Article, minus the total number of bachelor’s degree distance learners who are actually learning the respective field of study at the educational institution and its distance learning stations, plus the number of bachelor’s degree distance learners of such field of study expected to graduate in the enrollment year.

3. The criteria of the number of bachelor’s degree distance learners per lecturer for each field of study:

a) Lecturers in calculating distance learning enrollment quotas are full-time lecturers and visiting lecturers who are teaching and instructing distance learners of the educational institution in an average time of at least 08 working hours per week; lecturers who have the average teaching time of less than 08 working hours per week shall be counted in proportion to their actual teaching time;

b) The coefficient used to convert lecturers teaching distance learners, including visiting lecturers, based on their qualifications and titles in order to calculate the enrollment quotas shall be applied similarly to the coefficient used to convert full-time lecturers as prescribed in Article 5 of this Circular;

c) The number of distance learners per converted distance learning lecturer of each field of study shall be at most equal to that of full-time students as prescribed at Point b, Clause 1, Article 6 of this Circular.

4. The criteria of the number of bachelor’s degree distance learners per full-time distance learning manager or support staff (of the entire educational institution):

a) Full-time distance learning managers and support staff are cadres or employees who sign labor contracts with a definite term of 12 months or more in the enrollment year and work full-time (in accordance with the provisions of the current Labor Code on working time and rest time for workers) responsible for the management and support of distance learning of the educational institution and distance learning stations; those who work part-time responsible for distance learning shall be counted in proportion to the actual time they concurrently manage and support distance learning;

b) The coefficient used to convert managers and support staff specialized in distance learning based on their qualifications and titles in order to calculate the enrollment quotas shall be applied similarly to the coefficient used to convert full-time lecturers as prescribed in Article 5 of this Circular;

c) The number of distance learners per one converted full-time distance learning manager or support staff shall not exceed 200.

Article 11. Calculation of enrollment quotas for master’s and doctoral degree students

1. The maximum enrollment quotas for master’s degree students of an educational institution shall be calculated for each discipline, equal to the maximum scale of master’s degree training calculated according to the training capacity of such discipline, satisfy all the criteria specified in Clause 03 of this Article, and ensure the number of students per one thesis supervisor who fully meets the requirements for a thesis supervisor prescribed in the current regulations on enrollment and training of master’s degree students issued by the Ministry of Education and Training.

2. The maximum enrollment quotas for doctoral degree students of an educational institution shall be calculated for each discipline, equal to the maximum scale of doctoral degree training calculated according to the training capacity of such discipline, which shall satisfy all the criteria specified in Clause 03 of this Article, minus the current doctoral degree training scale, plus the number of doctoral degree students of such discipline expected to graduate in the respective enrollment year.

3. The criteria for calculating enrollment quotas for master’s and doctoral degree students

a) The maximum number of graduate or doctoral students per one full-time lecturer or visiting lecturer based on his/her qualifications, titles and professional relevance, used to calculate the enrollment quotas of the educational institution, shall be at most equal to the limit specified in Table 3 (for full-time lecturers) or Table 4 (for visiting lecturers) or Appendix 1 to this Circular;

b) The criteria of facilities and equipment: The educational institution shall have adequate facilities, laboratories, practice equipment, libraries, lecture halls, and working rooms of lecturers and supervisors, graduate and doctoral students meeting the requirements of the discipline, major and type of the training program;

c) The criteria of the labor demand of the market and requirements for socio-economic development: The educational institution shall calculate the enrollment quotas depending on the labor demand of the market and the requirements of socio-economic development of the country, respective locality and sector.

Article 12. Calculation and announcement of enrollment quotas of educational institutions

1. An educational institution shall calculate and announce its enrollment quotas in accordance with the provisions of this Circular and the current relevant law provisions, in which the school council is accountable for the orientation of enrollment methods and the increase or decrease of the training scale of each group of disciplines and field of study in line with the development orientation of such educational institution, meeting the demand for workers of the society as well as ministries, sectors, localities and the whole country, ensuring the international integration. The director or rector of the educational institution shall decide on the calculation of its enrollment quotas and take the accountability for the specific enrollment quota of each discipline, group of disciplines and field of study, given that it is suitable to the training capacity of the educational institution as prescribed in this Circular and other relevant provisions of law.

