Quy hoạch nhóm cảng biển Trung Trung bộ (nhóm 3)

Ngày 29/07/2016, Bộ trưởng Bộ Giao thông Vận tải đã ban hành Quyết định số 2369/QĐ-BGTVT phê duyệt Quy hoạch chi tiết nhóm cảng biển Trung Trung bộ (nhóm 3) giai đoạn đến năm 2020, định hướng đến năm 2030, bao gồm các cảng biển thuộc các tỉnh, thành phố: Quảng Bình, Quảng Trị, Thừa Thiên Huế, Đà Nẵng, Quảng Nam và Quảng Ngãi.
Tại Quy hoạch, Bộ trưởng định hướng sẽ nâng cấp Quốc lộ 12 đoạn từ Quốc lộ 1A đến bến cảng Hòn La và tuyến kết nối từ Quốc lộ 1A vào khu bến cảng Gianh; nâng cấp Quốc lộ 9 đoạn từ Quốc lộ 1A đến cảng Cửa Việt từ 02 làn xe lên 04 làn xe; đầu tư đường sắt kết nối tới các cảng Chân Mây, Liên Chiểu, Dung Quất. Đồng thời yêu cầu đẩy mạnh xã hội hóa việc đầu tư phát triển cơ sở hạ tần cảng biển bằng các hình thức PPP; tăng cường xúc tiến đầu tư, khuyến khích và tạo điều kiện thuận lợi cho mọi thành phần kinh tế trong và ngoài nước tham gia đầu tư phát triển cảng biển bằng các hình thức theo quy định.
Dự kiến đến năm 2020, khoảng từ 54 - 61 triệu tấn hàng/năm được thông qua tại nhóm cảng biển Trung Trung bộ, trong đó hàng tổng hợp, công ten nơ khoảng từ 24 - 28 triệu tấn/năm; vào năm 2030, bảo đảm thông qua từ 108 - 124 triệu tấn/năm, trong đó hàng tổng hợp, công ten nơ từ 43 - 51 triệu tấn/năm…
Quyết định này có hiệu lực thi hành kể từ ngày ký.

THE MINISTRY OF TRANSPORT

Decision No. 2369/QD-BGTVT dated July 29, 2016 of the Ministry of Transport approving the detailed planning for seaports in the Middle Central Vietnam (Group 3) by 2020 and the orientation towards 2030

Pursuant to the Law on Construction No. 50/2014/QH13 in 2014;

Pursuant to the Maritime Code of Vietnam in 2005;

Pursuant to the Government s Decree No. 107/2012/ND-CP dated December 20, 2012, defining the functions, tasks, powers and organizational structure of the Ministry of Transport;

Pursuant to the Government s Decree No. 92/2006/ND-CP dated September 07, 2006 on formulation, assessment, ratification and management of socio-economic development master plans and the Government s Decree No. 04/2008/ND-CP dated January 11, 2008 on amendments to Decree No. 92/2006/ND-CP;

Pursuant to the Prime Minister’s Decision No. 1037/QD-TTg dated June 24, 2014 on amendments to the Master Plan for development of Vietnam’s seaport system by 2020 and the orientation towards 2030;

In consideration of the report No. 4853/TTr-CHHVN dated November 25, 2015; the document No. 2547/CHHVN-KHDT dated June 23, 2016 of Vietnam Maritime Administration on receipt and explanation about suggestions of members of the Assessment Council, enclosed with completed plan documents; the written record dated June 09, 2016 by the Assessment Council on the amendments to the detailed planning for seaports in the Middle Central Vietnam (Group 3) by 2020, and the orientation towards 2030;

At the request of the Standing Member of the Assessment Council and Director of Planning and Investment Department,

DECIDES:

Article 1.Grant of approval for detailed planning for seaports in the Middle Central Vietnam (Group 3) by 2020 and the orientation towards 2030 with the following contents:

I. Planning scope

Group 3 includes seaports of following coastal provinces and cities in the Middle Central Vietnam: Quang Binh, Quang Tri, Thua Thien Hue, Da Nang, Quang Nam and Quang Ngai. Serving scope includes the said provinces and cities and demand for sea transport of Lao People s Democratic Republic and the Northeast of the Kingdom of Thailand.

II. Viewpoint and development targets

1. Viewpoint

- Develop seaports in conformity with the planning for transport development, construction planning, local socio-economic development planning and other related plans.

