VỀ VIỆC CÔNG BỐ DANH MỤC HÀNG HÓA NHẬP KHẨU PHẢI KIỂM TRA CHẤT LƯỢNG THEO QUY CHUẨN KỸ THUẬT QUỐC GIA TRƯỚC KHI THÔNG QUAN THUỘC TRÁCH NHIỆM QUẢN LÝ CỦA BỘ KHOA HỌC VÀ CÔNG NGHỆ

Căn cứ Luật Tiêu chuẩn và Quy chuẩn kỹ thuật ngày 29 tháng 6 năm 2006;

Căn cứ Luật Chất lượng sản phẩm, hàng hóa ngày 21 tháng 11 năm 2007;

Căn cứ Nghị định số 127/2007/NĐ-CP ngày 01 tháng 8 năm 2007 của Chính phủ quy định chi tiết thi hành một số điều của Luật Tiêu chuẩn và Quy chuẩn kỹ thuật;

Căn cứ Nghị định số 132/2008/NĐ-CP ngày 31 tháng 12 năm 2008 của Chính phủ quy định chi tiết thi hành một số điều của Luật Chất lượng sản phẩm, hàng hóa;

Căn cứ Nghị định số 20/2013/NĐ-CP ngày 26 tháng 02 năm 2013 của Chính phủ quy định chức năng, nhiệm vụ, quyền hạn và cơ cấu tổ chức của Bộ Khoa học và Công nghệ;

Căn cứ Nghị định số 187/2013/NĐ-CP ngày 20 tháng 11 năm 2013 của Chính phủ quy định chi tiết thi hành Luật Thương mại về hoạt động mua bán hàng hóa quốc tế và các hoạt động đại lý mua, bán, gia công và quá cảnh hàng hóa với nước ngoài;

Theo đề nghị của Tổng cục trưởng Tổng cục Tiêu chuẩn Đo lường Chất lượng,

QUYẾT ĐỊNH:

Điều 1. Công bố kèm theo Quyết định này Danh mục hàng hóa nhập khẩu phải kiểm tra chất lượng theo quy chuẩn kỹ thuật quốc gia trước khi thông quan thuộc trách nhiệm quản lý của Bộ Khoa học và Công nghệ tại Phụ lục đính kèm.

Đối với hàng hóa sản xuất trong nước, các hàng hóa thuộc Danh mục nêu tại Phụ lục kèm theo cũng phải thực hiện các biện pháp quản lý theo quy định tại quy chuẩn kỹ thuật quốc gia tương ứng và các văn bản quy phạm pháp luật hiện hành có liên quan.

Điều 2. Giao Tổng cục Tiêu chuẩn Đo lường Chất lượng chủ trì, phối hợp với các đơn vị có liên quan đề xuất Lãnh đạo Bộ Khoa học và Công nghệ công bố sửa đổi, bổ sung Danh mục hàng hóa phải kiểm tra chất lượng theo quy chuẩn kỹ thuật quốc gia trước khi thông quan thuộc trách nhiệm quản lý của Bộ Khoa học và Công nghệ phù hợp với yêu cầu quản lý.

Điều 3. Quyết định này có hiệu lực kể từ ngày ký.

Điều 4. Chánh Văn phòng Bộ Khoa học và Công nghệ, Tổng cục trưởng Tổng cục Tiêu chuẩn Đo lường Chất lượng và các tổ chức, cá nhân có liên quan chịu trách nhiệm thi hành Quyết định này./.

Decision No.1171/QD-BKHCN dated May 27, 2015 of the Ministry of Science and Technology announcement of lists of imported goods subject to quality inspection under national technical regulation before customs clearance within responsibility of the Ministry of Science and Technology

Pursuant to the Law on Technical regulations and standards dated June 29, 2006;

Pursuant to the Law on Product and goods quality dated November 21, 2007;

Pursuant to the Government s Decree No. 127/2007/ND-CP dated August 01, 2007 detailing the implementation of a number of articles of the Law on Technical regulations and standards;

Pursuant to the Government s Decree No. 132/2008/ND-CP dated December 31, 2008, detailing the implementation of a number of articles of the Law on Product and goods quality;

Pursuant to the Government s Decree No. 20/2013/ND-CP dated February 26, 2013 defining the functions, tasks, entitlements and organizational structure of the Ministry of Science and Technology;

Pursuant to the Government s Decree No. 187/2013/ND-CP dated November 20, 2013 detailing the implementation of the commercial law regarding international goods purchase and sale and goods purchase and sale agency, processing and transit with foreign countries;

At the request of Director General of the Directorate for Standards, Metrology, and Quality,

DECISION

Article 1.To announce enclosed herewith the lists of imported goods subject to quality inspection under National technical regulation before customs clearance within the management of the Ministry of Science and Technology.

For goods that are domestically produced and fall within the lists as prescribed in the enclosed appendices, management measures as prescribed in corresponding national technical regulation and relevant legislative documents must be also executed.

Article 2.To Assign the Directorate for Standards, Metrology, and Quality to preside over and cooperate with relevant units in making proposals to leaders of the Ministry of Science and Technology for making announcement of supplements and amendments to the lists of goods subject to quality inspection under National technical regulation before customs clearance within the management of the Ministry of Science and Technology.

Article 3.This Decision takes effect on the signing date.

Article 4.Chief Officers of the Ministry of Science and Technology, Director General of the Directorate for Standards, Metrology, and Quality and relevant organizations, individuals shall implement this Decision./.
