DECISION

On establishment of the management board of Hai Phong economic zone, Hai Phong city

THE PRIME MINISTER

Pursuant to the Law on Organization of the Government dated December 25, 2001;

Pursuant to the Government’s Decree No. 108/2006/ND-CP dated September 22, 2006 detailing and guiding the implementation of a number of articles of the Law on Investment;

Pursuant to the Government’s Decree No. 29/2008/ND-CP dated March 14, 2008, on industrial parks, export processing zones and economic zones;

Pursuant to the Prime Minister’s Decision No. 06/2008/QD-TTg dated January 10, 2008 on establishment and promulgation of operation regulations of Dinh Vu-Cat Hai economic zone, Hai Phong city;

Considering the request of the Chairperson of Hai Phong city People’s Committee in the Report No. 32/TTr-UBND dated September 01, 2008; and the request of the Minister of Home Affairs in the Report No. 2793/TTr-BNV dated September 12, 2008,

DECIDES:

Article 1. Establishment, the position and functions of the management board of Hai Phong economic zone, Hai Phong city

1. The management board of Hai Phong economic zone, Hai Phong city (hereinafter referred to as the management board) is established on the basis of reorganization of the management board of export processing zones and industrial parks, Hai Phong city (that was established under the Prime Minister’s Decision No. 240/TTg dated April 27, 1995).

2. The management board is an agency affiliated with Hai Phong city People’s Committee, performs the function of direct state management of Dinh Vu-Cat Hai economic zone and industrial parks in Hai Phong city, manages and organizes the implementation of the function of providing public administrative service and other support services relating to investment, production and business activities to investors in the economic zone and industrial parks in the city in accordance with law.

3. The management board has the legal person status, its own bank account and seal with national emblem, and is headquartered in Hai Phong city; it is the focal point of Hai Phong city’s budget planning and balanced separately the development investment capital from the central budget. Operation funding of the management board, funding for non-business operations under the management board are allocated by the state budget in accordance with law.

Article 2. Tasks and powers of the management board

The management board performs tasks and powers specified in:

1. Article 81 of the Government’s Decree No. 108/2006/ND-CP dated September 22, 2006 detailing and guiding the implementation of a number of articles of the Law on Investment;

2. Articles 37 and 38 of the Government’s Decree No. 29/2008/ND-CP dated March 14, 2008, on industrial parks, export processing zones and economic zones;

3. Articles 26 and 27 of the operation regulations of Dinh Vu-Cat Hai economic zone, Hai Phong city issued together with the Prime Minister’s Decision No. 06/2008/QD-TTg dated January 10, 2008;

4. Other relevant legal documents.

Article 3. Organizational structure and payroll of the management board

1. Leadership:

The management board has the head and no more than 03 deputy heads.

The head is appointed and relieved of duty by the Chairperson of Hai Phong city People's Committee according to the title criteria promulgated by the Ministry of Planning and Investment; The deputy heads are appointed and relieved of duty by the Chairperson of Hai Phong city People's Committee at the proposal of the head.

2. Organizational structure:

a) Administrative organizations include: office and professional divisions;

b) Affiliated non-business organizations.

Based on development requirements and tasks of Dinh Vu-Cat Hai economic zone and industrial parks in Hai Phong city, in each specific period, the head of the management board shall assume the prime responsibility for, and coordinate with relevant departments, agencies and branches in, submitting to the Chairperson of Hai Phong city People's Committee for decision on the management board’s organizational apparatus according to the competence.

3. Payroll:

a) Its administrative payroll includes: The head, full-time deputy heads and payroll of its office and professional divisions decided by the Hai Phong city People's Committee in the total administrative payroll assigned;

b) Its non-business payroll shall be decided by the Chairperson of Hai Phong city People's Committee in accordance with law on decentralization of administrative and non-business payroll management and payroll management mechanism applicable to non-business units of the State.

4. Head of the management board shall submit the Hai Phong city People’s Committee for detailing the functions, tasks, powers and organizational structure of the management board under law.

Article 4. Effect

This Decision takes effect on the signing date and replaces the Prime Minister’s Decision No. 240/TTg dated April 27, 1995 on establishment of the management board of export processing zones and industrial parks, Hai Phong city.

Article 5. Implementation responsibility

Ministers, heads of ministerial-level agencies, heads of government-attached agencies, chairperson of Hai Phong city People’s Committee, head of the management board of Hai Phong economic zone, Hai Phong city shall take the responsibility for the implementation of this Decision./.