- Take the advantage of favorable geological location, natural conditions and socio-economic conditions in the region to develop ports and exploit land area for constructing ports and existing wharves and terminals in an effective way; attach a special importance to the in-depth investment to improve the capacity of operation and receipt of large-scale ships for the purposes of meeting demand for goods movement by sea of the region in particular and of the entire area of Central Vietnam in general.

- Develop national central multipurpose terminals, dedicated terminals and local terminals in a harmonious manner to ensure the harmonious development of all seaports in the group and in the national seaport system; connect with other transport infrastructure (roads, railway, inland waterway and coastal routes); Develop Da Nang port into a national central multipurpose port (Class I) and an international gate port of the Central Vietnam (Class IA).

- Develop dedicated terminals in association with concentrated industrial zones and economic zones (Hon La, My Thuy, Chan May, Chu Lai and Dung Quat) in conformity with the development of industrial establishments, demand and capacity of investors.

- Make the best use of favorable natural conditions for suitable and stable development of floating docks and cargo transshipment areas on the way so as not to cause adverse impacts on other socio-economic development plans and to strictly comply with regulations on environmental protection, maritime safety and security for the purpose of reducing investment and maritime shipping costs, and the pressure of road transport and vehicular weight inspection.

- Planning-based sizes of ships (deadweight tonnages) are used as the basis for making investment in seaport public infrastructure but are not used as the basis for prohibiting ships with larger sizes from making ocean voyages on shipping lanes, and entering/leaving seaports. A ship which has a larger size but has technical specifications conformable with a wharf’s receiving capacity, and technical standards and regulations for the shipping lane (the width, depth and clearance height, etc.), and satisfied all safety conditions may enter seaports in this group.

- The upgrade and/or investment in wharves/terminals must take into account the construction of auxiliary works (warehouse, goods yards, etc.) and the investment in loading/ unloading equipment in a comprehensive manner in conformity with the sizes of received ships and seaport design capacity.

2. Development targets and orientation

a) General targets:

- Enhance the efficiency of seaports and related infrastructure in combination with the development of industry and services for the purposes of boosting the socio-economic development and ensuring national defense and security in the region, key economic zones in the Central Vietnam and relevant regions.

- Facilitate the development of industrial zones and economic zones to boost the local industrialization and modernization by 2020 and the orientation towards 2030.

b) Specific targets:

- Ensure the estimated capacity of goods movement by the following planning periods:

+ 54 - 61 million tons per year (in which, general cargo and container cargo account for 24-28 million tons per year) by 2020.

+ 108 - 124 million tons per year (in which, general cargo and container cargo account for 43-51 million tons per year) by 2030.

- Focus on the development of central terminals for general ships and container ships, and dedicated terminals at industrial zones and concentrated industrial establishments. Develop Da Nang seaport at Lien Chieu; expand the attraction zone of the port to fulfill the role as the gate port of the Central Vietnam.

- Invest and construct terminals in island districts to serve the transport of goods and passengers as well as the socio-economic development of island districts and to ensure the national defense and security.

III. Planning contents

1. Detailed planning for Group 3 ports

Group 3 includes 06 seaports: Quang Binh, Quang Tri, Thua Thien Hue, Da Nang, Quang Nam and Quang Ngai. Detailed planning for seaports and terminals:

a) Quang Binh seaport:A local multipurpose port (Class II) with dedicated terminals, including Hon La terminals and Song River satellite terminal.

Estimated capacity of goods movement: 8.7 – 10.1 million tons/year by 2020; 18.7 – 21.7 million tons/year by 2030. To be specific:

- Hon La terminals:Primary terminals, including local multipurpose terminals and dedicated terminals. 02 multipurpose terminals shall be built by 2020 to receive ships with a deadweight tonnage of 20,000 – 50,000 tons. 01 terminal shall be built by 2030 to receive ships with a deadweight tonnage of up to 50,000 tons (in conformity with dredging progress of shipping lane). Estimated capacity of movement: 3.3 – 3.8 million tons/year by 2020; 5.7 – 6.6 million tons/year by 2030.

