Thí điểm góp vốn cổ phần thành lập đơn vị sự nghiệp công lập
Nhằm thực hiện mục tiêu đến năm 2020, nước ta cơ bản trở thành nước công nghiệp theo hướng hiện đại, đời sống vật chất và tinh thần của nhân dân được nâng cao, ngày 09/08/2012, Chính phủ đã ban hành Nghị quyết số 40/NQ-CP ban hành Chương trình hành động của Chính phủ thực hiện Thông báo kết luận của Bộ Chính trị về Đề án “Đổi mới cơ chế hoạt động của các đơn vị sự nghiệp công lập, đẩy mạnh xã hội hóa một số loại hình dịch vụ sự nghiệp công”.
Tại Nghị quyết này, Chính phủ yêu cầu các Bộ, cơ quan ngang Bộ, UBND các tỉnh, thành phố trực thuộc Trung ương tập trung chỉ đạo, triển khai thực hiện thí điểm góp vốn cổ phần để thành lập mới đối với một số đơn vị sự nghiệp công lập, các đơn vị thuộc các tập đoàn, tổng công ty Nhà nước khi tiến hành cổ phần hóa nhưng không thực hiện cổ phần hóa các đơn vị sự nghiệp công lập hiện có; đổi mới cơ chế tài chính đối với nhóm các đơn vị sự nghiệp công lập cung cấp các dịch vụ sự nghiệp công có khả năng xã hội hóa cao, tự đảm bảo toàn bộ chi phí hoạt động theo hướng giao quyền tự chủ, tự chịu trách nhiệm về tổ chức thực hiện nhiệm vụ, nhân lực, tài chính…
Bên cạnh đó, Chính phủ cũng nhấn mạnh yêu cầu đổi mới cơ chế tính giá đặt hàng sản phẩm, dịch vụ sự nghiệp công; xây dựng và ban hành hệ thống định mức kinh tế - kỹ thuật và tiêu chí, tiêu chuẩn của từng loại hình dịch vụ sự nghiệp công để làm căn cứ đặt hàng, giao nhiệm vụ; tăng cường hoàn thiện các công cụ quản lý và vai trò kiểm tra, giám sát của các cơ quan quản lý Nhà nước đối với hoạt động cung cấp dịch vụ công nhằm hướng tới việc cung cấp tốt hơn dịch vụ cho mọi tầng lớp nhân dân…
Nghị quyết này có hiệu lực thi hành kể từ ngày ký.

Căn cứ Thông báo Kết luận số 37-TB/TW ngày 26 tháng 5 năm 2011 của Bộ Chính trị về Đề án "Đổi mới cơ chế hoạt động của các đơn vị sự nghiệp công lập, đẩy mạnh xã hội hóa một số loại hình dịch vụ sự nghiệp công”;

Xét đề nghị của Bộ trưởng Bộ Tài chính,

QUYẾT NGHỊ:

Điều 1. Ban hành kèm theo Nghị quyết này Chương trình hành động của Chính phủ thực hiện Thông báo Kết luận số 37-TB/TW ngày 26 tháng 5 năm 2011 của Bộ Chính trị về Đề án “Đổi mới cơ chế hoạt động của các đơn vị sự nghiệp công lập, đẩy mạnh xã hội hóa một số loại hình dịch vụ sự nghiệp công”;

Điều 2. Nghị quyết này có hiệu lực thi hành kể từ ngày ký.

Điều 3. Các Thành viên Chính phủ, Thủ trưởng cơ quan thuộc Chính phủ, Chủ tịch Ủy ban nhân dân các tỉnh, thành phố trực thuộc Trung ương chịu trách nhiệm thi hành Nghị quyết này./.

Phần 1.

MỤC TIÊU

Xác định, phân công và tổ chức thực hiện có hiệu quả những nhiệm vụ chủ yếu của các cơ quan quản lý nhà nước nhằm triển khai thực hiện Thông báo kết luận của Bộ Chính trị về tiếp tục thực hiện chủ trương đổi mới cơ chế hoạt động của các đơn vị sự nghiệp công lập, đẩy mạnh xã hội hóa các đơn vị sự nghiệp dịch vụ công trong thời gian tới với quyết tâm cao hơn, đổi mới mạnh mẽ, đồng bộ và toàn diện hơn, góp phần thực hiện được mục tiêu đến năm 2020 đưa nước ta cơ bản trở thành nước công nghiệp theo hướng hiện đại, đời sống vật chất và tinh thần của nhân dân được nâng lên rõ rệt.

