Lộ trình triển khai Cơ chế một cửa quốc gia

Ngày 14/11/2016, Thủ tướng Chính phủ đã ban hành Quyết định số 2185/QĐ-TTg về việc phê duyệt Kế hoạch tổng thể triển khai Cơ chế một cửa quốc gia và Cơ chế một cửa ASEAN giai đoạn 2016 - 2020.
Theo Kế hoạch, đến năm 2018, hoàn thành triển khai Cơ chế một cửa mở rộng ra phạm vi toàn quốc các thủ tục đối với phương tiện, hàng hóa vận tải vào, rời cảng biển, cảng thủy nội địa, cảng dầu khí ngoài khơi; các thủ tục đối với phương tiện vận tải vào, rời cảng hàng không thông qua cơ chế một cửa quốc gia; Triển khai các thủ tục hành chính có số lượng giao dịch nhiều, tác động lớn tới hoạt độn của các doanh nghiệp, tổ chức và người dân đạt ít nhất 80% trên tổng số các thủ tục hành chính của các bộ, ngành có liên quan đến hoạt động xuất khẩu, nhập khẩu hàng hóa; xuất cảnh, nhập cảnh, quá cảnh người và phương tiện vận tải.
Đến năm 2020, hoàn thành triển khai tất cả các thủ tục hành chính của các bộ, ngành tham gia quản lý hàng hóa xuất khẩu, nhập khẩu, quá cảnh; người và phương tiện vận tải xuất cảnh, nhập cảnh thông qua Cơ chế một cửa quốc gia; đảm bảo 100% các thủ tục hành chính thực hiện thông qua Cơ chế một cửa quốc gia được thu phí, lệ phí bằng phương thức điện tử.
Về việc thực Cơ chế một cửa ASEAN và trao đổi, xử lý chứng từ thương mại với các nước, khối - cộng đồng kinh tế, đến năm 2017, chính thức kết nối, trao đổi thông tin về giấy chứng nhận xuất xứ hàng hóa (C/O) mẫu D với các nước thành viên đã sẵn sàng. Đến năm 2018, thực hiện cung cấp Giấy chứng nhận xuất xứ hàng hóa, Giấy chứng nhận kiểm định động vật, thực vật, giấy chứng nhận an toàn thực phẩm, giấy phép rời cảng đường biển bằng phương thức điện tử đáp ứng mục tiêu tạo thuận lợi cho xuất khẩu hàng hóa.
Quyết định này có hiệu lực thi hành kể từ ngày ký.

VỀ VIỆC PHÊ DUYỆT KẾ HOẠCH TỔNG THỂ TRIỂN KHAI CƠ CHẾ MỘT CỬA QUỐC GIA VÀ CƠ CHẾ MỘT CỬA ASEAN GIAI ĐOẠN 2016 – 2020

Căn cứ Luật tổ chức Chính phủ ngày 19 tháng 6 năm 2015;

Căn cứ Luật hải quan ngày 23 tháng 6 năm 2014;

Căn cứ Luật công nghệ thông tin ngày 29 tháng 6 năm 2006;

Căn cứ Luật giao dịch điện tử ngày 29 tháng 11 năm 2005;

Căn cứ Nghị định thư về khung pháp lý để thực hiện Cơ chế một cửa ASEAN ký ngày 04 tháng 9 năm 2015;

Căn cứ Nghị định số 64/2007/NĐ-CP ngày 10 tháng 4 năm 2007 của Chính phủ về ứng dụng công nghệ thông tin trong hoạt động của cơ quan nhà nước;

Căn cứ Quyết định số 1899/QĐ-TTg ngày 04 tháng 10 năm 2016 về việc thành lập Ủy ban chỉ đạo quốc gia về Cơ chế một cửa ASEAN, Cơ chế một cửa quốc gia và tạo thuận lợi thương mại;

Xét đề nghị của Bộ trưởng Bộ Tài chính,

QUYẾT ĐỊNH:

Điều 1. Phê duyệt Kế hoạch tổng thể triển khai Cơ chế một cửa quốc gia và Cơ chế một cửa ASEAN giai đoạn 2016 - 2020 với những nội dung chủ yếu sau đây:

I. MỤC TIÊU CỦA KẾ HOẠCH

1. Mục tiêu tổng quát

a) Tất cả các thủ tục hành chính liên quan đến quản lý nhà nước đối với hàng hóa xuất khẩu, nhập khẩu, quá cảnh; người và phương tiện vận tải xuất cảnh, nhập cảnh, quá cảnh được thực hiện thông qua Cơ chế một cửa quốc gia dưới hình thức dịch vụ công trực tuyến cấp độ 4.

b) Tham gia và triển khai đầy đủ Cơ chế một cửa ASEAN theo đúng cam kết và lộ trình thực hiện của các nước ASEAN; sẵn sàng về mặt kỹ thuật để kết nối và trao đổi thông tin với các đối tác thương mại khác ngoài ASEAN theo các hiệp định và thỏa thuận mà Việt Nam là thành viên.

2. Mục tiêu cụ thể

a) Đến năm 2018:

- Hoàn thành triển khai mở rộng ra phạm vi toàn quốc các thủ tục đối với phương tiện, hàng hóa vận tải vào, rời cảng biển, cảng thủy nội địa, cảng dầu khí ngoài khơi; các thủ tục đối với phương tiện vận tải vào, rời cảng hàng không thông qua Cơ chế một cửa quốc gia.

- Triển khai các thủ tục hành chính có số lượng giao dịch nhiều, tác động lớn tới hoạt động của các doanh nghiệp, tổ chức và người dân đạt ít nhất 80% trên tổng số các thủ tục hành chính của các bộ, ngành có liên quan đến hoạt động xuất khẩu, nhập khẩu hàng hóa; xuất cảnh, nhập cảnh, quá cảnh người và phương tiện vận tải.

b) Đến năm 2020:

- Hoàn thành triển khai tất cả các thủ tục hành chính của các bộ, ngành tham gia quản lý hàng hóa xuất khẩu, nhập khẩu, quá cảnh; người và phương tiện vận tải xuất cảnh, nhập cảnh, quá cảnh thông qua Cơ chế một cửa quốc gia.

- Thời gian thông quan và giải phóng hàng hóa, người và phương tiện liên quan tới các thủ tục hành chính một cửa bằng với nhóm 04 nước dẫn đầu trong khu vực ASEAN.

- Đảm bảo 100% các thủ tục hành chính thực hiện thông qua Cơ chế một cửa quốc gia được thu phí, lệ phí bằng phương thức điện tử.

c) Các chứng từ điện tử (giấy phép điện tử, giấy chứng nhận điện tử và các giấy tờ điện tử tương đương) cấp thông qua Cơ chế một cửa quốc gia được sử dụng khi thực hiện các thủ tục hành chính khác có liên quan.

d) Thực hiện trao đổi và công nhận lẫn nhau về các chứng từ thương mại được cấp dưới dạng điện tử với các nước ASEAN và trao đổi, xử lý chứng từ thương mại với các nước, khối - cộng đồng kinh tế theo các thỏa thuận và cam kết quốc tế mà Việt Nam là thành viên.

II. GIẢI PHÁP

1. Hoàn thiện cơ sở pháp lý và cải cách thủ tục hành chính.

a) Xây dựng hành lang pháp lý đầy đủ cho việc sử dụng, trao đổi chứng từ điện tử, hồ sơ điện tử đối với thủ tục hành chính trong nước và các nước, khối - cộng đồng kinh tế.

b) Rà soát và tiến hành sửa đổi, bổ sung các văn bản quy phạm pháp luật theo định hướng: cắt giảm các thủ tục hành chính không cần thiết; đơn giản hóa quy trình thực hiện thủ tục hành chính; đơn giản hóa bộ hồ sơ, chứng từ cần phải nộp hoặc xuất trình theo hướng áp dụng tối đa chứng từ điện tử; sử dụng lại các thông tin, chứng từ điện tử, quyết định hành chính thuộc thành phần hồ sơ đã được lưu trữ trên Cổng thông tin một cửa quốc gia để thực hiện thủ tục hành chính thông qua Cơ chế một cửa quốc gia thay vì yêu cầu doanh nghiệp tổ chức nộp hoặc xuất trình các thông tin, chứng từ, quyết định hành chính đó.

c) Đảm bảo đầy đủ cơ sở pháp lý cho việc cung cấp dịch vụ công mức độ 4 thông qua Cơ chế một cửa quốc gia.

d) Xây dựng bộ dữ liệu quốc gia về biểu mẫu và chứng từ điện tử trong lĩnh vực hành chính và thương mại để áp dụng chung cho tất cả các thủ tục hành chính thực hiện thông qua Cơ chế một cửa quốc gia.