- Other dedicated terminals consist of:

+ Terminals of Quang Trach coal-fired thermal power plant (moved from Mui Doc to Hon La) consist of 02 terminals receiving ships with a deadweight tonnage of up to 70,000 tons and larger sizes, divided into 02 periods, up to 2020 and up to 2030. Estimated capacity of goods movement: 3.7 - 4.0 million tons per year by 2020, and 6.5 – 7.4 million tons per year by 2030.

+ Cement and bulk cargo terminals: 2-3 terminals, capable of receiving ships with a deadweight tonnage of 30,000 – 70,000 tons, shall be developed by 2030. Estimated capacity of movement: 2.4 – 3.0 million tons/year.

+ Petro Laos terminal: A dedicated terminal serving the provision of gasoline and oil to Khammouan – Laos. Scale of 01 terminal: capable of receiving oil tankers with a deadweight tonnage of 20,000 tons during the first period, and capable of receiving oil tankers with a deadweight tonnage of up to 50,000 tons during the following period in conformity with dredging progress of shipping lanes. Estimated capacity of movement: 2 – 2.5 million tons/year by 2020; 4.2 – 4.7 million tons/year by 2030.

- Gianh River terminal:A local satellite multipurpose terminal; estimated capacity of movement: 0.4 – 0.5 million tons/year.

- Gianh River oil terminal:Existing scale shall be kept unchanged with 01 terminal for receiving ships with a deadweight tonnage of up to 1,000 tons; estimated capacity of movement: 0.1 – 0.2 million tons/year.

- Thang Loi terminal:01 dedicated terminal for building and repairing ships, capable of receiving ships with a deadweight tonnage of 1,000 – 2,000 tons. Estimated capacity of movement: 0.1 – 0.2 million tons/year by 2020; 0.3 – 0.4 million tons/year by 2030.

b) Quang Tri seaport:A local multipurpose port (Class II) with dedicated terminals, including Bac Cua Viet terminals, Nam Cua Viet terminals and Ben Thuy terminals.

Estimated capacity of goods movement: 3.5 – 4.3 million tons/year by 2020; 12.7 – 15.5 million tons/year by 2030. To be specific:

- Bac Cua Viet terminals:Local terminals receiving general ships and passenger ships and serving the exchange between Con Co island district and the mainland. Upgrade and make in-depth investment in equipment of 02 existing wharves, and consider building a new wharf for receiving general ships with a deadweight tonnage of 3,000 – 5,000 tons and passenger ships by 2020. Estimated capacity of movement: 0.8 – 1.1 million tons/year by 2020; 1.2 – 1.5 million tons/year by 2030. Cua Viet oil terminal: keep existing scale which includes 01 buoy wharf receiving oil tankers with a deadweight tonnage of 40,000 tons; consider building a new permanent terminal, capable of receiving ships with a deadweight tonnage of 5,000 tons by 2020. Estimated capacity of movement: 0.5 – 1.0 million tons/year by 2020; 1.3 – 1.4 million tons/year by 2030.

- Nam Cua Viet terminals:Dedicated terminals serving demand for transport of goods of economic zones and industrial zones in Quang Tri province and an amount of oil products. 02 dedicated terminals shall be built by 2020 to receive ships with a deadweight tonnage of 3,000 – 5,000 tons or of a larger size with reduced load; 03 terminals are planned to be built by 2030. Estimated capacity of movement: 0.2 – 0.5 million tons/year by 2020; 1.0 – 1.4 million tons/year by 2030.

- My Thuy terminals:Dedicated terminals serving operations of industrial zones, and shall be developed under certain conditions. The scale and development of these terminals must be conformable with market demand and investors’ capacity of capital mobilization and ensure the harmonious development of port-connecting infrastructure (especially, shipping lanes, breakwaters, sand dykes, etc.). Estimated capacity of goods movement to serve demand of Quang Tri thermal power project: 1.6 – 2.0 million tons per year by 2020 and 3.7 - 4.0 million tons per year by 2030, capable of receiving ships with a deadweight tonnage of up to 70,000 tons and of larger sizes.

c) Thua Thien Hue seaport:A national central multipurpose port (Class I) which comprises Chan May terminals, Thuan An terminals and dedicated terminals at Dien Loc.

