TEMPORARY GUIDANCE

On implementation of the Government's Resolution No. 128/NQ-CP dated October 11, 2021 promulgating the temporary regulation on “Safe and flexible adaptation and effective control over the COVID-19 pandemic” in cultural, sports and tourism activities

In implementing the Government's Resolution No. 128/NQ-CP dated October 11, 2021 promulgating the temporary regulation on "Safe and flexible adaptation and effective control over the COVID-19 pandemic", the Ministry of Culture, Sports and Tourism promulgates the temporary guidance on safe and flexible adaptation and effective control over the COVID-19 pandemic in cultural, sports and tourism activities as follows:

A. GENERAL REQUIREMENTS UPON ORGANIZATION OF CULTURAL, SPORTS AND TOURISM ACTIVITIES

I. GENERAL REQUIREMENTS

1. Developing plans on organization of cultural, sports and tourism activities and plans for disease prevention and control at each level, assuming the responsibility for implementing COVID-19 prevention and control measures as prescribed.

2. Creating QR codes of COVID-19 checkpoints to manage people entering and leaving the locations under management and making health declarations in accordance with Minister of Health's Decision No. 2666/QD-BYT dated May 29, 2021.

3. Monitoring the health of  organizers of events and daily service activities; not employing persons who have any of the following symptoms: fatigue, fever, cough, sore throat, shortness of breath, etc. and persons being F1/F2 cases; asking organizers of events and daily service activities to measure their body temperature and monitor their health at home before coming to the workplace; in cases where a person detects  symptoms of fever, cough, sore throat or shortness of breath, etc., he/she shall not be present at the workplace and must notify the local health establishment and his/her managing unit for advice and handling as prescribed.

4. At entrance areas of ​​venues of events and service activities: checking body temperature, asking employees and participants to make health declarations, disinfect hands, wear facemasks and keep a safe distance according to regulations; arranging panels on disease prevention and control; fully arranging hand sanitizers; drawing spacing lines at the entrances to venues as prescribed; controlling and managing persons entering the venues, and taking measures to control the density of such persons to ensure disease prevention and control regulations. Asking all organizers of such events to adhere to the “5K Rules”.

5. Formulating plans to arrange temporary quarantine rooms/areas (hereinafter referred to as quarantine rooms) for organizers/participants who have any of the symptoms of fever, cough, sore throat or shortness of breath, etc. or F0/F1/F2 cases upon working. Quarantine areas must satisfy the requirements of the Ministry of Health.

6. Fully arranging waste containers with lids and hand washing areas, toilets, ensuring sufficient clean water and soap or hand sanitizers.

7. Disseminating, reminding, inspecting and supervising the implementation of COVID-19 prevention and control measures as well as the health situation of organizers.

8. Assuming the responsibility for coordinating with local competent health agencies upon request.

9. Requirements for participants: adhering to the "5K Rules", complying with law provisions on COVID-19 prevention and control measures, regulations of local administration, health agencies and organization committees; using information technology applications to make health declarations as prescribed.

10. In cases where the Government and the National Steering Committee for COVID-19 Prevention and Control, and the Ministry of Health promulgates new regulations on COVID-19 prevention and control for the subjects applied in this Guidance, the new regulations shall prevail.

II. REQUIREMENTS FOR ORGANIZATION OF ACTIVITIES ACCORDING TO PANDEMIC RISK LEVELS

1. The determination of pandemic risk level shall comply with the Government's Resolution No. 128/NQ-CP dated October 11, 2021 and the Minister of Health's Decision No. 4800/QD-BYT dated October 12, 2021.

2. With regard to areas of level-1 pandemic risk, the organization of cultural, sports and tourism activities must comply with the contents in Clause 1, Section I, Part A of this Guidance.

B. SPECIFIC GUIDELINES FOR EACH PANDEMIC RISK LEVEL

I. CULTURE

1. With regard to cultural activities serving political tasks; exhibition activities; events celebrating anniversaries, founding days, traditional days or response days

a) With regard to areas of level-2 pandemic risk:

- Reducing the scale and level, changing the form of organization according to the pandemic situation and local regulations.

- Reducing 30% of delegates and guests according to the approved plan.

b) With regard to areas of level-3 pandemic risk:

- Reducing the scale and level, changing the form of organization according to the pandemic situation and local regulations.