Phần 2.

NHỮNG NHIỆM VỤ CHỦ YẾU

Căn cứ chức năng, nhiệm vụ, quyền hạn quản lý nhà nước được giao, các Bộ, cơ quan ngang Bộ, cơ quan thuộc Chính phủ, Ủy ban nhân dân các tỉnh, thành phố trực thuộc Trung ương tập trung chỉ đạo tổ chức triển khai những nhiệm vụ chủ yếu sau đây:

I. NÂNG CAO NHẬN THỨC VỀ ĐỔI MỚI CƠ CHẾ HOẠT ĐỘNG CỦA CÁC ĐƠN VỊ SỰ NGHIỆP CÔNG LẬP VÀ ĐẨY MẠNH XÃ HỘI HÓA MỘT SỐ LOẠI HÌNH DỊCH VỤ SỰ NGHIỆP CÔNG:

1. Các Cơ quan chức năng ở các cấp thực hiện việc tuyên truyền, giáo dục và vận động nhằm quán triệt sâu rộng, tạo sự thống nhất về nhận thức trong toàn xã hội, đặc biệt đối với các cơ quan nhà nước, các tổ chức chính trị, tổ chức chính trị - xã hội, các đơn vị sự nghiệp và đội ngũ cán bộ, công chức, viên chức nhà nước về các nội dung và tinh thần của việc đổi mới cơ chế hoạt động của các đơn vị sự nghiệp công lập và đẩy mạnh xã hội hóa một số loại hình dịch vụ sự nghiệp công.

2. Các cơ quan chức năng ở các cấp tham mưu cho các cấp ủy đảng cùng cấp trong việc ban hành và triển khai các nghị quyết, chỉ thị về chủ trương, kế hoạch và biện pháp cụ thể nhằm tạo chuyển biến về tư tưởng, nâng cao nhận thức của xã hội về sự cần thiết, tính cấp bách của việc đổi mới cơ chế hoạt động của các đơn vị sự nghiệp công lập, đồng thời khuyến khích thu hút các thành phần kinh tế đầu tư phát triển dịch vụ sự nghiệp công để hướng tới việc cung cấp tốt hơn dịch vụ cho mọi tầng lớp nhân dân và bảo đảm cho các đối tượng chính sách xã hội và người nghèo được tiếp cận, hưởng thụ các dịch vụ cơ bản thiết yếu với chất lượng cao hơn.

II. HOÀN THIỆN THỂ CHẾ BẢO ĐẢM ĐỒNG BỘ CÁC YẾU TỐ THỰC HIỆN ĐỔI MỚI CƠ CHẾ HOẠT ĐỘNG CỦA CÁC ĐƠN VỊ SỰ NGHIỆP CÔNG LẬP, ĐẮY MẠNH XA HỘI HÓA MỘT SỐ LOẠI HÌNH DỊCH VỤ SỰ NGHIỆP CÔNG

1. Hoàn thiện thể chế về cơ cấu và phương thức đầu tư của Ngân sách nhà nước (NSNN):

a) Nhà nước tiếp tục giữ vai trò chủ đạo, tăng cường đầu tư cho xây dựng cơ sở vật chất các hoạt động sự nghiệp công cơ bản và thực hiện cơ cấu lại chi thường xuyên ngân sách nhà nước đối với các hoạt động cung cấp dịch vụ sự nghiệp công theo hướng:

- NSNN bảo đảm kinh phí hoạt động thường xuyên đối với các đơn vị sự nghiệp công lập được Nhà nước giao nhiệm vụ cung cấp dịch vụ sự nghiệp công ở các vùng có điều kiện kinh tế xã hội khó khăn, vùng đồng bào dân tộc thiểu số, vùng miền núi, biên giới và hải đảo.