Estimated capacity of goods movement: 4.8 – 5.4 million tons/year by 2020; 8.9 – 10.2 million tons/year by 2030. To be specific:

- Chan May terminals:Terminals for general ships, container ships and international passenger ships, capable of receiving cargo ships with a deadweight tonnage of 30,000 – 50,000 tons, container ships with a deadweight tonnage of up to 4,000 TEU, and passenger ships with a deadweight tonnage of up 225,000 GT. Build two or three wharves for receiving ships with a deadweight tonnage of up to 50,000 tons (excluding sub-wharves) and consider investing in breakwaters in the North by 2020; build 02 terminals for receiving cargo ships with a deadweight tonnage of 50,000 tons and 01 terminal for receiving international passenger ships with a deadweight tonnage of up 225,000 GT by 2030. Estimated capacity of movement: 4.6 – 5.5 million tons/year and 250 – 300 arrivals/year by 2020; 8.0 – 9.2 million tons/year and 450 – 500 arrivals/year by 2030. Chan May oil terminal: build a permanent wharf for receiving ships with a deadweight tonnage of 20,000 – 30,000 tons; step by step relocate existing buoy wharves to provide water surface area for building terminals for general ships and container ships. Estimated capacity of movement: 0.1 – 0.2 million tons/year by 2020; 0.5 – 1.0 million tons/year by 2030.

- Thuan An terminals:Local satellite multipurpose terminals. Complete the upgrade and in-depth investment in 02 existing terminals for receiving ships with a deadweight tonnage of 3,000 – 5,000 tons, capacity of movement: 0.1 – 0.3 million tons/year by 2020. Build a new terminal for receiving ships with a deadweight tonnage of up to 5,000 tons, capacity of movement: 0.3 – 0.5 million tons by 2030. Transshipment buoy wharves shall be built under certain conditions at the sea gate region to serve demand for goods transport in the region. Thuan An oil terminal: Keep existing scale includes 01 terminal for receiving ships with a deadweight tonnage of 1,000 tons. Expected capacity of movement: 0.1 million tons/year. Dien Loc cement terminal: This is a dedicated terminal serving Dong Lam cement plant and shall be developed according to demand of this plant.

d) Da Nang seaport:This is a national central multipurpose port (Class I) and shall be developed to take the role of an international gate port of the Central Vietnam (Class IA), including Tien Sa, Tho Quang and Lien Chieu terminals.

Estimated capacity of goods movement: 11.1 – 13.2 million tons/year by 2020; 22.9 – 27.9 million tons/year by 2030. Estimated capacity of container movement: 0.5 – 0.6 million TEU/year by 2020; 1.5 – 1.85 million TEU/year by 2030. To be specific:

- Tien Sa terminals:Terminals for general ships and container ships in service of Da Nang City, an amount of goods of the northern region of the Central Highlands, and goods in transit of Laos and the Northeast of Thailand, capable of receiving container ships with a deadweight tonnage of up to 4,000 TEU and international passenger ships with a deadweight tonnage of up to 225,000 GT. Make investment in construction of terminals in phase 2 by 2020, estimated capacity of goods movement: 8.6 – 10 million tons per year; after 2020, boost the investment in advanced equipment and technologies to improve the port capacity, capacity of goods movement: 12 million tons per year and capacity of passenger movement: 300 – 370 arrivals per year. Build a new dedicated terminal for receiving passenger ships with a deadweight tonnage of up to 225,000 GT;

- Tho Quang terminals:Multipurpose terminals for receiving ships with a deadweight tonnage of 10,000 – 20,000, with dedicated terminals for ships with a deadweight tonnage of 5,000 – 10,000 tons. Comprising of:

+ Multipurpose terminals: Build a new wharf for receiving ships with a deadweight tonnage of 10,000 tons by 2020. Estimated capacity of movement: 1.0 – 1.3 million tons/year by 2020; 1.4 – 1.7 million tons/year by 2030.

+ Oil terminal: Keep existing scale includes 01 terminal for receiving ships with a deadweight tonnage of 10,000 tons. Estimated capacity of movement: 0.3 million tons/year by 2020; 0.6 million tons/year by 2030.

+ Terminal for liquefied petroleum gas and nitrogenous fertilizer: 01 terminal for receiving ships with a deadweight tonnage of 5,000 tons; Estimated capacity of movement: 0.3 million tons/year by 2020, and 0.5 million tons/year by 2030.