- Reducing 50% of delegates and guests according to the approved plan. Limiting guests from other localities.

- Strengthening propaganda on the purpose and meaning of anniversaries, traditional days, founding days and response days on mass media.

c) With regard to areas of level-4 pandemic risk:

Stopping organization of activities. Promoting propaganda on anniversaries, traditional days, founding days and response days on mass media, websites, and propaganda publications.

2. With regard to festival activities

a) With regard to areas of level-2 pandemic risk:

- Reducing the scale and adjusting the form and time of festivals; reducing the organization of festival activities to ensure the requirements on disease prevention and control according to the pandemic situation and local regulations.

- Reducing 50% of delegates and guests according to the approved plans.

- Strengthening propaganda and introduction about the origin of festivals, relics and personalities being worshiped and honored; true values ​​and meanings of traditional beliefs and rituals.

b) With regard to areas of level-3 pandemic risk:

- Only organizing ceremonies without festival activities.

- Not inviting guests to attend such ceremonies.

c) With regard to areas of level-4 pandemic risk: Stopping organization of festivals.

3. With regard to operation of libraries; cinemas; facilities and venues for cultural and artistic performances

a) With regard to areas of level-2 pandemic risk:

- Reducing 50% of guests, spectators, and readers served.

- Implementing periodic disinfection measures in accordance with the guidance of the Ministry of Health.

- Equipping tables of regulations guiding the implementation of COVID-19 prevention and control measures.

b) With regard to areas of level-3 pandemic risk:

- Reducing 70% of guests, spectators, and readers served.

- Implementing periodic disinfection measures in accordance with the guidance of the Ministry of Health.

- Equipping tables of regulations guiding the implementation of COVID-19 prevention and control measures.

c) With regard to areas of level-4 pandemic risk: Stopping organization of activities.

4. With regard to operation of monuments and museums

a) With regard to areas of level-2 pandemic risk:

- Only serving visitor groups of no more than 20 persons/group; ensuring a safe distance and fully complying with regulations on disease prevention and control.

- Implementing periodic disinfection measures in accordance with the guidance of the Ministry of Health.

- Equipping tables of regulations guiding the implementation of COVID-19 prevention and control measures.

- Tour guides and narrators shall receive at least one dose of COVID-19 vaccine for 14 days or more or have recovered from COVID-19 within 6 months or have negative test certificate for COVID -19 in accordance with regulations of Provincial-level Department of Health.

b) With regard to areas of level-3 pandemic risk:

- Only serving visitor groups of no more than 10 persons/group; ensuring a safe distance and fully complying with regulations on disease prevention and control.

- Implementing periodic disinfection measures in accordance with the guidance of the Ministry of Health.

- Equipping tables of regulations guiding the implementation of COVID-19 prevention and control measures.

- Tour guides and narrators shall receive at least one dose of COVID-19 vaccine for 14 days or more or have recovered from COVID-19 within 6 months or have negative test certificate for COVID -19 in accordance with regulations of Provincial-level Department of Health.

c) With regard to areas of level-4 pandemic risk: Stopping organization of activities.

II. SPORTS

1. Physical and sports activities:

1.1. Outdoor physical and sports activities

Participants in outdoor physical and sports activities must keep a minimum distance of 2m and proactively practice cleaning and disinfecting surfaces for training sites and equipment.

a) With regard to areas of level-2 pandemic risk:

- Limiting outdoor physical activities in large groups. In cases of group training, not gathering more than 50 people per group; keeping a safe distance and maintaining a minimum exercise density of 4m2/person; adhering to the one-way principle in group training.

- Instructors and organizers of outdoor physical and sports activities shall receive at least one dose of COVID-19 vaccine for 14 days or more or have recovered from COVID-19 within 6 months or have negative test certificate for COVID -19 in accordance with regulations of Provincial-level Department of Health.

b) With regard to areas of level-3 pandemic risk:

- Limiting outdoor physical activities in large groups. In cases of group training, not gathering more than 20 people per group; keeping a safe distance and maintaining a minimum exercise density of 6m2/person; adhering to the one-way principle in group training.

- Instructors and organizers of outdoor physical and sports activities shall receive at least one dose of COVID-19 vaccine for 14 days or more or have recovered from COVID-19 within 6 months or have negative test certificate for COVID -19 in accordance with regulations of Provincial-level Department of Health.

c) With regard to areas of level-4 pandemic risk: Stopping outdoor physical and sports activities in public areas.