đ) Tạo thuận lợi thương mại thông qua áp dụng các phương pháp quản lý tiên tiến như quản lý rủi ro, kiểm tra sau.

e) Tạo cơ sở pháp lý cho việc sử dụng các dịch vụ do bên thứ ba cung cấp để đưa ra các tiện ích cho cả doanh nghiệp và các cơ quan nhà nước trong thực hiện thủ tục hành chính thông qua Cơ chế một cửa quốc gia và Cơ chế một cửa ASEAN.

2. Xây dựng, triển khai hệ thống công nghệ thông tin.

a) Hệ thống công nghệ thông tin phục vụ triển khai Cơ chế một cửa quốc gia được xây dựng và phát triển theo định hướng xử lý tập trung trên nền tảng Cổng thông tin một cửa quốc gia nhằm đáp ứng tiến độ triển khai theo cam kết của chính phủ, tiết kiệm và đảm bảo hiệu quả đầu tư, tận dụng nguồn lực cũng như tăng cường khả năng bảo mật, an toàn thông tin.

b) Hoàn thiện Cổng thông tin một cửa quốc gia sẵn sàng về mặt kỹ thuật để thực hiện Cơ chế một cửa ASEAN theo lộ trình và đảm bảo trao đổi, xử lý chứng từ thương mại với các nước, khối - cộng đồng kinh tế; giữa doanh nghiệp với doanh nghiệp nhằm tạo thuận lợi thương mại và tăng cường khả năng cạnh tranh quốc gia.

c) Đẩy mạnh thuê dịch vụ của bên thứ ba trong cung cấp các tiện ích cho cả doanh nghiệp và các cơ quan nhà nước trong thực hiện thủ tục hành chính thông qua Cơ chế một cửa quốc gia và Cơ chế một cửa ASEAN.

d) Tuân thủ các tiêu chuẩn kỹ thuật để đảm bảo cung cấp các dịch vụ công quốc gia theo Nghị quyết số 36a/NQ-CP ngày 14 tháng 10 năm 2015 của Chính phủ về Chính phủ điện tử.

3. Đào tạo, tuyên truyền và hỗ trợ.

a) Bộ Tài chính (Tổng cục Hải quan) chủ trì, phối hợp với các bộ, cơ quan liên quan xây dựng tài liệu tuyên truyền, hướng dẫn thực hiện Cơ chế một cửa quốc gia, Cơ chế một cửa ASEAN; xây dựng cơ chế và tổ chức hỗ trợ người sử dụng trên Cổng thông tin một cửa quốc gia.

b) Các bộ, cơ quan:

- Chủ động xây dựng kế hoạch, triển khai đào tạo, tuyên truyền, nâng cao nhận thức cho người dân, doanh nghiệp về Cơ chế một cửa quốc gia.

- Phối hợp với Bộ Tài chính (Tổng cục Hải quan) thực hiện các nhiệm vụ nêu tại điểm a khoản này.

- Xây dựng, cập nhật tài liệu tuyên truyền, hướng dẫn thực hiện Cơ chế một cửa quốc gia, Cơ chế một cửa ASEAN; hỗ trợ tổ chức, doanh nghiệp tham gia Cơ chế một cửa quốc gia; tổ chức đào tạo đội ngũ cán bộ chuyên trách về công nghệ thông tin đảm bảo đáp ứng yêu cầu nhiệm vụ được giao; đào tạo, tập huấn cho công chức thuộc các bộ, cơ quan mình thực hiện xử lý thông tin trên Cổng thông tin một cửa quốc gia; tuyên truyền nâng cao nhận thức về Cơ chế một cửa quốc gia.