+ Song Thu – X50 terminal: Mainly serve the loading of materials and equipment serving the plant s operation and a certain amount of general goods, capable of receiving ships with a deadweight tonnage of 5,000 tons. Estimated capacity of movement: 0.3 – 0.5 million tons/year.

- Lien Chieu terminals:In the short term, dedicated to bulk cargo and liquid cargo directly serving industrial establishments in this region. These terminals might be developed into primary terminals of international gate ports of the Central Vietnam (if possible), capable of receiving ships with a deadweight tonnage of 100,000 tons and container ships with a deadweight tonnage of 6,000 – 8,000 TEU. To be specific:

+ Existing oil buoy wharves for receiving ships with a deadweight tonnage of 3,000 – 7,000 tons. Estimated capacity of movement: 0.7 – 0.8 million tons/year by 2020; 0.9 – 1.1 million tons/year by 2030. These terminals shall be relocated in conformity with the development progress of Lien Chieu multipurpose terminal.

+ Hai Van cement terminal: Dedicated to Hai Van cement plant, keep an existing terminal for receiving ships with a deadweight tonnage of 5,000 tons, capacity of movement: 0.2 – 0.3 million tons/year by 2020. This terminal and the cement plant shall be relocated in the future.

dd) Ky Ha seaport (Quang Nam):A local multipurpose port (Class II) with dedicated terminals, consisting of Ky Ha and Tam Hiep terminals.

Estimated capacity of goods movement: 5.0 – 5.8 million tons/year by 2020; 11.7 – 12.7 million tons/year by 2030. Estimated capacity of container movement: 60,000 – 80,000 TEU/year by 2020; 0.29 – 0.34 million TEU/year by 2030. To be specific:

- Ky Ha terminals:Multipurpose terminals for receiving ships with a deadweight tonnage of 10,000 – 20,000 tons, with dedicated terminals for ships carrying oil or gas with a deadweight tonnage of 1,000 – 5,000 tons. Upgrade existing terminals and build a new terminal for receiving ships with a deadweight tonnage of 20,000 tons by 2020. Build one or two terminals by 2030. Estimated capacity of movement: 2.6 – 3.0 million tons/year by 2020; 4.7 – 5.1 million tons/year by 2030.

- Tam Hiep terminals:Multipurpose terminals with liquid cargo terminals and dedicated terminals directly serving Chu Lai Open Economic Zone, capable of receiving ships with a deadweight tonnage of 10,000 - 20,000 tons. Build one or two new multipurpose terminals and one dedicated terminal by 2020; build 02 multipurpose terminals and other dedicated terminals serving economic activities by 2030. Estimated capacity of movement: 3.2 – 3.7 million tons/year by 2020; 8.5 – 9.2 million tons/year by 2030.

e) Quang Ngai Seaport:A national central multipurpose port (Class I), consisting of: Dung Quat I terminals, Dung Quat II terminals and Sa Ly, Ly Son satellite terminals.

Estimated capacity of goods movement: 20.9 – 21.9 million tons/year by 2020; 32.9 – 35.6 million tons/year by 2030. Estimated capacity of container movement: 10,000 – 20,000 TEU/year by 2020; 50,000 – 60,000 TEU/year by 2030. To be specific:

- Dung Quat I terminals:Terminals for receiving general ships with a deadweight tonnage of 50,000 tons and container ships with a deadweight tonnage of up to 4,000 TEU; with dedicated terminals for oil products of refinery and petrochemical complex, terminals for building and repairing ships and dedicated terminals serving heavy industrial establishments, capable of receiving ships with a deadweight tonnage of up to 150,000 tons or larger subject to demand and capacity of investors. Comprising of:

+ Multipurpose, container and dedicated terminals: Build 02 multipurpose terminals for receiving ships with a deadweight tonnage of 50,000 tons and 01 dedicated terminal serving the industrial zone by 2020; Build 01 multipurpose terminal and 02 dedicated terminals by 2030. Estimated capacity of movement: 6.4 – 7.5 million tons/year by 2020; 8.5 – 9.5 million tons/year by 2030.

+ Crude oil terminal: Build a new terminal for receiving crude oil carried by ships with a deadweight tonnage of 300,000 – 350,000 tons. Estimated capacity of movement: 7.5 – 8.0 million tons/year by 2020; 8.0 – 9.0 million tons/year by 2030.