2.2. Indoor physical and sports activities

Participants in indoor physical and sports activities must receive at least one dose of COVID-19 vaccine for 14 days or more or have recovered from COVID-19 within 6 months or have negative test certificate for COVID -19 in accordance with regulations of Provincial-level Department of Health.

Sports facilities and providers of indoor physical and sport services shall assume the responsibility for developing plans on COVID-19 prevention and control and plans for handling  cases infected with COVID-19 in accordance with regulations; implementing QR code scanning, collecting information on participants in indoor physical activities as well as service users (collecting directly or online via QR code or health declarations) on a daily basis; ensuring sufficient disinfectant solution, hand sanitizers and soap at training and competition areas. Gym must ensure good ventilation and encourage natural ventilation while being equipped with tables of regulations guiding trainees to implement regulations on COVID-19 prevention and control under the direction of the Prime Minister, the National Steering Committee and the Ministry of Health.

a) With regard to areas of level-2 pandemic risk:

- Reducing the scale of gym (not exceeding 70% of maximum occupancy); service providers must clean and disinfect equipment and facilities on a daily basis.

- Instructors and participants in physical and sports activities shall receive at least one dose of COVID-19 vaccine for 14 days or more or have recovered from COVID-19 within 6 months or have negative test certificate for COVID -19 in accordance with regulations of Provincial-level Department of Health.

b) With regard to areas of level-3 pandemic risk:

- Limiting the number of participants (not exceeding 30% of maximum occupancy). For gyms with closed design, without ventilation, at risk of spreading diseases may be temporarily suspended from operations.

- Training instructors and participants in physical training and sports activities must receive 2 doses of COVID-19 vaccine or have recovered from COVID-19 within 6 months or have negative test certificate for COVID -19 in accordance with regulations of Provincial-level Department of Health.

- Service providers shall assume the responsibility for implementing disinfection measures on a weekly basis; performing cleaning and disinfection of equipment and facilities on a daily basis.

c) With regard to areas of level-4 pandemic risk: Stopping operation of indoor physical and sports service providers.

2. Sport competitions

Tournament Organization Committees or sport tournament organizers shall assume the responsibility for  developing and implementing plans to ensure COVID-19 prevention and control and submit such plans to competent agencies for approval within at least 15 days before opening such tournaments (including inspecting, testing, ensuring safety for participants and spectators and plans to coordinate with health agencies in handling upon detecting new cases infected with COVID-19; taking disinfection measures and cleaning equipment and tools).

a) With regard to areas of level-2 pandemic risk:

- Reducing the scale and adjusting the form of sports tournaments to ensure the requirements for disease prevention and control in each locality.

- Limiting the number of spectators; not exceeding 50% of maximum occupancy.

- Competition participants, tournament organizers, and spectators from areas of level-3 pandemic risk must receive at least one doses of COVID-19 vaccine for 14 days or more or have recovered from COVID-19 within 6 months or have negative test certificate for COVID -19 within a period of no more than 72 hours before opening such tournaments.

b) With regard to areas of level-3 pandemic risk:

- Limiting the organization of large-scale sports tournaments; only organizing provincial-level sports tournaments with limited scale; mass sports tournaments with a large number of participants shall only be held outdoor in open spaces.

- Athletes, competition participants, tournament organizers and spectators must receive at least one doses of COVID-19 vaccine for 14 days or more or have recovered from COVID-19 within 6 months or have negative test certificate for COVID -19 within a period of no more than 72 hours before opening such tournaments.

- With regard to sports tournaments with a large number of spectators such as football matches, the maximum capacity of stands shall not exceed 30%. In cases of necessity, competitions without spectators may be organized.

c) With regard to areas of level-4 pandemic risk: Stopping organization of sports competitions.

3. Activities of training and coaching athletes

3.1. With regard to athletes, coaches, professional staff, service staff who have received 2 doses of COVID-19 vaccine

a) With regard to areas of level-2 pandemic risk:

- Monitoring their health within 7 days from the date of arrival at training facilities.

- Limiting leaving training facilities during training.

b) With regard to areas of level-3 pandemic risk:

- Monitoring their health within 14 days from the date of arrival at training facilities.