- Thay đổi cơ bản phương thức hỗ trợ từ NSNN trong cung cấp dịch vụ sự nghiệp công, từng bước chuyển từ việc giao dự toán ngân sách cho các đơn vị cung cấp dịch vụ sự nghiệp công lập như hiện nay sang thực hiện phương thức đặt hàng, mua hàng dựa trên cơ sở hệ thống định mức kinh tế - kỹ thuật và tiêu chí, tiêu chuẩn chất lượng của từng loại hình dịch vụ đơn vị cung cấp mà không phân biệt cơ sở công lập, ngoài công lập nhằm tạo cạnh tranh lành mạnh, tạo môi trường thuận lợi, bảo đảm cho các đơn vị sự nghiệp công lập và ngoài công lập phát triển bình đẳng.

b) Nhà nước bảo đảm thực hiện các chính sách hỗ trợ trực tiếp cho người có công, người nghèo và đồng bào dân tộc thiểu số để được tiếp cận và hưởng thụ các dịch vụ sự nghiệp công cơ bản thiết yếu với chất lượng ngày càng cao hơn; bảo đảm kinh phí đào tạo, bồi dưỡng đội ngũ giáo viên, giảng viên và cán bộ quản lý (hiệu trưởng, hiệu phó) ở các cơ sở đào tạo không phân biệt cơ sở công lập, ngoài công lập.

2. Hoàn thiện thể chế về cơ chế tài chính đối với các đơn vị sự nghiệp công lập:

a) Tăng cường phân cấp và thực hiện trao quyền tự chủ, tự chịu trách nhiệm cao hơn cho các đơn vị sự nghiệp công lập đồng bộ cả về tổ chức thực hiện nhiệm vụ, nhân lực, tài chính (từng bước tính đủ giá dịch vụ và giảm trợ cấp ngân sách) có tính đến đặc điểm từng loại hình đơn vị, khả năng, nhu cầu thị trường và trình độ quản lý.

b) Thực hiện minh bạch hóa các hoạt động liên doanh, liên kết của các đơn vị sự nghiệp công lập; khắc phục tình trạng công - tư lẫn lộn; đổi mới cơ chế phân phối theo hướng vừa đảm bảo quyền lợi của người lao động vừa có tích lũy để tái đầu tư tăng cường cơ sở vật chất của đơn vị sự nghiệp công lập.

c) Thực hiện đổi mới cơ chế tài chính đối với nhóm các đơn vị sự nghiệp công lập cung cấp các dịch vụ sự nghiệp công có khả năng xã hội hóa cao, tự đảm bảo toàn bộ chi phí hoạt động (các trường đại học, bệnh viện và một số cơ sở dạy nghề từ sau năm 2015...) theo hướng: Giao quyền tự chủ, tự chịu trách nhiệm đồng bộ cả về tổ chức thực hiện nhiệm vụ, nhân lực, tài chính, tài sản khi cung cấp dịch vụ gắn với nhu cầu của xã hội; được quyết định thu giá dịch vụ trên cơ sở khung giá tính đủ các chi phí hợp lý, đúng pháp luật do cấp có thẩm quyền ban hành; được Nhà nước giao vốn, xác định giá trị tài sản để giao cho đơn vị sự nghiệp công lập theo cơ chế giao vốn cho doanh nghiệp; được quyền quyết định việc huy động vốn, sử dụng vốn, tài sản gắn với nhiệm vụ được giao theo quy định để mở rộng việc cung cấp dịch vụ sự nghiệp công, tự quyết định số người làm việc và trả lương trên cơ sở thang bảng lương của Nhà nước và hiệu quả, chất lượng công việc.

d) Đối với các đơn vị sự nghiệp cung cấp những dịch vụ thông thường (nhất là các đơn vị sự nghiệp kinh tế): Xây dựng, ban hành và tổ chức thực hiện cơ chế nhằm tạo điều kiện để chuyển sang hoạt động theo mô hình doanh nghiệp và sau đó cổ phần hóa theo quy định.