+ Terminals for goods exported: upgrade existing terminals and build 02 terminals for receiving ships with a deadweight tonnage of 50,000 tons by 2020. Estimated capacity of movement: 7.5 – 8.0 million tons/year by 2020; 8.0 – 9.0 million tons/year by 2030.

+ Terminals for industrial zones: Dedicated to steel mills and petrochemical plants; these terminals shall be developed in conformity with the development of industrial zones.

- Sa Ky terminal:A local satellite multipurpose terminal. Upgrade the existing terminal for receiving cargo ships and passenger ships with a deadweight tonnage of 1,000 – 2,000 tons, capacity of movement: 0.1 – 0.2 million tons/year by 2020, and 0.2 – 0.4 million tons/year by 2030.

- Ben Dinh terminal (Ly Son):A terminal for general ships and passenger ships in service of Ly Son island district. Scale: receiving ships with a deadweight tonnage of 2,000 – 5,000 tons; estimated capacity of movement: 0.1 – 0.2 million tons/year and passenger ships with 400 seats.

- Dung Quat II terminals:Located at My Han Bay, a potential area of dedicated terminals for receiving ships carrying crude oil, coal or ores with a deadweight tonnage of 100,000 – 350,000 tons, directly serving the metallurgy and refinery complex; have terminals for general ships and container ships to support for Dung Quat I terminals for the purpose of serving the development of Dung Quat Economic Zone in the next period.

(Estimated capacity of good movement at the port, and the scale, functions and capacity of each port in the Group are provided in the Annex enclosed to this Decision).

2. Plan for investment and upgrade of shipping lanes

- Dredge Hon La lane for receiving ships with a deadweight tonnage of up to 70,000 tons in conformity with the development of thermal power plants.

- Upgrade Cua Gianh, Cua Viet and Thuan An lanes for receiving ships with a deadweight tonnage of 3,000 – 5,000 tons mainly under the form of private sector involvement.

- Develop Ky Ha lane for receiving ships with a deadweight tonnage of 20,000 tons, and the segment from Ky Ha to Tam Hiep terminals for the voyage of ships with a deadweight tonnage of 10,000 – 20,000 tons in conformity with the construction progress of terminals in this area and actual development of Chu Lai Open Economic Zone.

- Build Tho Quang one-way lane for receiving ships with a deadweight tonnage of 10,000 tons. Dredge shipping lanes for ships with a deadweight tonnage of 5,000 tons fully loaded, and 10,000 tons partially loaded. Consider upgrading Da Nang lane to Tien Sa terminal for ships with a deadweight tonnage of up to 50,000 tons in conformity with the development of terminals and number of ships entering these terminals.

3. Orientation of port-connecting transport infrastructure

- Upgrade Highway 12, the segment from Highway 1A to Hon La terminal, and roads connecting from Highway 1A to Gianh terminals.

- Upgrade Highway 9, the segment from Highway 1A to Cua Viet terminal, on from two lanes to four lanes.

- Upgrade a 75-km segment on Highway 49 from Thuan An port to Ho Chi Minh highway, Thua Thien Hue province.

- Complete Da Nang - Quang Ngai expressway project and Cam Lo - Tuy Loan expressway project within approved period.

- Invest in railways connecting to Chan May, Lien Chieu and Dung Quat ports.

- Consider upgrading inland waterways (Gianh river, Han river and Hieu river) connecting to seaports and anchoring and transshipment zones for the purpose of relieving the burden of road transport.

4. Investment projects given priority by 2020

- Dredge Hon La lane for ships with a deadweight tonnage of up to 70,000 tons in conformity with the development of thermal power plants; Cua Gianh lane and Cua Viet – Quang Tri lane for ships with a deadweight tonnage of 3,000 – 5,000 tons under the form of private sector involvement.

- Dredge Tho Quang lane for receiving ships with a deadweight tonnage of 5,000 - 10,000 tons.

- Complete the upgrade of Ky Ha lane for receiving ships with a deadweight tonnage of 20,000 tons; consider upgrading the segment from Ky Ha to Tam Hiep terminals for receiving ships with a deadweight tonnage of 20,000 tons.

- Build inland container depots and cargo distribution center in Da Nang to facilitate the operations of seaports in Da Nang and Chan May.