- Limiting leaving training facilities during training.

c) With regard to areas of level-4 pandemic risk:

- Imposing concentrated quarantine measures for 7 days; then monitoring their health for 7 days from the date of arrival at training facilities.

- Having negative COVID-19 test result by RT-PCR within 72 hours before gathering at training facilities.

- Not leaving training facilities during the training session.

3.2. Athletes, coaches, professional staff, service staff who have not received 2 doses of COVID-19 vaccine

a) With regard to areas of level-2 pandemic risk:

- Monitoring their health within 7 days from the date of arrival at training facilities.

- Having negative COVID-19 test results by RT-PCR method before gathering at training facilities.

- Limiting leaving training facilities during the training session.

b) With regard to areas of level-3 pandemic risk:

- Monitoring their health within 14 days from the date of arrival at training facilities.

- Having negative COVID-19 test results by RT-PCR method before gathering at training facilities.

- Limiting leaving training facilities during the training session.

c) With regard to areas of level-4 pandemic risk:

- Imposing concentrated quarantine measures for 7 days; then monitoring their health for 7 days from the date of arrival at training facilities.

- Having negative COVID-19 test results by RT-PCR method before gathering at training facilities.

- Having negative COVID-19 test results by RT-PCR within 72 hours before gathering at training facilities.

- Not leaving training facilities during the training session.

III. TOURISM

1. Subjects of application

1.1. Travel enterprises, tourist transport enterprises, organizations/individuals that manage tourist sites, attractions or accommodation establishments and engage in tourism services (hereinafter referred to as tourism business establishments); employees working in tourism business establishments.

1.2. Tourists, service users in tourism business establishments, persons who come for contact or work, suppliers of materials, goods and services for tourism business establishments.

2. Medical testing

2.1. Conducting medical testing for cases with one of the symptoms of fever, cough, fatigue, sore throat, shortness of breath, etc.; conducting random and periodic screening tests by health agencies;

2.2. With regard to all pandemic risk levels, only one of the following cases is required to conduct medical testing:

- Being suspected COVID-19 cases or subject to indication of epidemiological investigation from area of level-3 pandemic risk;

- Coming from areas of level-4 pandemic risk or areas imposed medical isolation measure (lockdown areas); guests being residents of the areas are not required to conduct medical testing.

2.3. With regard to persons who have fully vaccinated for COVID-19 and have recovered from COVID-19, only one of the following cases is required to conduct medical testing:

- Upon request for epidemiological investigation;

- Coming from areas of level-4 pandemic risk or areas imposed medical isolation measure (lockdown areas).

2.4. Testing for COVID-19 according to the real time RT-PCR method or rapid antigen test is valid within 72 hours (from receipt of results).

3. Requirements for tourism business establishments

3.1. General requirements

a) With regard to areas of level-2 pandemic risk:

- Tourism activities are organized at 100% of capacity.

b) With regard to areas of level-3 pandemic risk:

- Only organizing sightseeing activities at tourist sites, attractions; indoor gathering events and group tour programs with less than 25 persons;

- Tourist accommodation and food services in tourism business establishments may operate at no more than 50% of occupancy at the same time; means of visitor transport shall not use more than 50% of the seats; services with high risk of infection such as discotheques, karaoke parlors, massage facilities, bars, internet shops, electronic game shops, barbering shops, beauty salons and other services shall comply with regulations of People's Committees of provinces and centrally-run cities;

- Tourist accommodation establishments that receive quarantined guests at the request of competent agencies must fully comply with disease prevention and control requirements of local health agencies;

- Tourist accommodation establishments that are serving guests at more than 50% of occupancy shall not receive new guests.

b) With regard to areas of level-4 pandemic risk:

- Stopping sightseeing activities at tourist sites and attractions; stopping organization of indoor events that gather more than 20 persons; stopping tourism programs in the areas and stopping travel from/to such areas;

- Tourist accommodation and food services in tourism business establishments may operate at no more than 30% of occupancy at the same time; means of visitor transport shall not use more than 50% of the seats; services with high risk of infection such as discotheques, karaoke parlors, massage facilities, bars, internet shops, electronic game shops, barbering shops, beauty salons and other services shall comply with regulations of People's Committees of provinces and centrally-run cities;

- Tourist accommodation establishments that receive quarantined guests at the request of competent agencies must fully comply with disease prevention and control requirements of local health agencies;

- Tourist accommodation establishments that are serving guests at more than 30% of occupancy shall not receive new guests.