đ) Thực hiện thí điểm góp vốn cổ phần để thành lập mới đối với một số đơn vị sự nghiệp công lập, các đơn vị thuộc các tập đoàn, tổng công ty nhà nước khi tiến hành cổ phần hóa nhưng không thực hiện cổ phần hóa các đơn vị sự nghiệp công lập độc lập hiện có.

3. Hoàn thiện thể chế về cơ chế tự chủ về thực hiện nhiệm vụ và tổ chức bộ máy đối với các đơn vị sự nghiệp công lập:

a) Tiếp tục đẩy mạnh phân công, phân cấp, giao quyền tự chủ, tự chịu trách nhiệm về thực hiện nhiệm vụ, tổ chức bộ máy và số người làm việc cho các đơn vị sự nghiệp công lập. Quy định rõ ràng thẩm quyền và trách nhiệm của người đứng đầu trong quản lý và điều hành đơn vị sự nghiệp; quy định và thực hiện cơ chế giám sát, kiểm tra trách nhiệm của người đứng đầu đơn vị sự nghiệp công lập trong việc thực hiện thẩm quyền.

b) Đổi mới cơ chế quản lý đội ngũ viên chức phải bảo đảm tính kế thừa và phát triển, thích ứng với việc thực hiện cơ chế tự chủ, tự chịu trách nhiệm của các đơn vị sự nghiệp công lập, phù hợp với các quy luật của nền kinh tế thị trường, bảo đảm tính cạnh tranh với khu vực ngoài công lập, thu hút người có tài năng, có trình độ cao tham gia vào đội ngũ viên chức để nâng cao chất lượng phục vụ người dân trong các lĩnh vực.

4. Hoàn thiện thể chế về cơ chế đặt hàng, mua hàng, giao nhiệm vụ cung ứng dịch vụ sự nghiệp công:

a) Xây dựng và ban hành hệ thống định mức kinh tế - kỹ thuật và tiêu chí, tiêu chuẩn của từng loại hình dịch vụ sự nghiệp công để làm căn cứ đặt hàng, giao nhiệm vụ.

b) Đổi mới cơ chế tính giá đặt hàng sản phẩm, dịch vụ sự nghiệp công; Nhà nước quy định giá hoặc khung giá sản phấm, dịch vụ đối với các loại dịch vụ cơ bản, có vai trò thiết yếu đối với xã hội; từng bước tính đúng, tính đủ các chi phí hợp lý trong giá dịch vụ sự nghiệp, phù hợp với thị trường và khả năng của Ngân sách nhà nước; thực hiện có lộ trình việc xóa bỏ bao cấp qua giá, phí dịch vụ nhằm tăng tính cạnh tranh và đảm bảo lợi ích của các đơn vị cung ứng dịch vụ sự nghiệp công.

5. Hoàn thiện thể chế, đẩy mạnh việc thực hiện chính sách khuyến khích xã hội hóa dịch vụ sự nghiệp công:

Tiếp tục đổi mới, hoàn thiện và tháo gỡ các khó khăn, vướng mắc trong việc xã hội hóa nhất là các chính sách ưu đãi về đất đai, thuế, tín dụng nhằm khuyến khích, huy động các thành phần kinh tế trong và ngoài nước tích cực tham gia đầu tư phát triển dịch vụ sự nghiệp công.

6. Tăng cường hoàn thiện các công cụ quản lý và vai trò kiểm tra, giám sát của các cơ quan quản lý nhà nước đối với hoạt động cung cấp dịch vụ công nhằm hướng tới việc cung cấp tốt hơn dịch vụ cho mọi tầng lớp nhân dân, phát huy các yếu tố tích cực, hạn chế các mặt trái của cơ chế thị trường. Đổi mới cơ chế hoạt động của các đơn vị sự nghiệp công phải gắn liền với cải cách thủ tục hành chính; Hiện đại hóa, tin học hóa, ứng dụng công nghệ thông tin trong mọi hoạt động của các đơn vị sự nghiệp công lập.

Phần 3.

TỔ CHỨC THỰC HIỆN

1. Bộ Tài chính chủ trì trình Thủ tướng Chính phủ quyết định thành lập Ban Chỉ đạo Nhà nước về đổi mới cơ chế hoạt động của các đơn vị sự nghiệp công lập, đẩy mạnh xã hội hóa một số loại hình dịch vụ sự nghiệp công.