4. Đảm bảo tài chính.

a) Nguồn kinh phí phục vụ cho triển khai Cơ chế một cửa quốc gia và Cơ chế một cửa ASEAN bao gồm:

- Nguồn thực hiện các chương trình, dự án, đề án có liên quan đã được phê duyệt lấy kinh phí từ ngân sách;

- Nguồn kinh phí từ các chương trình, dự án, đề án hỗ trợ của nước ngoài thông qua các kênh hợp tác quốc tế đa phương và song phương;

- Nguồn kinh phí của các bộ, cơ quan.

b) Ưu tiên bố trí nguồn vốn để thực hiện Kế hoạch từ ngân sách trung ương theo cơ chế hỗ trợ có mục tiêu.

c) Các bộ, ngành chủ động bố trí kinh phí để thực hiện Kế hoạch.

d) Cơ quan thường trực Ủy ban chỉ đạo quốc gia về Cơ chế một cửa ASEAN, Cơ chế một cửa quốc gia và tạo thuận lợi thương mại xây dựng kinh phí triển khai Cơ chế một cửa quốc gia và kinh phí đóng góp duy trì Cơ chế một cửa ASEAN, tổng hợp vào kinh phí hàng năm của Bộ Tài chính theo thỏa thuận giữa các nước thành viên ASEAN.

III. LỘ TRÌNH TRIỂN KHAI

1. Thực hiện Cơ chế một cửa ASEAN và trao đổi, xử lý chứng từ thương mại với các nước, khối - cộng đồng kinh tế:

a) Đến năm 2017: Chính thức kết nối, trao đổi thông tin về giấy chứng nhận xuất xứ hàng hóa (C/O) mẫu D với các nước thành viên đã sẵn sàng.

b) Đến năm 2018:

- Thực hiện cung cấp giấy chứng nhận xuất xứ hàng hóa, giấy chứng nhận kiểm dịch động thực vật, giấy chứng nhận an toàn thực phẩm, giấy phép rời cảng đường biển bằng phương thức điện tử đáp ứng mục tiêu tạo thuận lợi cho xuất khẩu hàng hóa.

- Thí điểm trao đổi ít nhất 01 loại chứng từ điện tử với một đối tác thương mại ngoài ASEAN của Việt Nam.

c) Đến năm 2020: Mở rộng việc trao đổi một số chứng từ điện tử trên cơ sở các cam kết quốc tế mà Việt Nam là thành viên để tạo thuận lợi hoạt động xuất khẩu, nhập khẩu hàng hóa và xuất cảnh, nhập cảnh, quá cảnh phương tiện vận tải.

2. Thực hiện Cơ chế một cửa trong nước:

a) Đến năm 2018: Triển khai, mở rộng dịch vụ công mức độ 4 tại các cửa khẩu chính trên phạm vi toàn quốc đối với các thủ tục hành chính tại Mục I Phụ lục I ban hành kèm theo Quyết định này.

b) Từ năm 2019 đến năm 2020: Triển khai, mở rộng dịch vụ công mức độ 4 trên phạm vi toàn quốc đối với các thủ tục hành chính tại Mục II Phụ lục I và Phụ lục II ban hành kèm theo Quyết định này.

Điều 2. Tổ chức thực hiện

1. Bộ Tài chính chủ trì, phối hợp với các bộ, cơ quan liên quan:

a) Thực hiện Kế hoạch triển khai Cơ chế một cửa quốc gia và Cơ chế một cửa ASEAN giai đoạn 2016 - 2020.

b) Xây dựng cơ chế phối hợp liên ngành để giải quyết các thủ tục hành chính có từ 02 cơ quan trở lên cùng tham gia giải quyết.

c) Bố trí kinh phí thường xuyên để thực hiện Kế hoạch.

2. Bộ Thông tin và Truyền thông chủ trì, phối hợp với Bộ Tài chính và cơ quan liên quan tổ chức thực hiện các giải pháp nêu tại khoản 2 Mục II Điều 1 Quyết định này.

3. Bộ Kế hoạch và Đầu tư chủ trì, phối hợp với Bộ Tài chính và cơ quan liên quan bố trí vốn đầu tư phát triển, vốn chương trình mục tiêu, vốn trái phiếu chính phủ (nếu có), vốn ODA để thực hiện Kế hoạch.

4. Các bộ, cơ quan tham gia quản lý hàng hóa xuất khẩu, nhập khẩu; người và phương tiện xuất cảnh, nhập cảnh, quá cảnh:

a) Ban hành chương trình hành động cụ thể thực hiện Kế hoạch tổng thể triển khai Cơ chế một cửa quốc gia và Cơ chế một cửa ASEAN giai đoạn 2016 - 2020 thuộc phạm vi bộ, cơ quan quản lý theo đúng nội dung, lộ trình đề ra trong Kế hoạch.

