DECISION

ON A NUMBER OF MEASURES TO SPEED UP THE TEMPO OF CONSTRUCTION OF HOA LAC HI-TECH PARK’S INFRASTRUCTURE

THE PRIME MINISTER

Pursuant to the Law on Organization of the Government of December 25, 2001;

Pursuant to the Prime Minister’s Decision No. 198/1998/QD-TTg of October 12, 1998 on the establishment of Hoa Lac Hi-Tech Park; and approval of the general planning and the investment project, Stage 1, Phase I, Hoa Lac Hi-Tech Park;

Pursuant to the Prime Minister’s Decision No. 10/2000/QD-TTg of January 18, 2000 on the establishment of Hoa Lac Hi-Tech Park Management Board;

In order to speed up the tempo of construction of Hoa Lac Hi-Tech Park, at the proposal of the Minister of Science and Technology (Official Dispatches No. 1117/TTr-BKHCN of December 16, 2002 and No. 52/BKHCN-CNC of January 10, 2003); and the comments of the Ministry of Planning and Investment (Official Dispatch No. 8154 BKH/KHGDMT of December 23, 2002), the Ministry of Construction (Official Dispatch No. 433 BXD/KH-TK of March 29, 2002), and the General Land Administration (Official Dispatch No. 1537/TCDC-PC of November 11, 2002),

DECIDES:

Article 1.- To assign the Hoa Lac Hi-Tech Park Management Board to coordinate with the concerned agencies in organizing the performance of the following tasks according to the current regulations:

1. To make investment preparations apart from Stage 1, Phase I.

2. To select prestigious and experienced foreign consultancy organizations for signing contracts on hiring of planning and providing consultancy on the designs of particular works of Hoa Lac Hi-Tech Park.

3. To organize the implementation of infrastructure construction projects, Stage 1, Phase I, Hoa Lac Hi-Tech Park in form of turnkey contracts (Design-Supplies and Equipment Procurement-Construction Contracts) prescribed in Article 62 of the Regulation on Investment and Construction Management, issued together with the Government’s Decree No. 52/1999/ND-CP of July 8, 1999.

Article 2.- To agree with the Science and Technology Ministry’s proposal on assigning Vietnam Construction Import and Export Corporation (VINACONEX) under the Ministry of Construction to act as general contractor to implement infrastructure construction projects, Stage 1, Phase I, Hoa Lac Hi-Tech Park (mentioned in Clause 3, Article 1 of this Decision) under turnkey contracts. The Ministry of Science and Technology shall direct the Hoa Lac Hi-Tech Park Management Board in organizing the realization of this form according to the current regulations.

Article 3.- On the basis of the land use planning and plans already approved by competent authorities, to permit the Hoa Lac Hi-Tech Park Management Board to experimentally allocate or lease land to investors in the order prescribed by the current legislation. The Management Board shall have to complete the procedures according to regulations and submit them to the People’s Committee of Ha Tay province for the granting of land use right certificates to investors.

Article 4.- On the basis of estimation of annual funding for implementation of projects, proposed by the Hoa Lac Hi-Tech Park Management Board, the Ministry of Planning and Investment shall coordinate with the Ministry of Finance in taking initiative in allocating budget capital so that the Hoa Lac Hi-Tech Park Management Board can perform the assigned tasks strictly according to the tempo.

Article 5.- This Decision takes effect 15 days after its signing.

Article 6.- The Ministers of Science and Technology, Planning and Investment, Finance, Construction, Natural Resources and Environment, and Defense; the Governor of Vietnam State Bank; the president of the People’s Committee of Ha Tay province; the general director of Vietnam Construction Import and Export Corporation, and the chairman of the Hoa Lac Hi-Tech Park Management Board shall have to implement this Decision.