2. Trên cơ sở những nhiệm vụ, nội dung công việc chủ yếu trong Chương trình hành động này và Phụ lục kèm theo, căn cứ chức năng, nhiệm vụ đã được phân công, các Bộ trưởng, Thủ trưởng cơ quan ngang Bộ, Thủ trưởng cơ quan thuộc Chính phủ, Chủ tịch Ủy ban nhân dân các tỉnh, thành phố trực thuộc Trung ương trực tiếp chỉ đạo xây dựng Chương trình hành động của Bộ, ngành, địa phương mình, báo cáo Thủ tướng Chính phủ trước ngày 31 tháng 10 năm 2012; trên cơ sở đó, cụ thể hoá thành các nhiệm vụ trong kế hoạch công tác hàng năm.

3. Trên cơ sở các cơ chế, chính sách dự kiến tổ chức thực hiện, giao:

a) Bộ Tài chính, Bộ Giáo dục và Đào tạo, Bộ Y tế, các Bộ, cơ quan liên quan theo nhiệm vụ được giao tổ chức triển khai thực hiện có hiệu quả nội dung chương trình hành động của Chính phủ; xây dựng, ban hành và thực hiện các cơ chế chính sách thích hợp để từng bước xây dựng giá dịch vụ công thực hiện theo cơ chế thị trường gắn với chính sách hỗ trợ hợp lý đối với người có công, người nghèo, người có hoàn cảnh khó khăn và đồng bào dân tộc thiểu số; đối mới cơ chế tài chính đối với các lĩnh vực sự nghiệp công theo hướng tăng quyền tự chủ, tự chịu trách nhiệm của các cơ quan, đơn vị gắn với cơ chế đặt hàng giao nhiệm vụ cụ thể.

b) Trong năm 2012 - 2013, Bộ Tài chính, Bộ Giáo dục và Đào tạo, Bộ Y tế, các Bộ, cơ quan liên quan tập trung thực hiện các nhiệm vụ sau:

- Tổ chức đánh giá mô hình hoạt động của các đơn vị sự nghiệp đã tự đảm bảo kinh phí hoạt động thường xuyên trong thời gian qua, trên cơ sở đó xây dựng đề án thực hiện thí điểm tự chủ kinh phí hoạt động, đề xuất các chính sách khuyến khích, tạo điều kiện cho đơn vị thực hiện tốt cơ chế tự chủ.

- Lựa chọn danh sách các đơn vị trực thuộc có thể tham gia thí điểm thực hiện đối mới cơ chế hoạt động, cơ chế tài chính như sau:

+ Thí điểm thực hiện đặt hàng cung ứng dịch vụ đối với các loại hình dịch vụ ít có khả năng xã hội hóa nhưng Nhà nước có nhu cầu sử dụng và xã hội chưa có khả năng đáp ứng.

+ Thí điểm thực hiện giao quyền tự chủ hoạt động kết hợp với tự chủ tài chính cao trên cơ sở thí điểm thực hiện điều chỉnh cơ chế thu chi tài chính để bù đắp đủ chi phí hoạt động thường xuyên (từng bước tính đủ giá dịch vụ và giảm trợ cấp ngân sách), đa dạng hóa các nguồn thu.

c) Tổng kết kết quả thí điểm, báo cáo Thủ tướng Chính phủ để hoàn thiện cơ chế, chính sách và triển khai rộng trong năm 2014-2015.

4. Các Bộ trưởng, Thủ trưởng cơ quan ngang Bộ, Thủ trưởng cơ quan thuộc Chính phủ, Chủ tịch Ủy ban nhân dân các tỉnh, thành phố trực thuộc Trung ương tập trung chỉ đạo, tăng cường, kiểm tra, đôn đốc việc triển khai thực hiện Chương trình hành động này; định kỳ hàng năm báo cáo Thủ tướng Chính phủ tình hình thực hiện; đồng thời gửi báo cáo Bộ Tài chính để theo dõi, tổng hợp báo cáo Thủ tướng Chính phủ.