b) Thực hiện cải cách thủ tục hành chính; xây dựng, triển khai hệ thống thông tin đảm bảo thực hiện các dịch vụ công ban hành kèm theo Phụ lục I và Phụ lục II Quyết định này ở mức độ 4.

c) Thường xuyên rà soát danh mục các thủ tục hành chính để kiến nghị kịp thời Thủ tướng Chính phủ, Ủy ban chỉ đạo quốc gia về Cơ chế một cửa ASEAN, Cơ chế một cửa quốc gia và tạo thuận lợi thương mại sửa đổi, bổ sung Phụ lục I và Phụ lục II của Quyết định này cho phù hợp với thực tiễn triển khai của các bộ, cơ quan.

d) Chủ động xây dựng kế hoạch kinh phí dành riêng cho thực hiện Cơ chế một cửa quốc gia để bố trí vào dự toán kinh phí hàng năm của bộ, cơ quan mình.

đ) Phối hợp với Cơ quan thường trực xây dựng phương án triển khai hệ thống công nghệ thông tin thực hiện Cơ chế một cửa quốc gia và Cơ chế một cửa ASEAN phù hợp với điều kiện đặc thù của bộ, cơ quan mình.

e) Thực hiện các giải pháp nêu tại Mục II Điều 1 Quyết định này.

5. Cơ quan Thường trực Ủy ban chỉ đạo quốc gia về Cơ chế một cửa ASEAN, Cơ chế một cửa quốc gia và tạo thuận lợi thương mại chủ trì, phối hợp với các cơ quan, đơn vị liên quan:

a) Xây dựng và trình Ủy ban chỉ đạo quốc gia về Cơ chế một cửa ASEAN, Cơ chế một cửa quốc gia và tạo thuận lợi thương mại phê duyệt phương án triển khai hệ thống công nghệ thông tin thực hiện Cơ chế một cửa quốc gia và Cơ chế một cửa ASEAN.

b) Đề xuất và tổ chức triển khai phương án dự phòng, sao lưu, an ninh, an toàn, bảo mật và các nội dung liên quan khác đảm bảo cho việc vận hành, duy trì và nâng cấp hệ thống công nghệ thông tin đồng bộ, thống nhất đáp ứng yêu cầu triển khai Cơ chế một cửa quốc gia và Cơ chế một cửa ASEAN.

c) Xây dựng bộ dữ liệu quốc gia về biểu mẫu và chứng từ điện tử trong lĩnh vực hành chính và thương mại để áp dụng chung cho tất cả các thủ tục hành chính thực hiện thông qua Cơ chế một cửa quốc gia.

d) Hàng năm tổng hợp, báo cáo Thủ tướng Chính phủ tình hình triển khai Kế hoạch.

Điều 3. Quyết định này có hiệu lực thi hành từ ngày ký ban hành.

Điều 4. Các Bộ trưởng, Thủ trưởng cơ quan ngang bộ, Thủ trưởng cơ quan thuộc Chính phủ, Ủy ban chỉ đạo quốc gia về Cơ chế một cửa ASEAN, Cơ chế một cửa quốc gia và tạo thuận lợi thương mại và các tổ chức, cá nhân có liên quan chịu trách nhiệm thi hành Quyết định này.

THE PRIME MINISTER

Decision No.2185/QD-TTg dated November 14, 2016 of the Prime Minister approving the master plan of implementing national single window and ASEAN single window in the period of 2016 - 2020

Pursuant to the Law on Government organization dated June 19, 2015;

Pursuant to the Law on Customs dated June 23, 2014;

Pursuant to the Law on Information technology dated June 29, 2006;

Pursuant to the Law on Electronic transaction dated November 29, 2005;

Pursuant to Protocol on legal framework to implement ASEAN Single Window signed on September 4, 2015;

Pursuant to the Government s Decree No. 64/2007/ND-CP dated April 10, 2007 on application of information and technology in operation of regulatory agencies;

Pursuant to Decision No. 1899/QD-TTg dated October 4, 2016 on establishment of National Steering Committee for the ASEAN Single Window and National Single Window and facilitating trade;

At the request of the Minister of Finance,

DECIDES:

Article 1.To approve the master plan of implementing National Single Window and ASEAN Single Window in the period of 2016 - 2020 as follows:

I. OBJECTIVES

1. General objectives

a) All of administrative procedures for state management in exported, imported, and transited goods; inbound, outbound persons and vehicles, and persons and vehicles in transits shall be conducted through National Single Window in the form of online public services level 4.

b) Participate and initiate adequate contents of ASEAN Single Window in line with commitments and road map of ASEAN member countries; ensure technological preparedness to communicate and exchange information with non-ASEAN trade partners in accordance with agreements to which Vietnam is a signatory.