3.2. Specific requirements

a) Developing plans for COVID-19 prevention and control and plans for handling cases infected with COVID-19 according to regulations. Appointing leaders to be in charge of and monitor COVID-19 prevention and control. Making health monitoring books and checking body temperature of employees before entering the workplace. Employees with symptoms of fever, cough, sore throat, shortness of breath must be tested for SARS-CoV-2 or take time off work and monitor their health at home.

b) Arranging reception areas, doors and aisles at the right distance according to the guidance of the Ministry of Health. Posting QR codes and information boards guiding COVID-19 prevention and control at reception areas, on tourist transport, venues for service users and in bedrooms of tourist accommodation establishments.

c) Checking body temperature of service users and persons coming for contact or work, suppliers of materials, goods and services in areas of level-3 or level-4 pandemic risk; providing facemasks to guests when needed.

d) Arranging hand washing basins with clean water, soap, dry hand wipes or providing alcohol-based hand hygiene products at reception areas, service areas, elevators, rooms, committees and dressing rooms of officials and employees in accordance with the guidance of the Ministry of Health.

dd) Regularly carrying out the process of cleaning and disinfecting public areas, places for crowded services, means of transport, tourist accommodation establishments, equipment and tools serving tourists according to the guidance of health agencies.

e) Laundry in tourism business establishments and guests' clothes shall be collected and transferred to laundry areas according to the guidance and recommendations of health agencies.

g) Establishing and publishing a hotline for exchanging information and supporting customers. Immediately notifying local health agencies if detecting persons showing signs of COVID-19 infection.

h) Tourism business establishments must register and self-assess COVID-19 safety on a daily basis at http://safe.tourism.com.vn to connect to the national COVID safety system.

i) Employees shall be guided and disseminated regulations on COVID-19 prevention and control; adhering to the “5K Rules” in the workplace; performing medical testing as prescribed in Clause 2, Section III of this Guidance.

4. Requirements for tourists, tourism service users and persons coming for contacting or working with tourism business establishments

4.1. Following the “5K Rules”; making health declarations as prescribed or scanning QR code.

4.2. Fully complying with the regulations of the National Steering Committee for COVID-19 prevention and control, the Ministry of Health and the rules of tourism business establishments.

4.3. Complying with the regulations on medical testing as prescribed in Clause 2, Section III, Part B of this Guidance.

C. ORGANIZATION OF IMPLEMENTATION

1. People's Committees of provinces and centrally-run cities

Directing departments, agencies, sectors and localities to coordinate in organizing the implementation of this Guidance.

2. Ministerial units

2.1. The Department of Grassroots Culture

- Assuming the prime responsibility for, and coordinating with the Vietnam National Administration of Tourism and the General Department of Physical Training and Sports, in implementing, summarizing and reporting to ministerial leaders on the results of implementation.

2.2. The Vietnam National Administration of Tourism and the General Department of Physical Training and Sports

- Publishing information on their media;

- Organizing, urging and inspecting the implementation of this Guidance;

- Coordinating with localities to summarize the situation and evaluate the implementation results; reporting to the leaders of the Ministry of Culture, Sports and Tourism on a monthly basis or upon new and complicated developments of the pandemic.

2.3. The Information Technology Center, Culture Newspaper, National Electronic Newspaper

Publishing this Guidance and information on COVID-19 prevention and control in cultural, sports and tourism activities.

3. Provincial-level Departments of Culture, Sports and Tourism, provincial-level Departments of Culture and Sports, provincial-level Departments of Culture, Information, Sports and Tourism, provincial-level Departments of Tourism:

- Guiding the organization of cultural, sports and tourism activities in their localities to ensure above-mentioned COVID-19 prevention and control measures; organizing the inspection and examination as prescribed;

- Publishing information on their media about this Guidance and  regulations on COVID-19 prevention and control in cultural, sports and tourism activities;

- Regularly inspecting and urging the implementation; reporting to competent agencies on a monthly basis or upon request;

4. Upon problems or inadequacies in the implementation of this Guidance, federations, associations, organizations and individuals shall promptly report to the Ministry of Culture, Sports and Tourism for consideration and modification./.
