Thí điểm góp vốn cổ phần thành lập đơn vị sự nghiệp công lập
Nhằm thực hiện mục tiêu đến năm 2020, nước ta cơ bản trở thành nước công nghiệp theo hướng hiện đại, đời sống vật chất và tinh thần của nhân dân được nâng cao, ngày 09/08/2012, Chính phủ đã ban hành Nghị quyết số 40/NQ-CP ban hành Chương trình hành động của Chính phủ thực hiện Thông báo kết luận của Bộ Chính trị về Đề án “Đổi mới cơ chế hoạt động của các đơn vị sự nghiệp công lập, đẩy mạnh xã hội hóa một số loại hình dịch vụ sự nghiệp công”.
Tại Nghị quyết này, Chính phủ yêu cầu các Bộ, cơ quan ngang Bộ, UBND các tỉnh, thành phố trực thuộc Trung ương tập trung chỉ đạo, triển khai thực hiện thí điểm góp vốn cổ phần để thành lập mới đối với một số đơn vị sự nghiệp công lập, các đơn vị thuộc các tập đoàn, tổng công ty Nhà nước khi tiến hành cổ phần hóa nhưng không thực hiện cổ phần hóa các đơn vị sự nghiệp công lập hiện có; đổi mới cơ chế tài chính đối với nhóm các đơn vị sự nghiệp công lập cung cấp các dịch vụ sự nghiệp công có khả năng xã hội hóa cao, tự đảm bảo toàn bộ chi phí hoạt động theo hướng giao quyền tự chủ, tự chịu trách nhiệm về tổ chức thực hiện nhiệm vụ, nhân lực, tài chính…
Bên cạnh đó, Chính phủ cũng nhấn mạnh yêu cầu đổi mới cơ chế tính giá đặt hàng sản phẩm, dịch vụ sự nghiệp công; xây dựng và ban hành hệ thống định mức kinh tế - kỹ thuật và tiêu chí, tiêu chuẩn của từng loại hình dịch vụ sự nghiệp công để làm căn cứ đặt hàng, giao nhiệm vụ; tăng cường hoàn thiện các công cụ quản lý và vai trò kiểm tra, giám sát của các cơ quan quản lý Nhà nước đối với hoạt động cung cấp dịch vụ công nhằm hướng tới việc cung cấp tốt hơn dịch vụ cho mọi tầng lớp nhân dân…
Nghị quyết này có hiệu lực thi hành kể từ ngày ký.

RESOLUTION
PROMULAGTING ACTION PROGRAM OF GOVERNMENT IN FURTHURANCE OF CONCLUSION NOTIFICATION OF THE MINISTRY OF POLITICSON SCHEME “RENEWING OPERATIONAL MECHANISM OF PUBLIC NON-BUSINESS UNITS, PUSHING UP SOCIALIZATIONOFSOME PUBLICNON-BUSINESSSERVICE TYPES”
GOVERNMENT
Pursuant to conclusion notification No.37-TB/TW of May 26, 2011 of the Ministry of politics on scheme “renewing operational mechanism of public non-business units, pushing up socializationofsome public non-business service types”;
At the request of the Minister of Finance;
RESOLVES:
Article 1.To promulgate together this Resolution the action program of Government in furthurance of conclusion notification No.37-TB/TW, of May 26, 2011 of Ministry of politics on scheme “renewing operational mechanism of public non-business units, pushing up socializationofsome publicnon-businessservice types”;
Article 2.This Resolution takes effect from the day of signing.
Article 3.Members of government, Heads of Governmental agencies, the Presidents of People’s Committees of central-affiliated cities and provinces shall implement this Resolution.

ACTION PROGRAM OF GOVERNMENT
IN FURTHURANCE OF CONCLUSION NOTIFICATION OF THE MINISTRY OF POLITICS ON SCHEME “RENEWING OPERATIONAL MECHANISM OF PUBLIC NON-BUSINESS UNITS, PUSHING UP SOCIALIZATIONOFSOME PUBLIC -BUSINESS SERVICE TYPES”
(Promulgated together with the Government’s Resolution No.40/NQ-CP, of August 09, 2012)
Part 1.
OBJECTIVE
To determine, assign and organize effective implementation of key tasks of state management agencies aiming to implement the conclusion notification of the Ministry of politics on continuing perform policies renewing operational mechanism of public non-business units, pushing up socialization of public non-business service in the next future with a higher decisive, a stronger and more synchronous and more comprehensive renewal, contributing in implementation of target that by 2020, our country basically become an modern-oriented - industrial country, material and spirit life of people is improved clearly.
Part 2.