2. Specific objectives

a) By 2018:

- Complete the nationwide expansion of formalities applicable to vehicles and goods coming into and leaving seaports, inland ports, offshore oil terminals; formalities applicable to vehicles coming into and leaving airports through National Single Window.

- Initiate a number of administrative procedures with numerous transactions putting a significant impact on the operation of enterprises, organizations, and the people which are expected to reach at least 80% of total number of administrative procedures of line ministries and agencies relating to import and export of goods; entry, exit, and transit of people and vehicles.

b) By 2020:

- Complete the initiation of all administrative procedures of line ministries and agencies in charge of import and export of goods; entry, exit, and transit of people and vehicles through National Single Window.

- Duration of release and clearance of goods, peoples, and vehicles relating to single-window administrative procedures is expected to equal that of top 4 ASEAN member countries.

- 100% of administrative procedures conducted through National Single Window are charged electronically.

c) Electronic documents (electronic licenses, electronic certificates, and equivalent) issued through National Single Window is used for the other relevant administrative procedures.

d) Exchange and mutually recognize commercial documents issued electronically among ASEAN member countries and exchange and process commercial documents with countries and economic communities in accordance with international agreements and commitment to which Vietnam is a signatory.

II. MEASURES

1. Complete legal bases and reform administrative procedures.

a) Build an adequate legal framework for the purposes of using and exchanging electronic documents, electronic records in domestic administrative procedures and those between countries and economic communities and unions.

b) Review and amendlegislative documents with the following orientation:reducing unnecessary administrative procedures; simplifying administrative procedures; simplifying documents to be submitted or represented by making the most of electronic documents; reusing information, electronic documents, administrative decisions required to be kept on the national single-window system so as to conduct administrative procedures through the National Single Window instead of requiring enterprises to submit or represent such information, documents, oradministrative decisions.

c) Ensure sufficient legal bases for the provision of public services level 4 through National Single Window.

d) Formulate national data on forms and electronic documents in the fields of administration and trade applicable to all of administrative procedures conducted through National Single Window.

dd) Facilitate trade by applying advanced management method, namely risk management, post inspection.

e) Build legal bases for the use of services provided by a third party for economic operators and regulatory agencies to conduct administrative procedures through National Single Window and ASEAN Single Window.

2. Build and initiate the information technology system.

a) The information technology system serving the initiation of National Single Window is built and developed with the orientation to concentrated processing based on national single-window system for the purpose of meeting time schedule as committed by the Government, ensuring frugality and investment effectiveness, taking advantage of resources, and enhancing the information security and safety.

b) Ensure technological preparedness of national single-window system for the purpose of implementing ASEAN Single Window according to road map and ensure the exchange and processing of commercial documents between countries, economic communities and unions; among enterprises so as to facilitate the trade and strengthen national competitiveness.

c) Promote the use of services provided by a third party for economic operators and regulatory agencies to conduct administrative procedures through National Single Window and ASEAN Single Window.

d) Comply with technical standards for the purpose of provide national public services in accordance with Resolution No. 36a/NQ-CP dated October 14, 2015 of the Government on electronic government.

3. Training, propagation and support.

a) The General Department of Customs affiliated to the Ministry of Finance shall take charge and cooperate with relevant line ministries and agencies in formulating materials on propagation and guidelines for implementation of National Single Window, ASEAN Single Window; formulate policies and support users of national single-window system.

b) Ministries and agencies:

- Formulate plans and initiate training, propagation, and raise the people and enterprises’ awareness of National Single Window.

- Cooperate with the General Department of Customs affiliated to the Ministry of Finance in performing tasks prescribed in Point a hereof.

- Formulate and update materials on propagation and guidelines for implementation of National Single Window, ASEAN Single Window; support organizations and enterprises to participate in National Single Window; provide full-time staff with training in information technology so as to meet requirements for their assignments; provide their officials with training in processing information on the national single-window system; and raise the public awareness of National Single Window.