2. The educational institutions shall fully update information and detailed data on the criteria for calculating enrollment quotas, the enrollment quotas that have been calculated, and the results of fulfilling enrollment quotas into the management software of the Ministry of Education and Training.

3. The educational institutions shall publicly and transparently announce the education quality assurance requirements, disclose the database and the criteria for calculating enrollment quotas, the enrollment quotas that have been calculated, the enrollment schemes and plans, the percentage of students who have jobs within 12 months after graduation, and other necessary information of the educational institution on their websites, and update the data into the management software of the Ministry of Education and Training. For disciplines in the field of security and national defense, the educational institutions shall publicly and transparently announce the education quality assurance requirements and other necessary information as prescribed by the agencies directly managing them and update the data into the management software of the Ministry of Education and Training.

4. The educational institutions shall prepare annual reports on the calculation of enrollment quotas using the report sample (specified in Appendix 4 to this Circular) and submit the reports in accordance with the guiding dispatches of the Ministry of Education and Training.

Article 13. The educational institutions shall:

1. Strictly follow the procedures of calculating and announcing enrollment quotas.

2. Ensure the truthfulness and accuracy of the reported data and the grounds for calculating the enrollment quotas, the results of fulfilling the annual enrollment quotas and take accountability to the State management agencies and the society.

3. Fulfill the enrollment quotas for bachelor’s degree students in each field of study (other than enrollment quotas for bachelor’s degree students in the group of teacher training disciplines and Early Childhood Education associate degree students, which shall be fulfilled in each discipline) and the enrollment quotas for the master’s and doctoral degree students in each discipline, which shall satisfy the criteria determined and publicly announced by the educational institution, and in line with the training capacity as prescribed in this Circular.

4. Provide sufficient information on the calculation and fulfillment of enrollment quotas upon requests for verification, inspection and examination by the Ministry of Education and Training and competent agencies.

5. Educational institutions, which are permitted to teach specialized disciplines to meet the high demand for workers with bachelor’s degrees serving the country’s socio-economic development, shall formulate and publicize information of their enrollment schemes and the quality assurance proofs on their websites in accordance with the current enrollment regulations.

6. Directors and rectors of the educational institutions shall be accountable to the Ministry of Education, Training and Social Affairs for the calculation and fulfillment of the enrollment quotas of such educational institutions in accordance with the current regulations.

Article 14. Inspection, examination and handling of violations

1. The Ministry of Education and Training shall inspect and examine the calculation of enrollment quotas of educational institutions in accordance with the law provisions.

2. Education institutions that violate regulations on the calculation of enrollment quotas shall be handled in accordance with law. The director or rector of any educational institution where wrongdoing(s) related to the calculation of enrollment quotas is committed and the person(s) who commits the violations against regulations on the calculation of enrollment quotas shall be handled in accordance with the law provisions.

Article 15. Effect

1. This Circular takes effect from March 4, 2022 and applies to Early Childhood Education associate degree courses; bachelor’s, master’s, and doctoral degree courses that enroll students from 2022 onwards.

2. This Circular replaces the Circular No. 06/2018/TT-BGDDT dated February 28, 2018 of the Minister of Education and Training providing regulations on the calculation of enrollment quotas for secondary and associate degree students in teacher training disciplines; bachelor’s, master’s, and doctoral degree students, as amended and supplemented in Circular No. 01/2019/TT-BGDDT dated February 25, 2019 and Circular No. 07/2020/TT-BGDDT dated March 20, 2020.

3. The Chief of Ministry Office, the Director of Higher Education Department, heads of relevant units under the Ministry of Education and Training; relevant ministries and sectors; directors of universities and academies; rectors of universities; rectors of junior colleges permitted to offer Early Childhood Education associate degree courses; directors of institutes permitted to offer doctoral degree courses; heads of schools run by State agencies, political organizations, socio-political organizations and people’s armed forces permitted to offer training courses at higher education levels shall be responsible for implementing this Circular.