5. Trong quá trình tổ chức thực hiện Chương trình hành động này, nếu thấy cần sửa đổi, bổ sung những nội dung cụ thể của Chương trình, các Bộ, ngành, địa phương chủ động phối hợp với Bộ Tài chính báo cáo Thủ tướng Chính phủ xem xét, quyết định.

6. Bộ trưởng Bộ Tài chính căn cứ chức năng, nhiệm vụ, quyền hạn được giao, theo dõi, đôn đốc các Bộ, ngành, địa phương triển khai thực hiện Chương trình hành động này; định kỳ báo cáo, kiến nghị Chính phủ, Thủ tướng Chính phủ các biện pháp cần thiết nhằm bảo đảm Chương trình được thực hiện hiệu quả và đồng bộ./.

PROMULAGTING ACTION PROGRAM OF GOVERNMENT IN FURTHURANCE OF CONCLUSION NOTIFICATION OF THE MINISTRY OF POLITICSON SCHEME “RENEWING OPERATIONAL MECHANISM OF PUBLIC NON-BUSINESS UNITS, PUSHING UP SOCIALIZATIONOFSOME PUBLICNON-BUSINESSSERVICE TYPES”

GOVERNMENT

Pursuant to conclusion notification No.37-TB/TW of May 26, 2011 of the Ministry of politics on scheme “renewing operational mechanism of public non-business units, pushing up socializationofsome public non-business service types”;

At the request of the Minister of Finance;

RESOLVES:

Article 1.To promulgate together this Resolution the action program of Government in furthurance of conclusion notification No.37-TB/TW, of May 26, 2011 of Ministry of politics on scheme “renewing operational mechanism of public non-business units, pushing up socializationofsome publicnon-businessservice types”;

Article 2.This Resolution takes effect from the day of signing.

Article 3.Members of government, Heads of Governmental agencies, the Presidents of People’s Committees of central-affiliated cities and provinces shall implement this Resolution.

ACTION PROGRAM OF GOVERNMENT

IN FURTHURANCE OF CONCLUSION NOTIFICATION OF THE MINISTRY OF POLITICS ON SCHEME “RENEWING OPERATIONAL MECHANISM OF PUBLIC NON-BUSINESS UNITS, PUSHING UP SOCIALIZATIONOFSOME PUBLIC -BUSINESS SERVICE TYPES”
(Promulgated together with the Government’s Resolution No.40/NQ-CP, of August 09, 2012)

Part 1.

OBJECTIVE

To determine, assign and organize effective implementation of key tasks of state management agencies aiming to implement the conclusion notification of the Ministry of politics on continuing perform policies renewing operational mechanism of public non-business units, pushing up socialization of public non-business service in the next future with a higher decisive, a stronger and more synchronous and more comprehensive renewal, contributing in implementation of target that by 2020, our country basically become an modern-oriented - industrial country, material and spirit life of people is improved clearly.

Part 2.

KEY TASKS

Based on assigned functions, tasks, powers in state management, Ministries, Ministerial-level agencies, Government-attached agencies, People’s Committee of central-affiliated cities and provinces shall concentrate on implementation of the following key tasks:

I. TO RAISE AWARENESS ON RENEWING OPERATIONAL MECHANISM OF PUBLIC NON-BUSINESS UNITS AND PUSHING UP SOCIALIZATION OF SOME PUBLIC NON-BUSINESS SERVICE TYPES:

1.The functional agencies at levels implement propagation, education and mobilization aiming to grasp thoroughly and deeply, make unification on awareness in whole society, especially with respect to state agencies, political organizations, socio-political organizations, non-business units and cadres, civil servants, public employees regarding content and spirit of renewal of operational mechanism of public non-business units and push up socialization of some non-business service types.

2.The functional agencies at levels advise to Party Committee levels at same level in issuing and implementing Resolutions, Directions on policies, plans and specific measures aiming to create evolution in thought, raise awareness of society about necessary, urgency of renewal of operational mechanism of public non-business units, and encourage attraction of economical members for investment in development of non-public services, aiming to orient better service supply for all classes of people and ensure for persons subject to social policies and the poorer being accessed, enjoyed essential basic services with higher quality.