4. Ensure finance.

a) Sources of funds for implementation of National Single Window and ASEAN Single Window conclude:

- Funding for relevant programs and projects, which are approved financed by the budget;

- Funding for foreign programs and projects through multilateral and bilateral international cooperation channels;

- Funding of ministries and agencies.

b) Prioritize sources of funds provided by central government budget to implement the Plan under the dedicated support mechanism.

c) Ministries and agencies shall allocate funding themselves to implement the Plan.

d) The standing agency ofNational Steering Committee forASEAN Single Window, National Single Window and facilitating trade shall make budget estimates for implementation of National Single Window and contribution to ASEAN Single Window, and then include them in annual budget estimates of the Ministry of Finance as agreed upon between ASEAN member states.

III. ROAD MAP

1. Implement ASEAN Single Window and exchange and process commercial documents with countries and economic communities and unions:

a) By 2017: Officially connect and exchange information about certificates of origin (C/O) form D with available member states.

b) By 2018:

- Provide certificates of origin, phytosanitary and veterinary certificates, food safety certificates, port clearance electronically for the purpose of facilitating import of goods.

- Conduct a pilot program to exchange at least 1 electronic document with a trade partner in a non-ASEAN member state.

c) By 2020: Expand the exchange of some electronic documents in accordance with international commitments to which Vietnam is a signatory so as to facilitate the import and export of goods and entry, exit, and transit of vehicles.

2. Implement domestic single-window system:

a) By 2018: Initiate and expand public services level 4 at primary checkpoints nationwide applicable to administrative procedures in Section I Appendix I issued herewith.

b) From 2019 to 2020: Initiate and expand public services level 4 nationwide applicable to administrative procedures in Section II Appendix I and Appendix II issued herewith.

Article 2. Implementationorganization

1. The Ministry of Finance takes charge and cooperates with relevant ministries and agencies:

a) Implement the master plan of National Single Window and Asean Single Window in the period of 2016 – 2020.

b) Formulate an interdisciplinary coordination mechanism to process administrative procedures of at least 2 agencies involved.

c) Provide regular funding for implementation of the Plan.

2. The Ministry of Information and Communications take charge and cooperate with the Ministry of Finance and relevant agencies in implementing the measures prescribed in Clause 2 Section II Article 1 hereof.

3. The Ministry of Planning and Investment shall take charge and cooperate with relevant agencies in providing investment and development capital, target program capital, Government bonds (if any), and ODA capital to implement the Plan.

4. Ministries and agencies in charge of management of export and import of goods; entry, exit, and transit of people and vehicles:

a) Promulgate a specific action program for master plan for implementing National Single Window and ASEAN Single Window in the period of 2016 – 2020 within the scope of ministries and agencies in conformity with contents and road map specified in the Plan.

b) Reform administrative procedures; build and initiate the information technology system so as to provide public services issued together with Appendix I and Appendix II hereof at level 4.

c) Regularly review the list of administrative procedures to request necessary amendments to Appendix I and Appendix II of this Decision to the Prime Minister,National Steering Committee forASEAN Single Window, National Single Window and facilitating trade in accordance with the actual initiation of ministries and agencies.

d) Actively formulate plans for specific funding for implementation of National Single Window which is included in their annual budget estimates.

dd) Cooperate with standing agencies in formulating plans for initiation of the information technology system implementing National Single Window and ASEAN Single Window in conformity with their particular conditions.

e) Adopt measures prescribed in Section II Article 1 hereof.

5. The standing agency ofNational Steering Committee forASEAN Single Window and National Single Window and facilitating trade shall take charge and cooperate with relevant agencies in:

a) Formulating and submittingNational Steering Committee forASEAN Single Window and National Single Window and facilitating trade a plan for initiation of the information technology system implementing National Single Window and ASEAN Single Window for approval.

b) Propose and initiate a plan for backup, security, safety and confidentiality, and others to ensure the inauguration, maintenance, and upgrade of the information technology system synchronously and consistently meeting the requirements for implementing National Single Window and ASEAN Single Window.

d) Formulate national data on forms and electronic documents in the fields of administration and trade applicable to all of administrative procedures conducted through National Single Window.

d) Consolidate and submit annual reports on the implementation of Plan to the Prime Minister.

Article 3.This Decisiontakes effect on the signing date.

Article 4.Ministries, Heads of ministerial-level agencies, Heads of Governmental agencies, National Steering Committee for ASEAN Single Window, National Single Window and facilitating trade and relevant organizations and individuals shall implement this Decision.