5. Policies and solutions for the planning implementation

a) Solution for managing the planning implementation

- Enhance private involvement sector in development of seaport infrastructure under PPP form (BOT, BTO, etc.). Enhance investment promotion, encourage and enable all domestic and foreign economic sectors to invest in seaport development under regulated investment forms; encourage investors of economic zones and industrial zones to invest in seaport infrastructure and port-connecting infrastructure.

- State budget shall focus on investment in public infrastructure works (shipping lanes, breakwaters, etc.) attached to important seaports/ terminals. The investment in terminals under this planning shall be carried out under the form of private sector involvement. Investors shall be responsible for sources of capital of their proposed terminals and efficiency of their investment in seaports and port-connecting infrastructure.

- If an investor applies for being invested in a wharf/terminal with a scale (in term of deadweight tonnage of received ships) larger than the planned scale, Ministry of Transport shall considers approving the investor’s application on the basis of specific types of goods, types of ships receiving goods at the port but such invested wharf/terminal shall not cause change in the port’s purposes; at the same time, that investor must assume responsibility for investment efficiency of his/her project.

- Keep boosting administrative procedure reform in management of investment and port operation towards simplification and international integration. Improve state management during the planning implementation.

- Provide land area behind the ports to build goods distribution centers which plan the role as logistics centers.

- Detailed planning for construction of terminals should take into account the planning for office of port authorities and regulatory bodies at new terminals to ensure conveniently and effectively state management of them.

b) Solutions for buoy wharves and transport hubs

- Buoy wharves and transport hubs under the planning shall be planned and stably invested and operated for a long term in conformity with the general planning of the port as wharves/terminals.

- Temporary buoy wharves and transport hubs shall not be planned but licensed to operate for a fixed term of not exceeding 5 years when buoy wharves and transport hubs under the planning in the region are unable to meet actual demand for goods movement. Investors in buoy wharves must stop their operation and dismantle them when licensed operation duration expires.

Article 2. Management and organization of planning implementation

1. Vietnam Maritime Administration

- Preside over and cooperate with departments/ boards/ regulatory bodies of provinces or cities and relevant agencies in publishing and managing implementation of approved planning.

- Preside over and cooperate with departments/ boards/ regulatory bodies of provinces or cities and relevant agencies in counseling Ministry of Transport to consider approving new investment or upgrade of wharves/terminals.

- Take charge of the appraisal and request Ministry of Transport to consider and decide the updates or adjustments to the scale, functions or construction progress of wharves/ terminals.

- With regard to potential ports/ terminals, based on actual demand and at the request of investors and people’s committees of provinces/ cities, Vietnam Maritime Administration shall submit an aggregated report to Ministry of Transport for consideration.

- Do research and propose specific policies for management and operation of permanent/temporary buoy wharves and transport hubs.

- Regularly coordinate with local government and relevant agencies in carrying out the inspection of the implementation of planning for seaports development; propose actions against projects that fail to comply with the planning; annually report to Ministry of Transport on the planning implementation results.

2. People’s committees of central-affiliated cities or provinces

- Give instructions in formulation of local planning in conformity with the approved detailed planning for the Group of seaports; pursuant to the approved planning, strictly manage land area dedicated to port construction; provide land area according to the planning for harmonious development of ports and infrastructure connected thereto, logistics centers and maritime service centers in order to ensure smooth operation of seaports.

- Before allocating land/ waters within the planning area for construction of seaports/terminals or issuing a certificate of investment to a seaport construction project, people’s committees of provinces/ cities must reach an agreement with the Ministry of Transport in contents related to the port planning (the purpose, scale and progress of investment) as regulated. Based on that agreement, Ministry of Transport shall instruct Vietnam Maritime Administration and provincial port authorities to strictly coordinate with local government in supervising and managing the planning implementation.

- Instruct provincial competent authorities to strictly coordinate with Vietnam Maritime Administration in preparing, appraisal and applying for approval for detailed planning for terminals; propose updates, supplements or adjustments to detailed planning for seaports/ terminals to Ministry of Transport in accordance with regulations.

Article 3.This Decision takes effect on the signing date and replaces Decision No. 1743/QD-BGTVT dated August 03, 2011 by Minister of Transport.

Article 4.Chief of Office, Chief Inspector of the Ministry of Transport, Directors of Departments, Director of Vietnam Maritime Administration, heads of relevant organizations and individuals are responsible for the implementation of this Decision./.