II.TO FINALIZE INSTITUTIONS TO ASSURE SYNCHRO OF ELEMENTS RENEWING OPERATIONAL MECHANISM OF PUBLIC NON-BUSINESS UNITS AND PUSH UP SOCIALIZATION OF SOME PUBLIC NON-BUSINESS SERVICE TYPES:

1.To finalize institutions on structure and investment methods of the State budget (NSNN):

a) State shall continue to keep decisive role, enhance investment in construction of material facilities of basic public non-business activities and restructure regular expenditure of the State budget for activities supplying public non-business service under way:

-The State budget ensure regular expenditure for public non-business units assigned task supplying public non-business services in areas with difficult social-economical condition, areas of ethnic minority groups, mountains, border areas and islands by state.

-To change basically methods of assistance from the State budget in supplying pubic non-business service, gradually turn from allocation of budget estimates for units supplying public non-business units as present into method of goods order, goods purchase on basis of technical- economical norm system and criterions, quality standards of each service type supplied by unit without discrimination whether public or non-public, aiming to make healthy competition, advantage environment, assure for public non-business units and non-public ones developed equality.

b) The state ensures implementation of policies assisting directly for meritorious people, poorer and ethnic minorities in order to access and enjoy basic essential public non-business services with higher quality; ensures expenditure of training, fostering teachers, lectures and management officers (principal,vice principal) of training establishments without discrimination whether public or non-public.

2.To finalize institutions on finance mechanism with respect to public non-business units:

a) To strengthen decentralization and implementation of assigning higher autonomy, self-responsibility for public non-business units synchronously in organization for implementation of task, human, finance (gradually being sufficient service price and reduce allowances from state budget) with calculation of characteristic of each unit type, capacity and demand of market and synchronously in management level.

b) To implement transparency of joint-venture and combination activities of public non-business units; to overcome confused situation between public and private; to renew mechanism of distribution under way of ensuring right and benefits of laborers and having accumulation in order to strengthen material facilities of public non-business units.

c) To implement renewal of financial mechanism with respect to group of public non-business units supplying non-business services that has high ability of socialization, self-ensures all expenditure for its activities (universities, hospitals and a few of vocational establishments after 2015)In way:Assigning autonomy, self-responsibility synchronously in organization for implementation of task, human, finance, properties upon supplying services and attached with demand of society; permitted to collect service price on the basis of frame price calculated sufficient reasonable and lawful expenditures promulgated by competent levels; allocated capital by state, defined value of properties assigned to public non-business units under mechanism of capital allocation for enterprises; permitted to decide mobilization of capital, use capital, properties attached to assigned tasks as prescribed in order to expand supply of non-business services, self-decide number of laborers and payment of salary on the basis of wage scales of state and effectiveness, quality of jobs.

d) For non-business units supplying normal services (especially economical non-business units):To formulate, promulgate and organize implementation of mechanism aiming to facilitate to convert activities under model of enterprises and then implement equitization as prescribed.

dd) To implement pilot contribution of stock capital for new establishment of some public non-business units, units under state group, corporation when perform equitization not perform equitization with respect to the existing - independent - public non-business units.

3.To finalize institutions on autonomy mechanism in implementation of tasks and organization of public non-business units:

a) To continue strengthening assignment, decentralization, assignment of autonomy, self-responsibility for tasks, organization of apparatus and number of laborers in public non-business units.To stipulate clearly competence and duty of heads in management and operation of non-business units; stipulate and implement mechanism of supervision, examination of duty of heads of public non-business units in their implementation of authority.

b) Renewal of mechanism of management of officers must ensure inheritance and development, adapt with implementation of autonomy and self-responsibility mechanism of public non-business units, in conformity with rules of market economy, ensure competition with non-public area, to attract talent persons with high level to participate in team of officers in order to increase service quality for people in all sectors.