KEY TASKS
Based on assigned functions, tasks, powers in state management, Ministries, Ministerial-level agencies, Government-attached agencies, People’s Committee of central-affiliated cities and provinces shall concentrate on implementation of the following key tasks:
I. TO RAISE AWARENESS ON RENEWING OPERATIONAL MECHANISM OF PUBLIC NON-BUSINESS UNITS AND PUSHING UP SOCIALIZATION OF SOME PUBLIC NON-BUSINESS SERVICE TYPES:
1.The functional agencies at levels implement propagation, education and mobilization aiming to grasp thoroughly and deeply, make unification on awareness in whole society, especially with respect to state agencies, political organizations, socio-political organizations, non-business units and cadres, civil servants, public employees regarding content and spirit of renewal of operational mechanism of public non-business units and push up socialization of some non-business service types.
2.The functional agencies at levels advise to Party Committee levels at same level in issuing and implementing Resolutions, Directions on policies, plans and specific measures aiming to create evolution in thought, raise awareness of society about necessary, urgency of renewal of operational mechanism of public non-business units, and encourage attraction of economical members for investment in development of non-public services, aiming to orient better service supply for all classes of people and ensure for persons subject to social policies and the poorer being accessed, enjoyed essential basic services with higher quality.
II.TO FINALIZE INSTITUTIONS TO ASSURE SYNCHRO OF ELEMENTS RENEWING OPERATIONAL MECHANISM OF PUBLIC NON-BUSINESS UNITS AND PUSH UP SOCIALIZATION OF SOME PUBLIC NON-BUSINESS SERVICE TYPES:
1.To finalize institutions on structure and investment methods of the State budget (NSNN):
a) State shall continue to keep decisive role, enhance investment in construction of material facilities of basic public non-business activities and restructure regular expenditure of the State budget for activities supplying public non-business service under way:
-The State budget ensure regular expenditure for public non-business units assigned task supplying public non-business services in areas with difficult social-economical condition, areas of ethnic minority groups, mountains, border areas and islands by state.
-To change basically methods of assistance from the State budget in supplying pubic non-business service, gradually turn from allocation of budget estimates for units supplying public non-business units as present into method of goods order, goods purchase on basis of technical- economical norm system and criterions, quality standards of each service type supplied by unit without discrimination whether public or non-public, aiming to make healthy competition, advantage environment, assure for public non-business units and non-public ones developed equality.
b) The state ensures implementation of policies assisting directly for meritorious people, poorer and ethnic minorities in order to access and enjoy basic essential public non-business services with higher quality; ensures expenditure of training, fostering teachers, lectures and management officers (principal,vice principal) of training establishments without discrimination whether public or non-public.
2.To finalize institutions on finance mechanism with respect to public non-business units:
a) To strengthen decentralization and implementation of assigning higher autonomy, self-responsibility for public non-business units synchronously in organization for implementation of task, human, finance (gradually being sufficient service price and reduce allowances from state budget) with calculation of characteristic of each unit type, capacity and demand of market and synchronously in management level.
b) To implement transparency of joint-venture and combination activities of public non-business units; to overcome confused situation between public and private; to renew mechanism of distribution under way of ensuring right and benefits of laborers and having accumulation in order to strengthen material facilities of public non-business units.
c) To implement renewal of financial mechanism with respect to group of public non-business units supplying non-business services that has high ability of socialization, self-ensures all expenditure for its activities (universities, hospitals and a few of vocational establishments after 2015)In way:Assigning autonomy, self-responsibility synchronously in organization for implementation of task, human, finance, properties upon supplying services and attached with demand of society; permitted to collect service price on the basis of frame price calculated sufficient reasonable and lawful expenditures promulgated by competent levels; allocated capital by state, defined value of properties assigned to public non-business units under mechanism of capital allocation for enterprises; permitted to decide mobilization of capital, use capital, properties attached to assigned tasks as prescribed in order to expand supply of non-business services, self-decide number of laborers and payment of salary on the basis of wage scales of state and effectiveness, quality of jobs.
d) For non-business units supplying normal services (especially economical non-business units):To formulate, promulgate and organize implementation of mechanism aiming to facilitate to convert activities under model of enterprises and then implement equitization as prescribed.
dd) To implement pilot contribution of stock capital for new establishment of some public non-business units, units under state group, corporation when perform equitization not perform equitization with respect to the existing - independent - public non-business units.
3.To finalize institutions on autonomy mechanism in implementation of tasks and organization of public non-business units:
a) To continue strengthening assignment, decentralization, assignment of autonomy, self-responsibility for tasks, organization of apparatus and number of laborers in public non-business units.To stipulate clearly competence and duty of heads in management and operation of non-business units; stipulate and implement mechanism of supervision, examination of duty of heads of public non-business units in their implementation of authority.
b) Renewal of mechanism of management of officers must ensure inheritance and development, adapt with implementation of autonomy and self-responsibility mechanism of public non-business units, in conformity with rules of market economy, ensure competition with non-public area, to attract talent persons with high level to participate in team of officers in order to increase service quality for people in all sectors.