4.To finalize institution on mechanism of goods order, goods purchase, assignment of task supplying public non-business services:

a) To formulate and promulgate system of technical- economical norms and criterions, standards of each non-business service type as basis for goods order and assignment of tasks.

b) To renew mechanism of calculation of priceofpublicnon-public products, servicesareordered; state shall stipulate price or frame price of products, services being basic, having essential role with society; gradually calculate rightly and fully for reasonable expenditures in price of non-business service, suitable with market and capacity of the State budget; implement with roadmap on delete subsidies by price, charge of service aiming to increase competition and ensure benefits of units supplying public non-business units.

5. To finalize institutions, push up implementation of incentive policy for socialization of public non-business services:

Continuing to renew, finalize and unfasten difficuls, problems in socialization, especially incentive policies on land, tax, credit aiming to encourage, mobilizie economical subjects domestic and offshore for positive participation in development of public non-business services.

6.To strengthen completion of management tools and role of examination, supervision of state management agencies with respect to activities of supply of public services aiming to orient better service supply for all classes of people, promote positive elements, restrain leffsides of market mechanism.Renewal of operational mechanism of public non-business units must combine with administrative procedure reform;modernization,computerization, information technology application in all activities of public non-business units.

Part 3.

ORGANIZATION FOR IMPLEMENT

1.The Ministry of Finance shall assume the prime responsibility for and submit to the Prime Minister for making decision on establishment of State Steering Committee of renewing operational mechanism of public non-business units and pushing up socialization of some public non-business service types.

2.On the basis of tasks, content of key job in this action program and enclosed Annex, based on function, task having been assigned, the Minister, heads of ministerial-level agencies, heads of Govermental agencies, the chairpersons of People’s Committees of central-affiliated cities and provinces shall direct formulation of action program of their Ministries, sectors and localities, report to the Prime Minister before October 31, 2021; on that basis, concretize tasks in annual work plan.

3.On the basis of mechanisms, policies expected to implement, assign:

a) The Ministry of Finance, the Ministry of Education and Training, the Ministry of Public Health, relevant ministries and agencies under assigned tasks, to effectively implement content of action program of Government; to formulate, promulgate and implement suitable mechanisms and policies in order to gradually formulate prices of public services performed under market mechanism attached to reasonable assistance policies for meritorious people, poorer, people with difficult circumstance and ethnic minorities; renew financial mechanism for non-business sectors in way of increase autonomy, self-responsibility of agencies, units attached with mechanism ofgoodsorder and assignment of specific tasks.

b) In year 2012-2013, the Ministry of Finance, the Ministry of Education and Training, the Ministry of Public Health, relevant ministries and agencies shall concentrate to implement the following tasks:

-To organize assessment of operational model of non-business units having ensured expenditures for regular activities in the past time, on that basis, to formulate scheme in pilot implementation of self-controllling operational expenditures, proposing incentive policy, to facilitate for units to well implement autonomy mechanism.

-To select list of affiliated units that may participate in pilot implementation of renewal of operational mechanism, financial mechanism as follows:

+ To implement pilotgoodsorder supplying service with respect to service types less capacity to implement socialization but state have demand of use and society has not capacity to supply.

+ To implement pilot assignment of autonomy in activities combinating with high financial autonomy based on pilot adjustment of financial implement of expenditure and revenue in order to remedy expenditures for regular activities (gradually calculate fully service prices and reduce allowances from budget), diversify revenues source.

c) To sum up pilot result, report to the Prime Minister for completion of mechanisms, policies and expanding in year 2014-2015.

4.Ministers, Heads of ministerial-level agencies, Heads of Governmental agencies, the Chairpersons of People’s Committees of central-affiliated cities and provinces shall concentrate on directing, strengthenning, examining, expediting implementation of this action program; annually report to the Prime Minister on performance; and send them tothe Ministry of Finance for monitoring, summing up and reporting to the Prime Minister.

5.In the course of implementation of this action program, if it is realized being necessary to amend and supplement specific contents of Program, ministries, sectors and localities shall be positive to coordinate with the Ministry of Finance to report to the Prime Minister for consideration and amking decision.

6.The Minister of Finance based on its assigned functions, tasks, powers,shall monitorate,expedite Ministries, sectors and localities to implement this action program; periodly report, propose to Government, the Prime Minister necessity measures aiming to ensure the program being implemented effectively and synchoronously.