4.To finalize institution on mechanism of goods order, goods purchase, assignment of task supplying public non-business services:
a) To formulate and promulgate system of technical- economical norms and criterions, standards of each non-business service type as basis for goods order and assignment of tasks.
b) To renew mechanism of calculation of priceofpublicnon-public products, servicesareordered; state shall stipulate price or frame price of products, services being basic, having essential role with society; gradually calculate rightly and fully for reasonable expenditures in price of non-business service, suitable with market and capacity of the State budget; implement with roadmap on delete subsidies by price, charge of service aiming to increase competition and ensure benefits of units supplying public non-business units.
5. To finalize institutions, push up implementation of incentive policy for socialization of public non-business services:
Continuing to renew, finalize and unfasten difficuls, problems in socialization, especially incentive policies on land, tax, credit aiming to encourage, mobilizie economical subjects domestic and offshore for positive participation in development of public non-business services.
6.To strengthen completion of management tools and role of examination, supervision of state management agencies with respect to activities of supply of public services aiming to orient better service supply for all classes of people, promote positive elements, restrain leffsides of market mechanism.Renewal of operational mechanism of public non-business units must combine with administrative procedure reform;modernization,computerization, information technology application in all activities of public non-business units.
Part 3.
ORGANIZATION FOR IMPLEMENT
1.The Ministry of Finance shall assume the prime responsibility for and submit to the Prime Minister for making decision on establishment of State Steering Committee of renewing operational mechanism of public non-business units and pushing up socialization of some public non-business service types.
2.On the basis of tasks, content of key job in this action program and enclosed Annex, based on function, task having been assigned, the Minister, heads of ministerial-level agencies, heads of Govermental agencies, the chairpersons of People’s Committees of central-affiliated cities and provinces shall direct formulation of action program of their Ministries, sectors and localities, report to the Prime Minister before October 31, 2021; on that basis, concretize tasks in annual work plan.
3.On the basis of mechanisms, policies expected to implement, assign:
a) The Ministry of Finance, the Ministry of Education and Training, the Ministry of Public Health, relevant ministries and agencies under assigned tasks, to effectively implement content of action program of Government; to formulate, promulgate and implement suitable mechanisms and policies in order to gradually formulate prices of public services performed under market mechanism attached to reasonable assistance policies for meritorious people, poorer, people with difficult circumstance and ethnic minorities; renew financial mechanism for non-business sectors in way of increase autonomy, self-responsibility of agencies, units attached with mechanism ofgoodsorder and assignment of specific tasks.
b) In year 2012-2013, the Ministry of Finance, the Ministry of Education and Training, the Ministry of Public Health, relevant ministries and agencies shall concentrate to implement the following tasks:
-To organize assessment of operational model of non-business units having ensured expenditures for regular activities in the past time, on that basis, to formulate scheme in pilot implementation of self-controllling operational expenditures, proposing incentive policy, to facilitate for units to well implement autonomy mechanism.
-To select list of affiliated units that may participate in pilot implementation of renewal of operational mechanism, financial mechanism as follows:
+ To implement pilotgoodsorder supplying service with respect to service types less capacity to implement socialization but state have demand of use and society has not capacity to supply.
+ To implement pilot assignment of autonomy in activities combinating with high financial autonomy based on pilot adjustment of financial implement of expenditure and revenue in order to remedy expenditures for regular activities (gradually calculate fully service prices and reduce allowances from budget), diversify revenues source.
c) To sum up pilot result, report to the Prime Minister for completion of mechanisms, policies and expanding in year 2014-2015.
4.Ministers, Heads of ministerial-level agencies, Heads of Governmental agencies, the Chairpersons of People’s Committees of central-affiliated cities and provinces shall concentrate on directing, strengthenning, examining, expediting implementation of this action program; annually report to the Prime Minister on performance; and send them tothe Ministry of Finance for monitoring, summing up and reporting to the Prime Minister.
5.In the course of implementation of this action program, if it is realized being necessary to amend and supplement specific contents of Program, ministries, sectors and localities shall be positive to coordinate with the Ministry of Finance to report to the Prime Minister for consideration and amking decision.
6.The Minister of Finance based on its assigned functions, tasks, powers,shall monitorate,expedite Ministries, sectors and localities to implement this action program; periodly report, propose to Government, the Prime Minister necessity measures aiming to ensure the program being implemented effectively and synchoronously.
